Myers, City Attorney ~8:~ J CA:RMM:rmd847/hpca City Council Meetlng 3-28-89 Santa Monica, California ORDINANCE NUMBER l469(CCS) (City Councll Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SECTION 3238H OF THE SANTA MONICA MUNICIPAL CODE TO ENLARGE PREFERENTIAL PARKING ZONE H WHEREAS, the Parking and Traffic Engineer has received a petition requesting the enlargement of Preferential Parking Zone H to include 30th street between Pearl Street and Ocean Park Boulevard; and WHEREAS, the petitions have been verified to be signed by residents living in two-thirds of the dwelling units con~rislng not less than fifty percent (50%) of the developed frontage of the proposed preferential parking zone~ and WHEREAS, the Parking and Traffic Engineer has undertaken such studies and surveys deemed necessary to determine whether a preferential parking zone should be designated in said area~ and WHEREAS, the city Council is satisfied that the proposed area meets the designation criteria set forth in Municipal Code Section 3232A, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Santa Monica Municipal Code Section 3238H is amended to read as follows: - 1 - . ) SECTION 3238h. Preferential Parking Zone H. (a) The following named and described streets within the city shall constitute Preferential parking Zone H: 30th, 31st, 32nd, 33rd, and 34th streets between Ocean Park Boulevard and Pearl street. (b) No vehicle shall be parked or stopped adjacent to any curb ln Preferential Parking Zone H for more than two hours between the hours of 9:00 a.m. and 6:00 p.m. without a permit issued and displayed in accordance with this Chapter. Thirtieth street between Ocean Park Boulevard and Pearl street shall have limited two hour parking between the hours of 9:00 a.m. and 6:00 p.m. on Mondays through Fridays only. (c) Any vehicle parked or stopped without a permlt when required by this Section may be removed from the street by any police officer. (d) The annual fee for each permit issued for Preferential Parking Zone H be fifteen dollars ($15.00) per or such other fee as may be shall permit - 2 - ~ establlshed from time to time by resolution of the City Council. SECTION 2 . Any provision of the Santa Monica Municipal Code or appendices thereto inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to affect the provisions of this Ordinance. SECTION 3. If any section, subsection I sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdiction, such decislon shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each and every section, subsection, sentence, clause, or phrase not declared inval id or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional. SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. This Ordinance shall become effective after 30 days from 1ts adoption.
