SUBJECT: Ordinance Amending MunICIpal Code Section 10103
to Establish Airport Operator Insurance Require-
ments by Resolution
At Its meeting on July 28, 1981, tbe City Council
directed the City Attorney to amend Santa Monica Municipal
Code Section 10103 to establIsh airport operator insurance
requirements by resolution. In response to this directive,
the accompanYIng ordinance has been prepared.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordInance be introduced for first reading.

AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA AMENDING
SECTION 10103 OF THE SANTA MONICA MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
ORDAIN AS FOLLOWS:
SECTION 1. Section 10103 of the Santa Monica Municipal
Code is amended to read as follows:
Section 10103. Indemnity. The
privileges of using the airport and
its fac~lities shall be conditioned
on the assumpt~on of full responsi-
b11ity and risk by the user thereof,
and the user shall release, hold
harmless and indemnify the C1ty,
members of the C~ty Counc11, Boards
and Commissions, and officers and
employees of the C~ty from any
liabi11ty or loss resulting from
such use. All a~rcraft owners and
operators shall be covered at the1r

expense by public liab1lity insurance
in such amounts and terms as estab-
l1shed and from t1me to tlme amended
or revlsed by Resolut1on of the
City Council.
SECTION 2. Any provision of the Santa Mon1ca Municipal
Code or appendices thereto lncons1stent with the prov1sions
of th1s ord1nance, to the extent of such inconsistencies and
no further, is hereby repealed or rnodlfied to that extent
necessary to affect the provisions of th1s ord1nance.
SECTION 3. If any section, subsection, sentence,
clause, or phrase of th1s ordinance is for any reason held to
be invalid or unconstltutional by a decision of any court of
competent jur1sdiction, such decision shall not affect the
validity of the rema1ning portions of the ordinance. The
City Council hereby declares that it would have passed thlS
ordinance and each and every section, subsection, sentence,
clause, or phrase not declared invalid or unconstitut1onal
wIthout regard to whether any portIon of the ordInance would
be subsequently declared invalld or unconstitutional.
SECTION 4. The Mayor shall sign and the Clty Clerk
shall attest to the passage of th1s ordinance. The City
Clerk shall cause the same to be published once in the

ordinance shall become effect~ve 30 days from its adopt~on.
