Myers, City Attorney ft,-'Z AU6 1 -4 .. e e CA:~lM:r C~ty Council Meet~ng 8-14-84 Santa Monica, California ORDINANCE NUMBER 1310(CCS) (City Counc~l Series) &~ ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SECTION 3238c TO THE SANTA MONICA MUNICIPAL CODE TO ENLARGE PREFERENTIAL PARKING ZONE C BY ADDING HILL STREET BETWEEN THIRD AND FOURTH STREETS WHEREAS, the C~ty Council has adopted Mun~cipal Code Sect~on 3232c establ~shing a preferentlal parking zone in the area bounded by Ocean Park Boulevard on the north, Third Street on the east, the city limits on the south, and Main Street on the west; and WHEREAS, a petition has been received to enlarge the preferent~al parking zone to ~nclude H~ll Street between Thlrd Street and Fourth Street: and WHEREAS, the petltion has been verified to be slgned by res~dents 11vlng ln two-thirds of the dwelling unlts comprlsing not less than 50 percent of the developed frontage of the proposed preferentlal parking zone: and WHEREAS, the Parking and Traff1c Englneer has undertaken such stud~es and surveys deemed necessary to determ~ne whether a preferentlal parklng zone should be deslgnated 1n the area; and 1 e e WHEREAS, the C~ty Counc~l is satisf~ed that the proposed area meets the deslgnat~on criter~a set forth in Munic~pal Code Section 3232A, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. amended Sect~on 3238c is/added to the Santa Monica Municipal Code to read as follows: Sectl.on 3238c. Preferentl.al ~.ark~ng Zone c. ( a) The fo llowi ng named and descr~bed streets or portlons of streets w~thin the Clty shall constitute Preferent~al Park~ng Zone C: Second and Th~rd Street between Ocean Park Boulevard and the south city limits, Hill Street between Main Street and Fourth Street, and Beach Street, Ashland Avenue, and Marlne Street between Main Street and Thl.rd Street, eXceptl.ng therefrom the po rt~on of any such street dlrectly adJacent to a school, church, or llcensed day care facility in other than a place of resldence and excepting therefrom any metered parklng spaces from use by pennittees. (b) No vehicle shall be parked or stopped ad Jacent to any curb in 2 e e Preferentlal Parking Zone C during the hours of 6:00 p.m. to 2:00 a.m. wlthout a permit issued and d1splayed in accordance wlth th1s Chapter. Any vehicle parked or stopped without a perm~t may be removed from the street by any police off~cer. tc) The annual fee for each permit 1ssued for Preferential Parklng Zone C shall be $15.00 per permit or such other fee as may be established from time to t1rne by resolution of the C1ty Council. SECTION 2. Any provislon of the Santa Monlca Municipal Code or append1ces thereto lnconsistent wlth the provisions of th1s ord1nance, to the extent of such 1nconslstencles and no further, are hereby repealed or mod~fled to that extent necessary to affect the provisions of this ordinance. SECTION 3. If any sect1on, subsection, sentence, clause, or phrase of this ordlnance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent Jurisdiction, such decls10n shall not affect the valld1ty of the remalnlng portlons ot the ord1nance. The Clty CounC1l hereby declares that it would have passed this ordlnance and each and every sectlon, subsectlon, sentence, clause or phrase not declared invalid or unconstitut1onal without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. 3 e e , . SECTION 4. The Mayor shall sign and the C~ty Clerk shall attest to the passage of this ordlnance. Th~s C~ty Clerk shall cause the same to be publ~shed once ~n the offlc~al newspaper w~th1n 15 days after its adoptlon. The ord1nance shall become effective after 30 days from its adoption.
