The ordinance is now presented to the City Council for adoption. RECOMMENDATION It is respectfully recommended that the accompanying ordinance be adopted. PREPARED BY: Robert M. Myers, City Attorney 6:, - 6- MAQ 11 1986 "AR 2 5 1986 e e CA:&~:rmd166/hpca city council Meeting 3-11-86 Santa Monica, California ORDINANCE NUMBER 1360(CCS) (City council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING SECTION 32381 TO THE SANTA MONICA MUNICIPAL CODE TO ESTABLISH PREFERENTIAL PARKING ZONE I WHEREAS, the Parking and Traffic Engineer has received a petition requesting establishment of a preferential parking zone in the area bounded by Main street, Strand street, Third Street, and Ocean Park Boulevard; and WHEREAS, the petition has been verified to be signed by residents living in two-thirds of the dwelling units comprising not less than 50 percent of the developed frontage of the proposed preferential parking zone; and WHEREAS, the Parking and 'Traffic Eng.1neer has undertaken such studies and surveys deemed necessary to deter~ine whether a preferential parking zone should be des.1gnated in the area; and WHEREAS, the City Council lS satisfied that the proposed area meets the designation criteria set forth in Municlpal Code Section 3232A, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: - 1 - e e SECTION 1. Section 323Si is added to the Santa Monica Municipal Code to read as follows: section Parking Zone I. 3238i. Preferential (a) The following named and described streets within the city shall constitute Preferential Parking Zone I: Second street and Third Street from Ocean Park Boulevard to Strand street; Strand street, Hollister Avenue, and Ocean Park Boulevard from Main street to Thlrd street; Norman Place from Main Street to Second Street: and Miles Street from Second street to Third street. (b) No vehicle shall be parked or stopped adjacent to any curb in Preferential Parking Zone I for more than one hour between the hours of 9:00 a.m. and 6:00 p.m. without a permit issued and displayed in accordance with this Chapter, and no vehicle shall be parked or stopped adjacent to any curb ~n Preferential Parking Zone I between the hours of 6:00 p.m. and 2:00 a.m. without a permit issued and displayed in accordance with this Chapter. - 2 - e e (c) Any vehicle parked or stopped without a permit when required by this Section may be removed from the street by any pol~ce offlcer. (d) The annual fee for each permit issued for Preferential Parking Zone I shall be $15.00 per permit or such other fee as may be established from time to time by resolution of the City Council. SEC'IION 2. Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent with the provisions of this ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modlfied to that extent necessary to affect the provisions of this ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdlction, such declsion shall not affect the validity of the remalI1ing portions of the ordinance. The city Council hereby declares that i t ~tlould have oassed thlS ordinance and each and every section, subsectlon, sentence, clause, or phrase not declared lnvalid or unconsti tutional ~vi thout regard to 'i.vhether any portion of t~e ordinance would be subsequently declare lnvalid or unconstitutional. - 3 - e e SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper withint 15 days after its adoption. The ordinance shall become effective after 30 days from its adoption.
