SUBJECT: Ordinance Amendlng Sections 6204H, 6204H2 and
6236 of the Santa Monica Municlpal Code to
Provide for the Licensing of Hypnotists as
Professionals
At its meeting on September 1, 1981, the City Council
lntroduced for flrst readlng an ordinance relatlng to the
llcensing of hypnotlsts. The ordinance 1S now presented to
the City Council for adoption.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING
SECTIONS 6204H, 6204H2 and 6236 OF THE
SANTA MONICA MUNICIPAL CODE TO PROVIDE
FOR THE LICENSING OF HYPNOTISTS
AS PROFESSIONALS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA ORDAINS AS
FOLLOWS:
SECTION 1. Section 62048 of the Santa Monica Municipal Code
is hereby amended to read as follows:
SECTION 6204H. For tune Telling.
ExceptIng that certain area of the City lYIng
west of the public way commonly known as "The
Promenadell along the Ocean Front and between
the south boundary of the City and Kinney
Street, or premIses located upon the Santa
MonIca Amusement PIer, which areas are
generally known as the Amusement Zone, and
wherein, if duly licensed under the provision
of this Code, a person may engage In fortune
tellIng for amusement purposes, no person
shall carry on, practIce, or profess to
practice the bUSIness or art of astrology,

phrenology, life read ing , fortune- tellIng,
cartomancy, clairvoyance, clair audience,
crys tal gazing, mediumshIp, oriental
mysteries, spirit photography, spIrItwritIng,

spirit voices, spIrit materIalIzation,
etherealIzatIon, numerology, physiognomy,
psychometry, seersh.lp, prophecy, augury,
divInatIon, magic or necromancy, or other
SImilar art or busInes, and demand or recieve
QIrectly or indirectly, a fee or reward, or
accept any donation for the exercise or
exhIbItIon of thIS art thereIn, or give an
exhibItIon of this art therein, or gIve an
exhibition thereof at any place where an
admission fee, donatIon, or reward is charged
or received, dIrectly or indIrectly, or teach
or give instruction in any such art or

donation for such teaching or instruction.
SECTION 2. Section 62Q4H2 of the Santa Monica MunICipal
Court IS hereby amended to read as follows:

fortune-telling, cartomancy, clairvoyance,
clalraudlence, crystal-gazing, medlumshlp,
prophecy, augury, divination, mag IC ,

and for Wh1Ch there IS demanded or rece1ved a
fee for the exercise Ot exhibit10n of his art
therein, or Ind1rectly either as a g~ft,

thereof at any place where an admIssion fee
1 s charged, $100.00 per annum.
SECTION 3. Section 6236 of the Santa Mon~ca Municipal Code
is hereby amended to read as follows:
SECTION 6236. ProfessIonal. Any
person, group, assoclation, partnership, firm
or corporatIon engaged In a profeSSIon,
vocation or calling, lIsted herelnafter or
not specifically provIded for in any other
section of this code, the business tax shall
be $20.00 for gross receipts of less than
$6,000.00, and In addltion thereto, $ . 6 5 pe t
each $1,000.00 or fraction thereof of gross
receipts in excess of $6,000.00. In no event
shall any llcense fee, required to be paid
pursuant to this sectIon, be in excess of
$2,000.00.

before Issuing a license pursuant to this
sect ion, the applieant to exhIbit an
unexpired and unrevoked license entitling
said applicant to practice 1n the state of
CalIfornIa.
SECTION 4. Any provision of the Santa Monica Municipal
Code or appendIces thereto inconsistent with the prOVIsions of

this ordInance, to the extent of such inconsIstencIes and no
fur ther , are hereby repealed or modIfIed to that extent necessary
to affect the provisions of thIS ordinance.
SECTION 5. If any sect1on, subsection, sentence, clause,
or phrase of thIS ordinance 15 for any reason held to be invalId
or unconstitutional by a deciSIon of any court of any competent
jur Isdiction, such decision shall not affect the valid1ty of the
remaIn1ng portIons of the ord1nance. The City CouncIl hereby
declart;i!s that it would have passed thIS ord1nance and each and
every section, subsectlon, sentence, clause or phrase not
declared invalid or unconstitutional WIthout regard to whether
any portIon of the ordinance would be subsequently declared
invalId or
SECTION 6. The Mayor shall 51gn and the City Clerk shall
attest to the passage of this ordInance. This City Clerk shall
cause the same to be published once in the official newspaper
within 15 days after its adoptIon. The ordinance shall become
effective after 30 days from its adoption.
