"AR 'l 6 ,~ TO: Mayor and CIty CouncIl FROM: CIty Attorney SUBJECT: Ot'dInance AdoptIng Current UnIform TechnIcal Codes and the Santa Monrca Amendments to the 1982 UnIform TechnIcal Codes ThIS Staff Report transmits an ordInance amending the MunIcIpal Code to adopt the most recent edItions of the unIform technJ.cal codes. At the present time, the CIty is applYIng the 1979 EdItIons of the codes pursuant to OrdInance Number 1177 (GCS) adopted on October' 10, 1980. The pr'oposed ordInance would adopt the 1982 edItIons of the ~nl form AdminIstrative code,vUnlform Code for' the Abatement of Dangerous BUIldIngs, Uniform Bulldlng Code, Uniform PlumbIng Code, Uniform MechanIcal Code, Uniform Flr'e Code, .-6n 1 form HOUSIng Code and the 1984 edition of the NatIonal ElectrIcal Code. The proposed ordinance wIll not Increase current permIt proceSSIng fees. The CIty Will continue to apply the fee schedules contaIned In the 1976 editIons of the uniform technIcal codes as adopted pursuant to OrdInance Number 1055 (CCS) on January 25, 1977. The CIty IS In the process on conductIng necessary cost/revenue studIes In antICIpation of a separate ordInance updatIng these fees. 1 {-A filAR 2 6 19l15 ---- -- - ---- -- - . , . The delay In adopting the 1982 edItIons of the unIform technIcal codes IS due to the fact that state law requIres that the codes be revIewed and approved by the State BUIlding Standards CommIssIon prIor to adoptIon by local agenCIes. The State BuIldIng Standards CommIssion dId not complete theIr approval of the 1982 edItions of the technIcal codes until mld-1984. In conJunctIon WI th adoptIng the unIform teChnIcal codes State law authorIzes the CIty to supplement the technIcal codes by local amendments based on local topographIcal, geolologlc or climatologIcal condItIons. The CIty currently has codIfIed these local amendments in a document entItled "Santa MonIca Amendments to the UnIform ConstructIon and FIre Codes ("1979 Amendmen t s " ) . The 1982 Amendments WIll reIncorporate the prOVISIons of the 1979 Amendments IncludIng three CIty CounCIl ordInances adopted SInce 1979: 1 The Supplemental SeIsmIC Safety RehabIlitatIon ReqUIrements prevIously adopted by OrdInance Number 1201 (CeS) on April 14, 1981. These prOVISIons WIll appear in SectIon 206(c), DIVISIon 1. 00 of the 1982 Amendments. 2. The ReqUIrements for AutomatIC FIre ExtIngUIshIng and ProtectIon Systems prevIously adopted by OrdInance Number 1217 (eeS) on August 25, 1981. These reqUIrements were modIfIed by OrdInance Number 1279 (CCS) adopted on AprIl 12, 1983. These prOVISIons WIll appear In SectIon 206(a) , DIvlsIon 3.00 of the 1982 Amendments. 2 -~ --- -- . , 3. The RequIrements for EXlstlng ResidentIal Structures prevIously adopted by OrdInance Number 1217 (GCS) on August 25J 1981. These provIsIons WIll appear in SectIon 206(a), DIVISIon 7 00 of the 1982 Amendments. The 1982 Amendments wIll also adopt three new provIsIons not prevIously consIdered by the CIty Council: 1- ProhIbIt the use of untreated wood roofIng and sIdIng for new or replacement roofIng or sIding. S~~ SectIon 206(a) , DIVISIon 9,00 of the 1982 Amendments. ThIS prOVIsIon IS in response to a resolutIon dIrected to the Mayor's Office In May 1982 from the Los Angeles County FIre ServIces CommlssIon. 2. ReaffIrm ResolutIon Number 2536 (CCS) adopted In November 1961 regardIng CIty responslblllty for code enforcement In mobllhome parks. See SectIon 206Ce) J DIVISIon 9.00 of the 1982 Amendments. ThIs reaffIrmatIon was requested by the state HOUSIng and CommunIty Development Department In 1981 and does not Involve any change 10 eXIstIng CIty POlICY or practIces. 3. Expand the BUIldIng and Safety CommISSIon by the addItIon of two physIcally handIcapped persons so It may also functIon as the AccesSlbIllty Appeals Board. See SectIon 204(1) of the 1982 Amendments. Health and Safety Code SectIon 19957.5 prOVIdes that the CIty may appoint an appeals board for interpretatIons of state law regardIng complIance wlth handIcapped requlrements. The statute requIres that at least two members of thIs optIonal board be 3 . . phys1cally hand1capped, two members must be exper1enced In constructIon and one member shall be a public member. It IS proposed that two handIcapped members be added to the eX1st1ng BUIld1ng and Safety CommissIon Wh1Ch wIll then functIon as the AcceSSibility Appeals Board. Three members of the eXistIng BUIlding and Safety CommISSion WIll become members of the Access1bIlIty Appeals Board and the remaining two members WIll become alternates ThIS actIon wIll prov1de an approprlate forum to address and resolve technical code problems affectlng hand1capped requ1rements. A complete set of the uniform technlcal codes has been placed 1n the Clty CounCIl off1ce.
