Ordinance Adding section 3238h to the Santa
Monica Municipal Code Establishing Preferential
Parking Zone H
At its meeting on February 25, 1986, the city Council
introduced for first reading an ordinance adding Section 3238h to
the Santa Monica Municipal Code establishing Preferential Parking
Zone H on 31st, 32nd, 33rd, and 34th streets between Ocean Park
Boulevard and Pearl Street. The ordinance is now presented to
the city Council for adoption.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be adopted.

AN ORDINANCE OF TEE CITY COUNCIL OF THE
CITY OF SANTA MONICA ADDING SECTION 3238H
TO THE SF~~TA MONICA MCNICIPAL CODE TO
ESTABLISH PREFERENTIAL PARKING ZONE H
w~EREAS, the Par~-<ing and Traffic Engineer has received a
petition requesting establishment of a preferent1al parking zone
on 31st, 32nd, 33ra, and 34th Streets between Ocean Park
Boulevard and Pearl Street; and
\iHEREAS, the petltion has been verifled to be signed by
residen~s living in two-thirds of the dwelling units comprising
not less than 50 percent of the developed frontage of the
proposed preferent~al parkl~g zone; and
W1ILREAS, the Parking and 'Iraff.lc Engineer has undertaken
suc~ studles and surveys deemed necessary to determine whether a
pre=erentlal parklng zone shculd be des.lg~ated in the area; and
\';~ER~AS, the Clty Councl2. 15 sa-:.isfied that the proposed
area meets the designation criteria set fort~ in Municipal Code
Section 3232A,
NOW', TSEREFORE, THE CITY COCNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:

SECTION 1.
section 3238h is added to the Santa Monica
Munic~pal Code to read as follows:

3238h.
Preferential
( a)
The following
named and
described streets within the City shall
consti tute Preferential Parking Zone H:
31st, 32nd, 33rd, and 34th streets
between Ocean Park Boulevard and Pearl
street.
(b) No vehicle shall be parked or
stopped
adJacent
to
any
curb
in
Preferential Parking Zone E for more than
two hours between the hours of 9:00 a.m.
and 6:00 p.m. without a per~it issued and
displayed

SECTION 2.
Any provision of the Santa Monica Munic~pal
Code or appendices thereto inconsistent with the provisions of
this ordinance, to the extent of such inconsistencies and no
further, are hereby repealed or modified to that extent necessary
to affect the provisions of this ordinance.
SECTION 3.
If any section, subsection, sentence, clause,
or phrase of this ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of any competent
jurisd1ction, such decision shall not affect the valid~ty of the
remaining portions of the ord1nance.
The City Council hereby
declares that it would have passed this ordinance and each and
every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to ~.<Thether
any portion of the ordinance would be subse~~ently declare
invalid or unconstitutional.
SECTION 4.
The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance.
The city Clerk shall.
cause the same to be published once in the offlclal ne~vspaper
withint 15 days after its adoption. The ordinance shall beco~e
effect~ve after 30 days from its adoption.
