3238a to Establ~sh Preferential Park1ng
Zone A (Cedar, Plne, and Maple Streets
Between L1nco1n Court and 10th Street)
At its meeting on June 23, 1981, the City Council
dlrected the City Attorney to prepare an ordlnance establish-
lng a preferential parking zone on Cedar, Plne, and Maple
streets between L1ncoln Court and 10th street and on Lincoln
Boulevard between P1ne Street and Ocean Park Boulevard. In
response to this dlrection, the accompanying ordinance has
been prepared.
The accompanying ordinance establishes Preferential
Park1ng Zone A. Preferentlal Park1ng Zone A will encompass
the area of Cedar, P1ne, and Maple streets between Lincoln
Court and 10th Street.
Although the city Councll indicated
a desire to lnclude with~n the zone Lincoln Boulevard between
Plne Street and Ocean Park Boulevard, a determ1nation has
been made that th1s is not an appropriate area for a prefer-
ential parking zone.
(It had been anticipated that employ-
ees of John Muir School could rece~ve permits; however, the

Municipal Code requires that only residents of a zone may be
lssued permits.)
The accompanying ordinance contains the following fea-
tures:
1. Establlshment of Preferentlal Parking Zone A
for Cedar, Plne, and Maple Streets between
Lincoln Court and 10th Street.
2. Parklng in Zone A requires a permit during
the hours of 7:00 a.m. to 6:00 p.m. on any
weekday excluding holidays.
3. An annual permlt fee of $ 10.00 per permit.
The enabl~ng ordinance contalns provlslons relating to
~ssuance of permits, duration of permits, visitor permits,
exemptions, and fines, among other things. See Munlclpal
Code Sections 3234-37.
In connectlon wlth this ordinance, an lnltlal study and
negative declaration have been prepared pursuant to the pro-
visions of the Callfornla EnVlronmental Quality Act of 1970.
Notice of the preparation of the inltlal study and negative
declaration was published on December 5, 1981, requestlng
comments on or before January 5, 1982. No comments have been
received.
RECOMMENDATION
It is respectfully recommended that the negative decla-
ration be approved and that the accompanying ordlnance be
introduced for first reading.

Subject: Negative Declaration for Establishment of Preferential
Parking Zone lA' (EIA #7l2)
Background
Residents of the n800" blocks of Cedar, Pine and Maple Streets
petitioned to the city's parking and traffic engineer for a
preferential parking zone. Upon review of the parking and
traffic engineer's study and resultant recommendations, the City
Council directed the City Attorney to prepare the appropriate
ordinance for creation of such a zone. The City's Environmental
Impact Review Committee determined, upon review of a Planning
Department prepared Initial Study, that preferential parking
zone 'A' does not have a significant effect on the environment
and that a Negative Declaration shall be filed for the proposed
zone.
Environmental Issues
Implementation of Preferential Parking Zone 'A' may cause an
insignificant shift in parking and traffic patterns to the
"1000" blocks of Cedar, pine and Maple Streets as a result of
the loss of street parking capabilities to the commercial area
on the easterly side of Lincoln Boulevard between Ocean Park
Boulevard and Pearl Street. Addltional government services
will be required to enforce the 7:00 a.m. to 6:00 p.m. week day
parking restrictions.

CITY OF SANTA MONICA ADDING SECTION 3238a
TO THE SANTA MONICA MUNICIPAL CODE
TO ESTABLISH PREFERENTIAL PARKING ZONE A
WHEREAS, the Parking and Traffic Engineer has received
a pet1tion request1ng estab11shment of a preferent1al park1ng
zone on Cedar, pine, and Maple Streets between Lincoln Court
and 10th Street: and
WHEREAS, the petition has been verified to be s1gned by
residents 11v1ng 1n two-th1rds of the dwel11ng un1ts compr1s-
1ng not less than 50 percent of the developed frontage of the
proposed preferent1al park1ng zone; and
WHEREAS, the Parking and Traffic Eng1neer has under-
taken such stud1es and surveys deemed necessary to determ1ne
whether a preferent1al park1ng zone should be designated in
the area: and
WHEREAS, the Park1ng and TraffIc Engineer has deter-
mined that a preferential parking zone should be designated
in the area: and
WHEREAS, the C1ty Counc11 15 5at1sf1ed that the pro-
posed area meets the desIgnatIon criteria set forth in Munic-
1pal Code Sectlon 3232A,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION l. Sectlon 3238a 1S added to the Santa Monica
Munlclpal Code to read as follows:
Sectlon 3238a. Preferentlal
Parklng Zone A.
(a) The following named and
descr1bed streets or port1ons of
streets within the City shall con-
st1tute Preferential Parking Zone A:
Cedar, Plne, and Maple Streets
between the Llncoln Court and
10th Street.
(b) No vehlcle shall be
parked or stopped adJacent to any
curb ln Preferential parking Zone A
durlng the hours of 7:00 a.m. to
6:00 p.m. on any weekday excluding
holidays without a permlt issued and
displayed in accordance with thlS
Chapter.
(c) The annual fee for each
permlt issued for Preferential Park-
ing Zone A shall be $ 10.00 per per-
mlt.
SECTION 2. Any provlslon of the Santa Monica Municipal
Code or appendlces thereto inconsistent with the provlslons

of th~s ordinance, to the extent of such inconsistencies and
no further, ~s hereby repealed or modified to that extent
necessary to affect the provisions of th~s ord~nance.
SECTION 3. If any sect~on, subsect~on, sentence,
clause, or phrase of this ord~nance lS for any reason held to
be lnvalld or unconstltut~onal by a declsion of any court of
competent jur~sd~ct~on, such dec~s~on shall not affect the
valldlty of the remalnlng portlons of the ord~nance. The
Clty Councll hereby declares that it would have passed thls
ordlnance and each and every section, subsection, sentence,
clause, or phrase not declared lnvalld or unconstitutional
wlthout regard to whether any portion of the ordlnance would
be subsequently declared invalld or unconstitutional.
SECTION 4. The Mayor shall Slgn and the City Clerk
shall attest to the passage of this ordinance. The Clty
Clerk shall cause the same to be publlshed once In the
off~cial newspaper with~n lS days after ltS adoptlon. The
ordlnance shall become effectlve 30 days from its adoption.
