SR-6-L (13) . . 6-1- 2. //- 003 NfW 1 3 1990 SS:SS:NM:sdg council Meeting: November 13, 1990 Santa Monica, California (nmbins) TO: Mayor and city Council FROM: City staff SUBJECT: Recommendation to Direct city Attorney to Prepare Ordinance Establishing Fees for Properties that store Refuse Bins on city Property Introduction This is a request to direct the city attorney to prepare an ordinance establishing fees for property owners who use City property (usually alleys) to store refuse containers. A $15 per month minimum fee per bin is proposed. Background Due to building and parking constraints many businesses and residential properties do not have sufficient space on their property to store refuse containers. Consequently, refuse containers for these properties are placed and remain in City alleys and parkway areas. Previously, the City has not charged these property owners for the use of City property. However, staff is currently making many changes to the City's refuse service to improve efficiency and to improve the appearance of the City's alleys and other right-of-ways. staff believes that imposing a fee for use of City property will provide some incentive for these property owners to locate space on their property for the refuse bins, thus resulting in less cluttered alleys and parkways. Those - 1 - b-L ~..~(j: ~~ - I}~(t . ~ V .~....!I -- . . properties not relocating their trash bins from City property will pay the city a fee calculated at the current use of public property rental rate of 50 cents per square foot per month as compensation. The fee also will apply to refuse bins for those businesses that use private refuse service. By establishing this fee, it is not the intent to give property owners an option of using city property for refuse bin storage. Rather, storage of these containers on City property will only be permitted if there is no appropriate location on private property. BUdget/Financial Impact It is estimated that there are approximately 200 locations where property owners place refuse bins on city property. staff assumes that 90% of the bins at these locations will remain on public property after the adoption of this Resolution. Therefore, assuming an effective date of March 1, 1990, revenues in the amount of $10,800 (180 bins x $15 x 4 months) will be generated and deposited in the General Fund Account 01-500-401-00000-0061-10000 during the FY 1990-91. The full year impact in FY 1991-92 is estimated to be $32,400 (180 bins x $15 x 12 months). Recommendation It is recommended that Council direct the City Attorney to prepare an ordinance establishing fees for property owners who use City property to store refuse containers. Resolution CCS A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ESTABLISHING A FEE FOR STORING REFUSE BINS ON CITY PROPERTY WHEREAS, it has been determined that it is in the best interest of the city for property owners to provide adequate storage area for refuse bins on their private property~ and, WHEREAS, there are many properties that currently use City property to store refuse containers provided by the City and by private refuse companies~ and, Whereas, other private uses of city property are required to compensate the City for use of this property~ and, WHEREAS, section 7151 of the Santa Monica Municipal Code allows fees to be established for the storage of refuse containers on City property, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The charge for storing each refuse container up to four cubic yard capacity on City property will be Fifteen Dollars ($15) per month. SECTION 2. This charge of Fifteen Dollars ($15) per month per bin will apply to all properties using City property for this purpose whether the bin is owned by the City or a private company. This full monthly fee will apply for any portion of any month that the bin is stored on City property. - 4 - . . SECTION 3. This fee shall become effective on November 1, 1990, or upon its administrative implementation, whichever occurs last. SECTION 4. The city Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
