BACKGROUND This ord~nance was passed 1n emergency forM by t:le C~ ty Councll as Item 8G at 1ts July 1, 1980 meetlng, contlnued from 1ts June 24, 1980 Meeting. As per standard procedures lt was also 1ntroduced in regular form as Item 8H at the same !'\eetlng. The ordlnance provides for the removal of elght (8) boats washed up on the beach north of the Santa Monica Pler durlng a storn 1n February 1980. Declarlng the boats to be abandoned property wlthln the meaning of Harbors & Nav1gation Code 5522, the ard1nance dlrects the Clty Manager to take the necessary actlons to effectuate the re~oval of these boats. It was amended to delete the section requiring notiflcatlon to the owners of the boats of the adoptlon of thlS ord1nance and allow1ng them 8E JUL 2 2 196a 8E" -JUL 2 2 1980 . . 10 days from the adoption of this ordinance to remove the boats at the~r own expense. Follow~ng adopt~on of the emergency ord~nance, R~chard Koch, owner of s~x of the boats in quest~on, obta~ned a temporary restrain~ng order against the sale of the boats in order to preserve the status quo pending a hear~ng on th~s natter, set for July 18, 1980. The boats were removed from the beach on July 3, 1980 at a cost of approx~mate1y $4,000 and are now be~ng stored at the beach ma~ntenance yard north of the Santa !lonica Pier. The C1ty Hanager, or h.l.s deslgnee, shall, upon the explratlan of ten (10) days after the adoption of thlS ordlnance, cause the aforementloned abandoned vessels to be sold, destroyed Owner or otherw1se dlsposed of 1n such manner as he may deem ex~edlent or convenlent. Upon sale tltle shall vest ln the purchaser who shall 1mmedlately take steps to re~ove the property. All pro- ceeds from such sale shall be the property of the City. SECTION 3. The Clty Manager, or hlS designee, is author- ized to ca~se the removal of the aforernentloned abandoned vessels from the beach for the purpose of effectlng thelr sale or other means of disposal and to enter lnto contracts necessary for such removal. The mlnlffium prlce of any vessel so removed shall be the cost of that removal. SECTION 4. Any provislon of the Santa Monica Municipal Code or appendlces thereto lnconslstent therew2th, to the extent o~ such lnconslstencles and no further, are hereby repealed or mO~l- fied to that extent necessary to effect the prov1sio~s of tnls ordlnance. -3- . . If any section, subsectlon, sentence, clause, or phrase of th1S ordinance 1S for any reason held to be inval1d or unconstltutional by a decision of any court of any competent jurisdiction, such decision shall not affect the val1dity of the rema1ning portlons of the ord1nance. It was my fighting for reasonable business conditions for not only me, but others on the Pier as well, that helped to create the climate into which U.~. is now attemptlng to enter. I fought the battles, took the hard knocks, and got the bad reputation in C~ty Hall, so that ultimately 1 could operate a beating business in a conducive environment and new that it appears that the environment may finally eXlst, you are thinklng of giving the thlngs I fought for to another. Mr. Budai and hlS Corporation are lucky. They are apparently getting the welcome mat laid out for them. How diffe~ent the cllmate from when I fisst acted to bring boating to Santa ~onica.- The first person I talked to in City Hall was the first in a succession of seven Pier managers and he actually invited me to go away and come back ina year! U.M. is not experiencing what I did with a totally new and inexperlenced pier manager ncr are they experienclng the hostlle efforts I did from Don Arnett and h~s harbormaster who tried to keep mr out. They dont have to generate a rebuttal to a hostile staff report or go _ through a license review board hea::::,ing as I did. _ But ~ore than anything else, they are not havlng to know the deadly effects on a business enxerprise from the hostility of a garbor Dept who for years had been enJoYlng an aba~doned harbor w~th nething to do. ~~.o fer years didn't have to worry about anything happening to dlsturb their soft little deal - thelr own pr2vate little club of 2nslders, who natura~ly viewed this outsider as somethlng to purge at ~y cost. C.~. isnt having to fight against all of the entrenched ways of a Pier which had been ~~changed in 25 years. Every letter, memo, scrap of correspondence, every single document haa been preserved and it all points unquest1onab~y to the fact that Santa ~onica City Hall has persistently tried to keep from me the success I fought so hard to achieve. The letter 1n the file from Clarence Earmon gives the appearance that the lessees Assn consciously chose another boating operator over me. ! suggest that you consider that this is a personal letter from Mr Earmon and was not written or sent upon vmte of the Assn. I realized the desire peonle h3~e to ~o fQ~ a boat ride, and also the fasein- ~tiQn of our harbor, with it's seals and abundant bird life. Bavln~ ori~lnally started with rentals and school, I felt tnat Nest Hind WqS somehow slightly out of tune with the general Pie~- Il:oing nublie in that most of them had never been in a sai11:oa1:, and very likely never would unless a low cost, easy way to do so were made aV2il9ble to them. The experience of introducin~ thousands to the pleasures of sailing bas been a worthwhile one indeed. Some people have ~ade rather interestin~ co~ments, or asked incredible qUesti~ns, all of which have enriched the experience for ever,one. One of tl1e most frequently 2.!'!ked questions has been if t'~e bre~k- w~ter iq ~an~de o~ natural. and by far the ~ost bi~arre questiJn wa.s, "Do those rocks go all the way to the bottom?" which was asked by two different persons! ~any ask about the seals, about sharks, pelicans, etc., ~nd I f~el that Nest ~inc 1s t~us ~2~ing a meanin~- ful contributiJn to the live~ ;f ~Rny people by providing them with ~n e~perience that is at the sa~e time recreational and educational. At t~e ti~e of this writing, appro~imately 40,000 people have taken the ~est ~lnd Rides. Many pe~ple would love to go for a ride but, because of certain fears, will not set foot in a sailboat in spite of our best efforts in persuad~n; them. I w?nt to oe able to give these people the pleasure of the Harbor Rides as well, and so I prop0se to offer them t~e same kind of ride, but in a boat powered by a motor, and perhaps next t1~e we ~ay convince them to try it in a sailboat. rhis kind of combination of sail and motor powered rides is quite common in the industry. Skippers from ~y staff are experts in dealin~ with the public on the water, and can use this skill in any kind of boat. ~hi~ proposal 1s merely qn e7tension of R D~?n I ~ave ~ad to put s~~ll outboards on the sailboats for assist in light or calm win~s. I propose to offer the same general type of rides that I now ?rovlde. Six passen~ers per boat will still be the rule, as thls conforms with oertaln Coast Guard regulations. If I see t~e need for 19r~er craft with greater capacity, all procedures will be in full c0mpliance with all COast Guard ~egulations. I might point out that, althou2h t~ere has been no enforceme~t of the six oassen<<er rule here in the harbor, I have never exceeded this li~it. As with all things here in the h8rbor. it will have to be determined from experience. Experience has been the key f3ctor here in the operation of ./est .iind Rides.
