MunICipal Code SectIon 33885
At Its meetIng on May 22, 1984, the City CouncIl
dlrected the CIty Attorney to prepare an ordInance reviSIng
the defInition of ~holiday~ In MunICIpal Code Section 3388B
for the purpose of clarifYIng parkIng enforcement procedures.
In response to this dIrectIon, the accompanYIng ord1nance has
been prepared and 1S presented for City CouncIl conSIderatIon,
The proposed ordinance amends MuniCIpal Code SectIon
3388B by addIng as holIdays Veterans Day and by add1ng
clarIfYIng
language regardIng the observance of certaIn
hol1days that fall on a weekend. The proposed ordInance also
amends Mun1cIpal Code SectIon 3388B by deletIng as a holiday
the 4th Monday in October
RECOMMENDATION
It is respectfully recommended that the accompanying
ordInance be introduced for fIrst reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING SECTION 3388B
OF THE SANTA MONICA MUNICIPAL CODE
TO REVISE THE DEFINITION OF HOLIDAY
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN
AS FOLLOWS:
SECTION 1. Section 3388B of the Santa MonIca MunIcipal
Code IS hereby amended to read as follows:
SectIon 3388B.
HolIday.
The
word "holiday" shall mean and Include
the
following
days:
January 1,
February
12, the thIrd Monday In
February, the last Monday in May, July
4} the 1st Monday In September, the
2nd Monday In October, November 11,
Thanksgiving Day, December 25 and any
other
day deSIgnated by the CIty
CouncIl of the City of Santa MonIca as
a day for public feast, thanksgiVIng
or holIday. When January 1, February
12, July 4, November ii, or December
25 falls on a Saturday, the holIday

shall be deemed to be the precedlng
Frlday; when January 1, February 12,
July 4, November 11, or December 25
falls on a Sunday,
the holiday shall
be deemed to be the following Monday
SECTION 2,
Any provlsion of the Santa Monica MunIclpal
Code or appendIces thereto inconsIstent with the provIsions of
thls ordlnance, to the extent of such lnconslstencles and no
further,
IS hereby repealed or modI fled to that extent
necessary to affect the provlsions of this ordlnance.
SECTION
3 .
If any sectlon,
subsectlon,
sentence,
clause, or phrase of thls ordlnance 1S for any reason held to
be 1nvalid or unconstitut1onal by a dec1s1on of any court of
competent Jur1sdiction,
such decis10n shall not affect the
val1dity of the remaInIng port1ons of the ordInance.
The Clty
Councll hereby declares that it would have passed this
ordInance and each and every sectIon, subsectIon, sentence,
clause, or phrase not declared lnvalld or unconstitutional
w1thout regard to whether any portlon of the ordInance would
be subsequently declared Invalid or unconstItutIonal.

SECTION 4.
The Mayor shall sign and the City Clerk
shall attest to the passage of this ordinance. The City Clerk
shall cause the same to be published once in the official
newspaper within 15 days after Its adoption. The ordinance
shall become effective 30 days from Its adoption,
