General AVlation Safety Issues
On September 16, at the lnvltatlon of Supervlsor Deane Dana, I attended
the County hearlng on lssues related to general aVlation safety. It was
a very interesting hearlng wlth testimony from the commerclal aVlatlon
industry, the Alrllne Pllot's Assn., A.O.P.A.. Los Angeles Alrports,
and the Burbank Alrport.
I urged the Supervlsors to malntaln thelr sense of urgency on the issue
of aVlatlon safety.
It was clear to me from the testlmony before the
Board that all general aVlation alrcraft ln this region should be reqUlred
to have functlonlng altltude encoders and transponders. I have already
asked Hank Dlttmar to flnd out if we could require thlS of the planes
rentlng tle-downs at Santa Monlca Alrport. I suggest that we also do
the fall OWl ng:
1. Ask our Alrport Commlssion to consider tie down rates WhlCh
are dlscounted for alrcraft WhlCh have these safety devlces (annually
certlfled as operatlonal).
2. Instruct staff to monltor and report back actlons of the County
Board in this area, so that we can conslder both thelr leglslatlve and
regulatory posltions.

SUBJECT: Feasibility of City Required Aviation Safety Devices at
Santa Monica Airport
INTRODUCTION
This report discusses the feasibility of the city enacting
regulations to require aircraft based at or using the santa
Monica Airport to be equipped with safety and anti collision
devices such as transponders or altitude encoders.
BACKGROUND
The recent air tragedy over cerritos has focused attention on air

safety in the Los Angeles basin particularly as it involves
general aviation aircraft within the Terminal Control Area (TCA).
Recent newspaper editorials have urged that general aviation
aircraft be required to install transponders and/or altitude
encoders.
The Los Angeles County Board of Supervisors held a
hearing on the subject last week which resulted in a direction to
County Staff to investigate such a requirement for each of the
five County airports.

Transponders and altitude encoders, if activated by pilots, would
provide information to controllers that an aircraft has entered
the TeA. Altitude encoders would not only identify that an
aircraft is in the area, but would also provide information as to
the altitude of the aircraft.
In order to determine whether the City could legally require
aircraft based at the Airport to
install
encoders
or
transponders, City staff enquired of the Federal Aviation
Administration as to possible Federal preemption. The FAA's
response, which is attached, indicates that any ordinance or
statute which would require transponders or encoders would
conflict with Federal Aviation Regulations and would therefore be
invalid. Any effort by the city in this regard would thus be
likely to result in a lawsuit.
An amendment to preexisting Federal legislation which would
require transponders was passed out of committee by the House of
Representatives last week.

ThlS is in response to your letter dated September 9, 1986, to Mr. Russ
Hathaway.
It is well settled that the federal government has preempted the fleld of
alrspace and 31r traffic regulation pursuant to the Commerce Clause, Article
1, Section 8, Clause 3 of the United States Constitution, and the Federal
AVlatlon Act of 1958, as amended, 49 U.S.C. 1301 et. seq. and more
speciflcally. 49 U.S.C. 1348(b). See. Allegheny Airllnes v. Village of
Cedarhurst, 238 F.2d 812 (1956). Section 91.24 of the Federal AVlation
Regulations (14 C.F.R. 91.24), a copy of WhlCh is enclosed, sets forth the
general requ1rements for transponders and the1r use.
It should be noted that Slnce transponders are not utlllzed for operations
on the a1rport sllrface, any requirements 1mposed by the Clty of Santa
Monlca or the State of Callfornia in thlS regard must be construed to be an
attempt by the Clty or state to regulate air traffic, i.e., alrcraft which
are be1ng operated in the navlgable airspace. As such, any ord1nance or
statute promul gated by the city or state which confllcts wlth the Federal
Aviation Regulatlons would be lnval1d. An ord1nance or statute Wh1Ch lS
more restr1ctlve than the federal regulations, must be construed to be in
confl iet Wl th that federal mandate and therefore pre-empted. San Di ego
Unif1ed Port Dist. v. Gianturco. 651 F.2d 1306 (1981).
Slmilarly, the Clty of Santa Monlca would be precluded from requlrlng
aHcraft to utll ;ze any specl fie fl ight path.
