CA:RMM:r City Council Meeting 2-9-82 Santa Monica, California .... .- STAFF REPORT TO: Mayor and City Counc~l FROM: C~ty Attorney SUBJECT: Ordinance Add~ng Mun~c~pal Code Section 3238b to Establish Preferential Park~ng Zone B (Fraser, Hart, and Wadsworth Ave- nues Between Barnard Way and Neilson Way and the north side of Ocean Park Boulevard Between Barnard Way and Ne~lson Way) At its meeting on January 26, 1982, the City Council introduced for f~rst reading an ordinance establishing a preferential parking zone for Fraser, Hart, and Wadsworth Avenues between Barnard Way and Neilson Way and on the north side of Ocean Park Boulevard between Barnard Way and Ne~lson Way. At the same t~me, the City Council approved a negative declaration in connection wIth this ordInance under the pro- visions of the CalifornIa Environmental QualIty Act. CA:RMM:r City Council Meeting 2-9-82 Santa Monica, California ORDINANCE NUMBER 1246(CC5) (City Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING SECTION 3238b TO THE SANTA MONICA MUNICIPAL CODE TO ESTABLISH PREFERENTIAL PARKING ZONE B WHEREAS, the Parking and Traffic Engineer has received a petition requesting establishment of a preferential parking zone on Fraser, Hart and Wadsworth Avenues between Barnard Way and Neilson Way and on the north side of Ocean Park Boulevard between Barnard Way and Neilson Way; and WHEREAS, the petition has been verified to be signed by residents living in two-thirds of the dwelling units compris- ing not less than 50 percent of the developed frontage of the proposed preferential parking zones; and WHEREAS, the Parking and Traffic Engineer has under- taken such studies and surveys deemed necessary to determine whether a preferential parking zone should be designated in the area; and WHEREAS, the Parking and Traffic Engineer has deter- mined that a preferential parking zone should be designated in the area; and WHEREAS, the City Council is satisfied that the pro- posed area meets the designation criteria set forth in Munic- ipal Code Section 3232A, t .- ~. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 3238b is added to the Santa Monica Municipal Code to read as follows: Section 3238b. Preferential Parking Zone B. (a) The following named and described streets or portions of streets within the City shall con- stitute Preferential Parking Zone B: Fraser, Hart, and Wadsworth Avenues between Barnard Way and Neilson Way and the north side of Ocean Park Boulevard between Barnard Way and Neilson Way. (b) No vehicle shall be parked or stopped adjacent to any curb in Preferential Parking Zone B without a permit issued and dis- played in accordance with this Chap- ter. Any vehicle parked or stopped without a permit may be removed from the street by any police officer. (c) The annual fee for each permit issued for Preferential park- ing Zone B shall be $ 10.00 per per- mit. -2- SECTION 2. Any provision of the Santa Monica Municipal Code or appendices thereto ~nconsistent with the provisions of this ordinance, to the extent of such inconsistenc~es and no further, is hereby repealed or modified to that extent necessary to affect the provisions of this ord~nance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the ordinance. The City Council hereby declares that it would have passed this ordinance and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the ordinance would be subsequently declared invalid or unconstitutional. SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption. The ordinance shall become effective 30 days from its adoption.
