In NovemberJ 1983, thIS OffIce sent a letter to the 321
Club's attorney puttIng hIm on notIce of the CIty'S position
that the club's operatIons were contrary to the terms Imposed
upon It by a Type 57 license. (See Attachment 1.) ThIS OffIce
was then Informed that the 321 Club was beIng sold and that an
ABC lIcense transfer applIcatIon was pendIng. The ABC has
Informed thiS OffIce that no action has occurred on the

transfer and that It appears the proposed sale wIll not take
place.
Despite the concerns expressed In the November, 1983
letter, the operations of the 321 Club have essentially
remained unchanged. In fact, the club has been the source of
several cItIzen complaInts. The VICinity of the club has been
the location for numerous crimes resultIng In a
dIsproportionately hIgh demand on polIce resources. The
attached crIme and InCident log for the perIod of January
through September, 1984 demonstrates thi s fact. (See
Attachment 2.)
The ABC IS required to hold publIC hearlngs~ pursuant to
SectIon 24203 of the BUSIness and ProfessIons Code) If
accusatIons against anyon-sale licensee are filed with the
ABC by any legIslative body Or chIef of polIce. Upon receipt
of such a complaint the ABC shall prOVide for a pUblIc hearing
within the county in which the premIses IS located. If the
legIslatIve body or chIef of polIce certifIes that the publIc
safety, health or welfare requIres an Immediate hearIng, the
publIC hearIng shall be held wlthln 60 days of the fIllng of
the accusatIons.

ThlS letter ~s written with respect to the operations of
the above-referenced club located at 321 Santa Monica
Boulevdrd in Santa Monica. I have been directed to write this
letter at the request of the Clty Council at its meeting of
October 9, 1984. (A copy of the City Councll's resolution on
thlS matter ~s enclosed.)
As you know, the operator of this club has a T~pe 57
speclal on-sale general license. It is the Ci ty Counci l' s
understanding that such a license can only be issued to a club
or organlzation which meets the requirements of Section 23037
of the BUsJ.ness and Professions Code. It is the City
Council's belief that the 321 Club does not meet the criteria
for a club because it does not maintain a bona fide membership
IJ.st w~th members paying dues at least once every year, nor
does J.t limlt lts sale of alcohol to members and their bona
fide guests.
The C~ty Council believes an investigation into the
operatlons of the 321 Club will reveal that any
representat~ons by the licensee that it is a club as
envisioned by Section 23037 of the Business and Professions
Code is a shallow ruse. It ~s common knowledge throughout the
community that the 321 Club does not limit itself to members
and lnstead actJ.vely seeks the business of the general public.
The C ~ ty Counci 1 is al so concerned with the fact that
the 321 Club allows ffilnors upon the premises wher~ alcohol is
belng served. Such .activity may be technically consistent
with the restrJ.ct~ons imposed upon Type 57 license holders,

however, ~t violates the sp1rit of Section 25665 of the
Business and Professions Code, Wh1Ch proscribes the preaence
of mJ.nors 1n a location with an on-sale license issued for
publ~c premises. As such, J.t certainly 18 a practice which is
contrary to pub11c welfare and morals and grounds fOF
revocat1on or 5uspens1on of the 321 Club's license pursuant to
Sect10n 24200 of the Bus~ness and Professions Code.
Addi t~onal grounds for revocation or suspension of the
321 Club's license lies 1n the fa~lure by the club's operator
to correct ob]ectJ.onable condit1ons constituting a nuisance
W~ thJ.n reasonable t:Lme after notJ..ce to make such correctJ.ons
by the City Attorney pursuant to Section 373a of the Penal
Code. (See enclosed letter to 321 Club's attorney, dated
November 23, 1983.) Notwithstand:Lng such notice, and an
a ttempted sale of the 321 Club to a new operator, which has
been stalled or derailed, the lamentable conditions persist at
the locat~on.
Numerous cr~mes and incidents have occurred -in and
around the 321 Club :Ln the past year and many of these are in
SOMe manner attrJ.butable to the way the club J.8 run. (See
enclosed computer prJ.nt-out, dated October 3, 1984.)
Accordingly, on behalf of the City Council, it is hereby
requested that publJ.c hearings be held within 60 days to
ascertain whether, based upon the above-stated accusations,

Attorney Jeffrey Holtzman is more specifically informed as to
the problems w1th the 321 Club and is available to assist you

Dear Mr. Herman:
The purpose of thlS letter is to follow up on the
August 29, 1983, meeting between you and various officials
of the City of Santa Moncia. We have given cons~derab1e
thought to the problems raised by the 321 Club, and thlS
letter wll1 outllne recommendatlons to remedy those prob-
lems.
The prlnclpal problems related to the operations of
the 321 Club are related to the age of the patrons. These
complaints include concerns of parents about an establish-
ment that serves alcohol and admits minors, mlnors being
served alcohol at the 321 Club, minors drinking alcohol
in various public places 1n the vicinity of the 321 Club,
and m1nors loitering and creating disturbances in viClnity
of the 321 Club.
In our opinion, the best way to address these pro-
blems is for the 321 Club to take one of the following
actions:
I. Excluslon of any person under the age of 21.
2. Compllance with the terms of lts Type 57 Private
Club Llcense.

If one of these two steps 1S not taken, the City
WIll consider commencing litigation to address the
problems caused by the 321 Club. We hope that this action
WIll be made unnecessary by responsible conduct on the
part of your client. We appreciate your recent coopera-
tion in resolv~ng other matters pend1ng between this
office and your client.
In your last letter to the Chief of Police, you made
certaIn complaints concernIng conduct by the Police
Department. Information avaIlable to thIS office lndi-
cates that the Police Department has properly carried out
its responsibilIties in connection with the 321 Club.
However, should you have any specific complaints, we would
urge you to initiate a personnel complaint against the
officers Involved. For th1s purpose you should contact
Lt. Robert Taylor, who has been specially assigned to
rece~ve any complaints from you.
If you have any questions, please do not heSItate to

WHEREAS}
the 321 Club and the viCInIty of the 321 Club
has been and contlnues to be the slte of numerous crimeSj and
WHEREAS, the 321 Club has caused a dlsproportionate use
of police resources in response to the unusually hlgh number
of InCIdents In the area of the 321 Clubj and
WHEREAS, the CIty Attorney, In November, 19B3} had
notIfIed the 321 ClUb, through Its attorney, o~ th~ CIty'S
concern WIth the problems created by the 321 Clubj and
WHEREAS, the condItIons at and around the 321 Club have
not Improved since November, 1983; and
WHEREAS, the CalIfornIa BUSIness and ProfeSSIons Code
provIdes that an ABC license may be revoked or suspended when
the continuance of the lIcense would be contrary to pUblIC
welfare or morals; and
WHEREAS, the Business and ProfeSSIons Code provIdes for
Ghe revocatIon or suspenSIon of an ABC license upon the
licensee's violation of ABC rules or regulatIons or of any

Penal Code sections relatlng to the sale or consumptIon of
alcoholic beverages; and
WHEREAS, the BUSlness and ProfessIons Code provIdes that
an ABC lIcense may be revoked or suspended If objectIonable
condItlons constituting a nuisance are not corrected withIn a
reasonable time after the CIty Attorney has requested such
correctIons be made; and

WHEREAS,
to hold
the BUSiness and ProfessIons Code requires the
publlc hearIngs upon the accusatIon of a local

hereby certIfIes that the publlC safety, health and welfare
requIres an ImmedIate hearIng by the ABC of the accusatIons

SECTION 2.
The Mayor shall transmlt to the ABC a
certIfIed copy of thIS ResolutIon accompanIed by the letter

Mr. Paul Petty of the PenthQuse of the Roman Inn-at 520 Pico Blvd.
here, two t~es now, regardi~g the unruly behavior and Doise associated
with the conduct of guests coming and going from the Roman Inn
Penthouse on Fr1,.day and Saturday eve-n;ngs. Well, noW' you can add
Sunday to the list. Atter you;sent those letters, each ttme the
trouble subsided for a few weeks, but lately i.t has been getting
worse.
People are parking i.llegally on our streets, in red zones,
meanwhile ~tn-n;ng the~r car motors and loitering i.n cur yards.
They crufae by :my house, peer into my windows, and last night,
..hen I went out to see a friend get safely i_nto her caJ:", I glanced
across the street to Bee two young .men breaking into a parked VW van
They were using a fi.le to pry open the window. I reported this to
the police who arri.ved in time to arrest the two. When the'. police
left, two cars pulled up- to one side ~f :my house and several boys
jUl1lped out and begaTI looking around thJ cars of my nei.ghbor, (which
were parked in her dri vewa:y) t as if trying to find a way to get :tDl
into the cars. Then the boys grabbed three kittens, which belong to

neck.I told them to stop and they dropped one ~tten onto a parked

tb.at accompa.'"lies the continued use of the Penthouse of the Roman Inn
on Friday J Saturday J and now Sunday evenings. On these nights liquor
is Gold there. We have seen very young people drinking in our s~reets,
and they toss thE: empty bot.tles ont~ our lawns :in piles..besides.
They fight in the stre~ts, break into aii;tomobiles~ and are noispy. We

to cease and desist from allowing any nore such gatherings at the
