Ordinance Amending Santa Monica Municipal Code
Section 3238m to Expand Preferential Parking
Zone M
At its meeting on January 23, 1990, the City Council
directed the City Attorney to prepare an ordinance amending
Municipal Code section 3238m to expand Preferential Parking Zone
M. In response to this direction, the accompanying ordinance has
been prepared and is presented to the City Council for its
consideration.
The accompanying ordinance amends Municipal Code section
3238m to expand Preferential Parking Zone M. The current Parking
Zone M includes Third street between pica Boulevard and strand
street, Bay street between Neilson Way and Third street, Bicknell
Avenue between Neilson Way and Third Street, and Pacific street
between Neilson Way and Third street. The accompanying ordinance
enlarges Preferential Parking Zone M to include Bicknell Avenue
between Third and Fourth streets. No other changes were made to
this Section and all parking restrictions currently set forth in
this section will apply to all streets in the enlarged Zone as
well.

An initial study was prepared in accordance with the
provisions of the California Environmental Quality Act. Based
upon this initial study, a negative declaration has been
prepared. Both documents are attached to this Staff Report as
Exhibit A. Notice of preparation of the negative declaration was
given in the manner required by law.
RECOMMENDATION
It is respectfully recommended that:
1. The negative declaration be approved.
2. The accompanying ordinance be introduced for first
reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING SANTA MONICA MUNICIPAL
CODE SECTION 3238M TO EXPAND PREFERENTIAL
PARKING ZONE M
WHEREAS, the Parking and Traffic Engineer has received a
petition requesting an expansion of Preferential Parking Zone M
to include Bicknell Avenue between Third and Fourth streets; and
WHEREAS, the petitions have been verified to be signed by
residents living in two-thirds of the dwelling units comprising
not less than fifty percent (50%) of the developed frontage of
the proposed preferential parking zone: and
WHEREAS, the Parking and Traffic Engineer has undertaken
such studies and surveys deemed necessary to determine whether a
preferential parking zone should be designated in said area; and
WHEREAS, the city Council is satisfied that the proposed
area meets the designation criteria set forth in Municipal Code
Section 3232A,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION 1.
Santa Monica Municipal Code section 3238m is
amended to read as follows:

Section 3238m. Preferential Parking
Zone M.
(a) The following named and
described streets within the city shall
constitute Preferential Parking Zone M:
Third street between pico Boulevard and
Strand Street, Bay street between Neilson
Way and Third Street, Bicknell Avenue
between Neilson Way and Third Street,
Pacific Street between Neilson Way and
Third street, and Bicknell Avenue between
Third and Fourth streets.
(b) No vehicle shall be parked or
stopped adjacent to any curb in
Preferential Parking Zone M between the
hours of 10:00 p.m. to 2:00 a.m. or for
more than two hours between the hours of
9:00 a.m. and 10:00 p.m. without a permit
issued and displayed in accordance with
this Chapter.
(c) Any vehicle parked or stopped
without a permit when required by this
Section may be removed from the street by
any police officer.
Cd) The annual fee for each permit
issued for Preferential Parking Zone M
shall be $15.00 per permit, or such other

time by reso'ution of the City Council.
SECTION 2.
Any provision of the Santa Monica Municipal
Code or append. :::es theret.o inconsistent with the provisions of
this Ordinance, to the extent of such inconsistencies and no
further, are hereby repealed or modified to that extent necessary
to affect the provisions of this ordinance.
SECTION 3.
If any section, subsection, sentence, clause,
or phrase of th15 ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of any competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance.
The City Council hereby
declares that it would have passed this Ordinance, and each and
every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether
any portion of the Ordinance would be subsequently declared
invalid or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance.
The City Clerk shall
cause the same to be pub 1 ished once in the off icial newspaper
within 15 days after its adoption. This Ordinance shall become
effective after 30 days from its adoption.

PROPOSED NEGATIVE DECLARATION
An application for a NEGATIVE DECLARATION to carry out the
following project:
Amendments to Preferential Parking Zones K, M. O. Zone K would
be amended to prohibit parking on 19th Street between Wilshire
Boulevard and California Avenue between 9:00 a.m. and 8:00 p.m.,
Monday through Saturday, except by permit. Zone M would be
enlarged to include Bicknell Avenue between Third and Fourth
streets r where parking would be prohibited for more than two
hours between 9:00 a.m. and 10:00 p.m. daily, except by permit.
Zone 0 would be enlarged to include 21st street between Wilshire
Boulevard and California Avenue, where parking would be
prohibited for more than two hours between 9:00 a.m. and 6:00
p.m., Monday through saturday, except by permit in the City of
Santa Monica, California, having been filed by city of Santa
Monica Parking/Traffic Division, on May 15, 1990, and the
application having been reviewed by the Community and Economic
Development Department in accordance wi th the procedures
established by Resolution 6694 (CCS), therefore, the Department
hereby finds that:
1. The proposed activity does constitute a project within
the meaning of the California Environmental Quality Act
of 1970, as amended.

2. The proposed activity is not exempt from the provisions
of such act by reason of being a ministerial,
categorically exempt or emergency activity.
3. The proposed activity does not appear to have a
substantial adverse effect upon the environment.
4 . Inasmuch as it can be seen wi th reasonable certainty
that no substantial adverse effect is involved, no
proper purpose would be served by the preparation of an
Environmental Impact Report.
5. A Negative Declaration document is the proper, correct
and appropriate procedure required to assure compliance
with the purpose and intent of the California
Environmental Quality Act of 1970, as amended.
The Department, therefore, has determined that the proposed
project does not have a significant effect on the environment and
that an Environmental Impact Report is not required. Following
the public review period, the decision-making body is required to
consider whether or not a Negative Declaration continues to be
appropriate.
HOW TO COMMENT ON THE PROPOSED NEGATIVE DECLARATION
The City of Santa Monica encourages public comment on this and
other projects. A copy of the Negative Declaration is available
for your review in the City Planning Division at the address
below and in the office of the City Clerk. If you have comments
about the proposed Negative Declaration, you should forward them
to the City Planning staff so that they can be considered.

33. This determination shall not become effective for a period
of fourteen days from the date of determination, or, if
appealed, until a final determination is made on the ap-
peal. Any appeal must be made in the form required by the
Zoning Administrator.
INCLGSIONARY UNIT CONDITIONS
34. The developer shall covenant and agree with the City of
Santa Mon1ca to the specific terms, conditions and
restrictions upon the possession, use and enjoyment of the
subject property, which terms, conditions and restrictions
shall be recorded with the Los Angeles County Recorder's
Office as a part of the deed of the property to ensure
that three affordable units are provided and maintained
over time and through subsequent sales of the property.
An affordable unit shall be defined as being affordable to
households with incomes not exceeding 100\ of the (BUD)
Los Angeles County median ~ncome, expending not over 30%
of monthly income on housing costs, as specified by the
Housing Division of the Department of Community and
Economic Development.
This agreement shall be executed and recorded prior to
approval of the Final Map. Such agreement shall specifY
1) responsibilities of the developer for makinq the
unites) available to eligible tenants and 2) responsibil~-
ties of the City of Santa Monica to prepare application
forms for potential tenants, estaplish criteria for
qualifications, and monitor compliance with the provisions
of the agreement.
Owner shall provide the City Planning Division with a
conformed copy of the recorded agreement prior to approval
of the Final Map.
This provision is intended to satisfy the inclusionary
housing requirements of program 12 of the Housing Element
of the General Plan of the City of Santa Monica (tlprogram.
12") . Developer may satisfy the obligations created by
this Agreement by demonstrating to the Director of Plan-
ning compliance with ordinance 1448 (CCS), which provides
implementation standards for Program 12.
TENTATIVE TRACT MAP CONDITIONS
1. All off site improvements required by the City Engineer
shall be installed. Plans and specifications for off site
improvements shall be prepared by a registered civil en-
gineer and approved by the city Engineer.
2. Before the City Engineer may approve the final map, a sub-
division improvement agreement for all off site improve-
ments required by the City Engineer shall be prepared and
a performance bond posted through the city Attorney's
office.

2. The proposed activity is not exempt from the provisions of such
act by reason of being a ministerial, categorically exempt or
emergency activity.
3. The proposed activity does not appear to have a substantial
adverse effect upon the environment.
4. Inasmuch as it can be seen with reasonable certainty that no
substantial adverse effect is involved, no proper purpose would
be served by the preparation of an Environmental Impact Report.
5. A Negative Declaration document is the proper, correct and
appropriate procedure required to assure compliance with the
purpose and intent of the California Environmental Quality Act of
1970, as amended.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA APPROVING THE DEVELOPMENT
AGREEMENT BETWEEN MAGUIRE THOMAS PARTNERS DEVELOPMENT
AND THE CITY OF SANTA MONICA
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1. The Development Agreement attached hereto as
Exhibit "An and incorporated herein by reference between Maguire
Thomas Partners Development, a California limited partnership,
and the City of Santa Monica, a municipal corporation, is hereby
approved.
SECTION 2 .
Each and every term and condition of the
Development Agreement approved in Section 1 of this Ordinance
shall be and is made a part of the Santa Monica Municipal Codes
and any appendices thereto.
The City Council of the Ci ty of
Santa Monica finds that public necessity, public convenience, and
general welfare require that any provision of the Santa Monica
Municipal Code or appendices thereto inconsistent with the
provisions of this Development Agreement, to the extent of such
inconsistencies and no further, be repealed or modified to that
extent necessary to make fully effective the provisions of this
Development Agreement.

SECTION 3 .
Any provision of the Santa Monica Municipal
Code or appendices thereto inconsistent with the provisions of
this Ordinance, to the extent of such inconsistencies and no
further, are hereby repealed or modified to that extent necessary
to affect the provisions of this Ordinance.
SECTION 4.
If any section, subsection, sentence, clause,
or phrase of this Ordinance is for any reason held to be invalid
or unconstitutional by a decision of any court of any competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance.
The ci ty Council hereby
declares that it would have passed this Ordinance, and each and
every section, subsection, sentence, clause, or phrase not
declared invalid or unconstitutional without regard to whether
any portion of the Ordinance would be subsequently declared
invalid or unconstitutional.
SECTION 5. The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance. The city Clerk shall
cause the same to be published once in the official newspaper
within 15 days after its adoption. This Ordinance shall become
effective after 30 days from its adoption.
