INTRODUCTION
Thls report transffilts an ordinance to repeal Sectlon
6500.269 of the Santa Monlca Munlcipa1 Code, relating to
the dlstrlbution of sales tax proceeds.
BACKGROUND
At ltS ~eeting of May 8, 1979, the Clty Council
dlrected Clty Staff to consolldate all Clty ascountl.ng funds,
ellffilnate the speclal funds, and deposlt all Clty revenues
lnto the General Fund. Sectlon 6500.269, which allocates one
quarter of sales tax money to a SpeCl.aL Fund to be used
only for capltal lmprovements, should be repealed to accompllsh
thl.S result.
Upon the effectl.ve date of thlS Ordlnance, all sales tax
monles wl11 go lnto the Genera~ Fund; the Council havlng
prevlously consolidated the varlOUS speclal funds wlth the
General Fund by resolutlon dated May 8, 1979. The staff
report presented to the Counell at that tlme lS attached.
ALTERNATIVES
The Council may repeal Sectlon 6500.26~ or choose not
to do so.

REPEALING SECTION 6500.269 OF
THE SA~TA MONICA MUNICIPAL CODE,
RELATING TO THE DISTRIBUTION OF
PROCEEDS OF S~LES AND USE TAX.
WHEREAS, Sectlon 6500.269 of the Santa Monlca Hunlclpal
Code provldes that three-fourths of local sales tax ~oney
be deposlted and pald into the general ~und of the City and
the remalnlng one-fourth of such monles be deposited ln a
Special Fund to be used only for capltal lTIprOVements; and
WHEREAS, the Clty Councll flnd~ that It lS in the publlC
lnterest that all sales tax money collected be deposlted In
the General Fund:

SECTION 1. Sectlon 6500.269 of the Santa ~fonlca !1unlclpal
Code, relatlng to dlstrlbutlon of proceeds of sales and use
tax, added by Ordlnance ~unber 939 CCS, adopted December 30,
1973, lS hereby repealed.
SECTION 2. If any sectlon, subsection, sentence,
clause or phrase of this ordlnance is for any reason held to be
lnvalld or unconstltutlonal bv a declslon of any court of
competent ]Ur~sdlctlon, such declsion shall not affect the
valldlty of the remalnlng portlons of the ord~nance. The Clty
Councll hereby declares that lt would have passed thlS ordlnance
and each and every sectlon, subsectlon, sentence, clause or
phrase not declared lnval~d or unconstltutlonal without regard
to whether any :gort~on of the ord~nance would be subsequently
declared invalid or unconstltut~onal.

SECTIO~ 3. The Mayor shall slgn and the Clty Clerk
shall attest to the passage of thlS ordlnance. ~he Clty Clerk
shall cause the sane to be publlshed Once In the offlcial
newspaper withln flfteen (15) days after lts adoptlon. The
ordlnance shall become effectlve after thlrty (30) days from
lts adoptlon.
