nues Between Barnard Way and Neilson Way
and the north side of Ocean Park Boulevard
Between Barnard Way and Neilson Way)
At 1ts meeting on July 14, 1981, the C1ty Council
directed the C1ty Attorney to prepare an ordinance estab11sh-
1ng a preferential parking zone for Fraser, Hart, and Wads-
worth Avenues between Barnard Way and Neilson Way and on the
north s1de of Ocean Park Boulevard between Barnard Way and
Ne11son Way. In response to this d1rect1on, the accompanying
ord1nance has been prepared.
The accompany~ng ord1nance establishes Preferent1al
Park1ng Zone B. The proposed ordinance contains the follow-
ing features:
1. Establishment of Preferent1al Parking Zone B
for Fraser, Hart, and Wadsworth Avenues between
Barnard Way and Neilson Way and the north side
of Ocean Park Boulevard between Barnard Way
and Neilson Way.
2. Park1ng 1n Zone B requires a permit at all
t1mes.

3. Removal of any veh1cle parked without a perm1t.
4. An annual perm1t fee of $ 10.00 per permit.
The enabl1ng ordinance contains prOV1Slons relat1ng to issu-
ance of permits, duration of perm1ts, visitor permits, exemp-
t1ons, and fines, among other things. See Mun1c1pal Code
Sect~ons 3234-37.
In connect1on wlth thlS ord1nance, an initial study and
negative declaration have been prepared pursuant to the pro-
visions of the California Environmental Quality Act of 1970.
Not1ce of the preparat~on of the 1n1tial study and negat1ve
declaration was publ1shed on December 5, 1981, requesting
comments on or before January 5, 1982. No comments have been
received.
The California Coastal Commission has been contacted,
and the C1ty has been advised that no coastal development
perm~t 1S requlred for thlS ord1nance.
RECOMMENDATION
It 1S respectfully recommended that the negative decla-
rat10n be approved and that the accompanY1ng ordinance be
introduced for first reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ADDING SECTION 3238b
TO THE SANTA MONICA MUNICIPAL CODE TO
ESTABLISH PREFERENTIAL PARKING ZONE B
WHEREAS, the ParkIng and Traffic Engineer has received
a petItIon request~ng establIshment of a preferential parking
zone on Fraser, Hart and Wadsworth Avenues between Barnard
Way and Neilson Way and on the north sIde of Ocean Park
Boulevard between Barnard Way and Neilson Way; and
WHEREAS, the petItIon has been verified to be signed by
reSIdents lIVIng In two-thirds of the dwellIng units comprlS-
lng not less than 50 percent of the developed frontage of the
proposed preferential parkIng zones; and
WHEREAS, the Park~ng and TraffIC Engineer has under-
taken such studIes and surveys deemed necessary to determine
whether a preferential parkIng zone should be designated in
the area; and
WHEREAS, the ParkIng and Traffic Engineer has deter-
mined that a preferentIal parking zone should be designated
in the area; and
WHEREAS, the CIty CounCIl is satisfied that the pro-
posed area meets the designation crIteria set forth in Munic-
lpal Code Section 3232A,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION l. Section 3238b 1S added to the Santa Mon1ca
Municipal Code to read as follows:
Section 3238b. Preferentlal
Parking Zone B.
(a) The following named and
descr1bed streets or portions of
streets w1th1n the City shall con-
st1tute Preferential Parking Zone B:
Fraser, Hart, and Wadsworth Avenues
between Barnard Way and Neilson Way
and the north side of Ocean Park
Boulevard between Barnard Way and
Ne11son Way.
(b) No veh1cle shall be
parked or stopped adjacent to any
curb 1n Preferential Parking Zone
B wlthout a perm1t issued and dis-
played in accordance with this Chap-
ter. Any veh1cle parked or stopped
w1thout a permit may be removed from
the street by any pollce officer.
(c) The annual fee for each
permit issued for Preferentlal Park-
ing Zone B shall be $ 10.00 per per-
mit.

SECTION 2. Any prov~s~on of the Santa Monica Municipal
Code or appendices thereto ~nconsistent with the provisions
of th~s ordinance, to the extent of such inconsistencies and
no further, ~s hereby repealed or modified to that extent
necessary to affect the provisions of this ordinance.
SECTION 3. If any section, subsection, sentence,
clause, or phrase of this ordinance is for any reason held to
be invalid or unconst~tut~onal by a decis~on of any court of
competent Jurisdiction, such dec~sIon shall not affect the
val~dIty of the remaining port~ons of the ordInance. The
CIty Council hereby declares that it would have passed th~s
ord~nance and each and every sect~on, subsectIon, sentence,
clause, or phrase not declared InvalId or unconstitutional
without regard to whether any portion of the ordInance would
be subsequently declared invalid or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk
shall attest to the passage of this ordinance. The City
Clerk shall cause the same to be publIshed once In the
official newspaper within 15 days after Its adoption. The
ordinance shall become effect~ve 30 days from its adopt~on.

Summary
Subject: Negative Declaration for Establishment of Preferential
Parking Zone fB' (EIA #710)
Background
Residents of the uIOO" blocks of Wadsworth, Hart and Fraser
Avenues and of the northerly side of the nloon block of Ocean
Park Boulevard petitloned to the city's parking and traffic
engineer for a preferential parking zone. Upon review of the
parking and traffic engineer's study and resultant recommendation,
the Clty Council directed the City Attorney to prepare the
appropriate ordinance for the creation of such a zone. The
City's Environmental Impact Review Committee subsequently
determined, upon review of an Initial Study prepared by the City's
Planning Department, that creation of preferential parking zone
'B' would not have a slgnificant effect on the environment and
that a Negative Declaration is appropriate for the proposed zone.
EnVlronmental Issues
There are no long or short term adverse environmental effects
expected to occur as a result of the implementation of the
parking zone. Additional governmental services wlll be required
to enforce the proposed residential preferential parking zone 'B'.

residents living in two-thirds of the dwelling units compris-
ing not less than 50 percent of the developed frontage of the
proposed preferential parking zones; and
WHEREAS, the Parking and Traffic Engineer has under-
taken such studies and surveys deemed necessary to determine
whether a preferential parking zone should be designated in
the area; and
WHEREAS, the Parking and Traffic Engineer has deter-
mined that a preferential parking zone should be designated
in the area; and
WHEREAS, the City Council is satisfied that the pro-
posed area meets the designation criteria set forth in Munic-
ipal Code Section 3232A,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION 1. section 3238b is added to the Santa Monica
Municipal Code to read as follows:
Section 3238b. Preferential
Parking Zone B.
(a) The following named and
described streets or portions of
streets within the City shall con-
stitute Preferential Parking Zone B:
Fraser, Hart, and Wadsworth Avenues
between Barnard Way and Neilson Way
and the north side of Ocean Park
Boulevard between Barnard Way and
Neilson Way.
(b) No vehicle shall be
parked or stopped adjacent to any
curb in Preferential Parking Zone
B without a permit issued and dis-
played in accordance with this Chap-
ter. Any vehicle parked or stopped
without a permit may be removed from
the street by any police officer.
(c) The annual fee for each
permit issued for Preferential Park-
ing Zone B shall be $ 10.00 per per-
mit.

SECTION 2. Any provision of the Santa Monica Municipal
Code or appendices thereto inconsistent with the provisions
\
of this ordinance, to the exte~t of such inconsistencies and
no further, is hereby repealed or modified to that extent
necessary to affect the provisions of this ordinance.
SECTION 3. If any section, subsection, sentence,
clause, or phrase of this ordinance is for any reason held to
be invalid or unconstitutional by a decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions of the ordinance. The
City Council hereby declares that it would have passed this
ordinance and each and every section, subsection, sentence,
clause, or phrase not declared invalid or unconstitutional
without regard to whether any portion of the ordinance would
be subsequently declared invalid or unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk
shall attest to the passage of this ordinance. The City
Clerk shall cause the same to be published once in the
official newspaper within 15 days after its adoption. The
ordinance shall become effective 30 days from its adopt1on.
