SUBJECT: Ord~nance Amending Munlcipal Code Sect10n 10103
to Establish Airport Operator Insurance Require-
ments by Resolution
At lts meeting on August 18, 1981, the C1ty Council
introduced for f1rst reading an ordinance amending Santa
Mon1ca Municipal Code Section 10103 to establish airport
operator insurance requ1rernents by resolution. The ordlnance
is now presented to the C1ty Council for adopt1on.
RECOMMENDATION
It 1S respectfully recommended that the accompanYlng
ordlnance be adopted.

SECTION 10103 OF TEE SANTA MONICA MUNICIPAL CODE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
ORDAI~ AS FOLLOWS:
SECTION 1. Section 10103 of the Santa Mon~ca M~nlclpal
Code ~s amended to read as follows~

on the assuwptlcn of full responSl-
bLlity and risk by the user thereof,
and the user shall release, hold
harmless and lndemnlfy the City,
members of the City Councll, Boards
and Commissions, and officers and
employees of the City from any
llabilLty or loss resulting from
such use. All aircraft owners and
operators shall be covered at their

SECTION 3. If any section, subsection, sentence,
clause, or phrase of this ordlnance is for any reason held to
be lnval1d or unconstltutional by a declslcn of any court of
competent Jur1SQlct1on, such declsion shall not affect tne
val~dity of the remaining portions of ~he ord~nance. ~~e
Clty Council nereby declares that 1t would have passed thlS
ordinance and each and every sectio~, subsect1on, sentence,
clause, or phrase not declared invalid or unconstlt~tional
without regard to whether any port~on of the ordlnance would
be subsequently declared lnvalld or unconstltutio~al.
SECTION 4. The Mayor shall s1gn and the Clty Clerk
shall attest to the passage of thlS ordinance. The City
Clerk shall cause the same to oe published once lD the
