Hyers, C~ty Attorney ~-c JAW 8" 1 ~ e e CA: ID-m: rm3 2 38Da City Council Meet1ng l-8-85 Santa Monica, Californla ORDINANCE NUMBER l324 (CcS) (C~ty Counc~l Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING SECTION 3238d TO THE SANTA MONICA MUNICIPAL CODe TO ESTABLISH PREFERENTIAL PARKING ZONE D 1tlliEREAS, the Park~ng and Traffic Eng1neer has received a petlt~on requesting establ~shment of a preferential parklng zone on Stanford Street between W11shire Boulevard and Lipton Avenue, and lvHEREAS, the pet~tlon has been verified to be signed by res~dents l~v~ng in two-thlrds of the dwel1~ng units co~pr~s~ng not less than 50 percent of the developed frontage of the proposed preferentlal park~ng zone, and HHEREAS, the Park~ng and Trafflc Eng~neer has undertaken such stud1es and surveys deemed necessary to determlne whether a preferential parklng zone should be des~gnated ~n the area; and WHEREAS, the Clty Council is satisfied that the proposed area meets the designatlon criter~a set forth in Munlcipal Code Section 3232A, NCM, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOCS ORDAIN AS FOLLOWS: SECTION 1. Sectlon 3238d ~s added to the Santa Mon~ca Munic~pal Code to read as follows: 1 '- . e Sect~on Park~ng Zone D. 3238d. Preferent~al (a) The followi ng street w~thin the named and desc ribed C~ty shall constitute Preferent~al Parking Zone D: Stanford Street between Wilshire Boulevard and L~pton Avenue. (b) No vehicle shal1 be parked or stopped adjacent to any curb in Preferential Park~ng Zone D during the hours of 9:00 p.m. to 2:00 a.~. w~thout a perM~t 1ssued and d~splayed in accordance w~th th~s Chapter. (c) No vehicle shall be parked or stopped adjacent to any curb in Preferent~al Park~ng Zone D for more than two hours between the hours of 9:00 a.m. and 6:00 p.m. w~thout a perm1t issued and d~splayed in accordance with th~s Chapter. (d) Any veh1cle parked or stopped w1thout a permit when requ1red by th~s Sect~on may be removed from the street by any pol~ce officer. (e) The annual fee for each perm~t issued for Preferential Park~ng Zone D shall be $15.00 per pern1t or such other 2 "- . . fee as may be established fron t~we to t~me by resolut~on of the Clty Counell. SECTION 2. Any provision of the Santa Monica Hunlclpal Code or appendlces the~eto inconslstent with the prov~sions of this ordinance, to the extent of such i~conslstencies and no further, are hereby repealed or modlfied to that extent necessary to affect the provisions of thlS ord~nance. SECTION 3. If any sectlon, subsect~on, sentence, clause, or phrase of thlS ordinance is for any reason held to be lnval~d or unconstitutional by a dec~sion of any court of any competent Jurlsdictlon, such decls~on shall not affect the validity of the remalnlng portlons of the ordlnance. The City Council hereby declares that ~t would have passed thlS ordlnance and each and every sectlon, subs ect~on, sentence, clause or phrase not declared ~nvalld or unconstitutlonal without regard to whether any port~on of the ordinance would be subsequently declared ~nval~d or unconstltutlonal. SECTION 4. The Mayor shall 51gn and the C~ty Clerk shall attest to the passage of thls ordlnance. The C~ty Clerk shall cause the same to be published once in the offlcial newspaper withln 15 days after ~ts adoptlon. The ord~nance shall become effective after 30 days from ~ts adopt1on.
