SUBJECT: Ordinance Amending 1979 Newsrack Ordinance
At Its meeting on September 4, 1984, the City Council
Introduced for first reading an ordinance enlarging the zone
subject to special newsrack provisions to include the entire
City. The ordinance IS now presented to the City Council for
adoption.
RECOMMENDATION
It is ['espectfully recommended that the accompanying
ordinance be adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING THE 1979
NEWSRACK ORDINANCE TO ENLARGE THE AREA
OF ZONE A TO INCLUDE THE ENTIRE CITY
WHEREAS, Ordinance Number 1131 (eCS) established specIal
requirements for newsracks located in a zone coverIng Wilshire
Boulevard and Fifth and Sixth Streets from Santa Monica
Boulevard to WIlshire Boulevard; and
WHEREAS, Ordinance Number 1174 (CCS) enlarged the zone
to add Fourth Street from WilshIre Boulevard to Colorado
Avenue, Santa MonIca Mall, Santa Monica Place, and Lincoln
Boulevard from Broadway to the Santa MonIca Freeway; and
WHEREAS, Ordinance Number 12.23 (CCS) enlarged the zone
to add the area bounded by WilshIre Boulevard on the north,
Second Street on the east, Colorado Avenue on the South, and
Ocean Avenue on the west, and the area bounded by Pico
Boulevard on the north, Haln Street on the east, the City
I imi ts on the south and NeIlson Way and AppIan Way on the
west; and
WHEREAS, Ordinance Number 12.64 (eCS) enlarged the zone
to add Pico Boulevard between Main Street and the easterly
City limits; and

WHEREAS, the CIty Council of Santa Monica desires to
enlarge the zone to encompass the entire area within the
boundaries of the City of Santa Monica,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION 1. OrdInance Number 1131 (CCS) is hereby
amended to replace the map of Zone A with the map attached
hereto, enlarging Zone A to add the entire area within the
boundaries of the City of Santa Monica. Shown on the map are
five distrIcts. District 1 consists of the area in whIch the
specIal requirements of Municipal Code Sectlon 6252 currently
apply. Districts 2, 3, 4 and 5 shall comply with the special
requlrements of Munlcipal Code Section 6252 on or before the
following dates:
District 2: March 31, 1985.
DistrIct 3: November 30, 1985.
District 4: June is, 1986.
District 5: December 31, 1986.
SECTION 2. Any provlslons of the Santa Monica Municipal
Code or appendices thereto inconsistent with the provisions of
this ordinance, to the extent of such inconsistencies and no
further, is hereby repealed or modlfied to that extent
necessary to affect the provisions of this ordinance.
SECTION 3. It any section, subsection, sentence,
clause, or phrase of this ordinance is for any reason held to
be invalid or unconstitutional by a decIsion of any court of
competent jurisdiction, such decision shall not affect the

validity of the remaining portions of the ordinance. The City
Council hereby declares that it would have passed this
ordinance and each and every sectlon, subsection, sentence,
clause or phrase not declared invalid or unconstitutional
without regard to whether any portion of the ordinance would
be subsequently declared invalid or unconstitutional.
SECTION 4. The Hayor shall sign and the Clty Clerk
shall attest to the passage of this ordinance. The City Clerk
shall cause the same to be published once in the official
newspaper Within 15 days after its adoption. The ordlnance
shall become effectlve 30 days from its adoption.
