Seetlon 3395 of the Santa Meniea ~UniCl?a1 Code IS amended to read as =ollows: SeetloD 3395. SECTION 2. Section 3395A of the Santa Monica Municipal Code is amended to read as :ol~ows: Section 3395A. ~otwithstandl.:1g any ether provision of this Code to the contrary, violation of Sections 3201, 3207, 3212, 3332, 3333, 3350, 3351, 3352, 3352B, 3364, 3365, 3366, 3367, 3368, 3373, 3374, 3375, 3380a, 3380b, 3394A, 3394B, or 3394C or thiS Code shall be punlshable r-,... If court appearance is made or bail posted wlth~n the tlrr.e set forth in the notice c: cltation of vlo1at1on, not less ttan ten dollars -2- e e ($ 10.00) shall be assessed. 2. If no appearance 15 made nor requlred bail ?osted as set forth In subsection 1 above, after a war- rant of arrest is issued in t~e man- ner required by law, ~ot less than twenty-five dollars ($ 25.00) shall be assessed. SECTION 3. Section 3395B or the Santa ~onIca ~unlcipal Code is repealed. SECTION 4. Any provis~on 0: L~e Santa Mon~ca Mun1clpal Code or appendlces thereto lnconsisten~ with the provlslons of this ordinance, to the extent of suc~ inconsistencIes and no further, is hereby repealed or ~odi:led to that eX~ent necessary to affect the prcvislons of this ordInance. SECTION 5. If any sect1on, subsection, sentence, clause, or phrase '"'~ ....~ thlS ordinance is zor any reason held to be lnvalid or unconstItutional by a decIslon of any court of competent Jurlsdictlon, such decis~on shall not affect the validIty or the rernalning portlcns of the ordinance. T~e CIty Council hereby declares that it would have passed th~s ordinance and each and every sect~on, subsectlon, sentence, clause, or phrase net declared invalld or unconstItutional WIthout regard to whether any pcrtlon of the ord~nance would be subsequently declared lnvalld or u~constitutioQal.
