Introductlon ThlS report forwards to the Clty Councll the Plannlng Commlsslonls action on addlng a new general section to the Munlcipal Code WhlCh would permlt the demolltlon of structures only after the replacement proJect had recelved a bUlldlng permlt. Background In adoptlng ltS resolutlon of lntentlon to amend the comprehenslve land use ordlnance (Resolutlon 6385 CCS), the Clty COUDCll included the Commerclal and Industrlal Task Force recommendatlon that no demolltlon permlts be lssued untll approval had been granted for the replacement structure. The Task Forcers lntent in maklng this recornmendatlon was 1) to reduce the length of tlme ln WhlCh lots are left vacant, 2) to enable uses In structures that are proposed to be demollshed to remaln In place servlng the commuulty, for as long as posslble, 3) to permlt potentlally dlsplaced bUSlness or serVlces the maxlmum a~ount of t~me In WhlCh to flnd a sUltable new locatlon, 4) to allow for the posslble incluslon of eXlstlng buslnesses or serVlces In the replacement proJect. The Plannlng Commlsslon held a publlc hearing on the matter on January 4, 1982, at WhlCh no one from the publlC wlshed to speak. lD-C .lAN 2 6 1982 . . - . ',,-- Mayor and City Caunell - 2 - January 26, 1982 In the Plann~ng Carnmisslon's discusslon of thlS proposed change in the demolition permit procedure, several Commission members ralsed issues that had not been adequately addressed. These lssues included: 1) the dlfficulty In receiving financing prlor to obtainlng demol~tlon permlts, 2) the lnablllty to "fast tract" a prOJect Slnce demolltion could not occur whlle other permlts for constructlon were belng received, 3} the legal implicatlons where a lease requlres a lessee to remove the lmprovements on vacatlng the premlses, and 4) the lncreased security problems associated wlth a vacant buildlng as opposed to a vacant lot. A rnotlon to approve the proposed demoltlon permlt procedure falled to pass. Plannlng Commission vote: 3 yes, 3 no, 1 absent. On the advise of the City Attorney, the Plannlng Co~~ission moved to forward the proposed demolltlon permit procedure to the city Council wlth the CO~~isslon's comments. ThlS motion was approved wlth 4 yes, 2 no, 1 absent. Alternatlves Other than the lssuance of a bUlldlng permit which requlres every aspect of a proposed proJect to be fUlly evaluated/there is no procedure WhLCh even comes close to assurlng that the development proposed can or will be built. Arch1tectural Review Board approval, a Coastal Permit, a Use Permlt or even a Development Agreement can all be obtained on the basis of Mayor and City Council - 3 - . January 261 1982 e conceptual or prellffilnarV plans that do not requ~re englneerlng or other demonstration that the proposed structure can be constructed as proposed. Even a bUlldlng permlt is no absolute guarantee that complet~on will actually occur as is ably demonstrated by the unfinlshed bUllding at 1214 Fifth Street. Recommendation It 1S respectfully recommended that the Council act favorably upon this issue by d1rectlng the Clty Attorney to prepare an ordlnance prohlbltlng demolltlo~of eXlsting structures untll a bUlldlng perm1t has been issued for a replacement.
