SUBJECT: Recornmendatlon to Alter Permitted Hours of Constructlon
on Saturdays and Federal Holldays
INTRODUCTION
ThIS report analyzes alternatlves for controlllng constructlon
nOlse through modlflcation of hours In WhlCh construct~on can
take place on Saturdays, prohlbltlon of constructlon on certaln
federal holidays, and ~dentlflcatlon of the areas where such
restrlctlons are appllcable.
BACKGROUND
At the meetlng of December 10, 1985, the City Council dlscussed
the feaslblllty of banning construction ln residentlal zones on
federal holldays and not allowlng constructIon to commence prIor
to 9:00 A.M. on Saturdays. The Council requested that City staff
submlt a report on thIS matter.
Cl ty staff al so analyzed the
posslbll~ty of maklng the Saturday hours and federal holiday ban
appllcable citywlde.
As a baSlS for conslderlng modlflcatlon, a survey was conducted
of 27 Cl tles (see ExhJ.bJ. t A) to ascertal..n what llmi tatlons on
constructlon hours were lwposed by other Jurlsdlct~ons. In

Saturday Construction Hours
An area staff evaluated which would lessen exposure to
constructlon nOlse was the feaSlblll.ty of modl.fYlng the allowed
startIng tlme on Saturdays to 9:00 A.M. from 7:00 A.M. Based on
dlScusSlons wIth unions and buildlng offlclals, 1t was concluded
that the 9: 00 A. M. startlng t1me would not put a hardshIp on
constructlon act1vlty. Constructlon 15 tYPlcally a weekday
activl.ty. Furthermore, the 9:00 A.M. Saturday tl.me should
address complalnts concernlng early morning constructl.on nOlse.
Federal Ho1idays
Staff analyzed a second area where construction nOlse has been a
concern and dlscovered through a survey of 27 citles that nlne
cltles ban construct1on on some of the ten federal holidays, and
four cltles malntaln the same hours as Saturday construction on
federal holidays, and fl.fteen cltles have no special restrlctlons
concerning federal holldays. Of the nlne cltles bannlng
constructlon on holidays, three make exceptions for certal.n
holidays. Staff also surveyed elght construct1.0n unlOhS (see
Exhlblt B) to ascertalh whl.ch Federal holldays they observed In
comparison to federal holidays recognlzed by the Cltles surveyed.
It was found that unIons typically observe seven of the ten
holldays.

Applicability of Restrictions
Santa Mon1ca Munic1pal Code SectIon 4204d2 (see Exh1b1t C) I1m1ts
construct1on actlvity only 1n residentlal zones or wIthin a 500
foot radius of reS1dential zones between the hours of 8:00 P.M.
and 7: 00 A.M. Monday through Saturday and bans construct1on on
Sundays. The Sect10n also author1zes the C1ty's BU11d1ng
OffIcer, when appropr1ate, to 1ssue spec1al permits exempt1ng
contractors from these restrlct1ons.
Based upon the CIty'S predom1nate res1dential character, 1ts
str1p commercial and ill1xed land use patterns, and the fact that
complaints about nOlse may occur from all zones, 1t has been
concluded that any reV1S10n to the t1mes and days on Wh1Ch
construct1on may occur should be c1tYW1de.
TIn s CI tYW1de approach w1l1 al so facIlItate enforcement. The
Pollee Department has expressed concern about the d1fflculty of
enforc1ng restr1ct1ons which only apply to resident1al zones.
Under the current ord1nance a res1dent 11ving 1n or near a
cornmerc1al zone who has a complalnt about construct10n n01se can
not readily be ass1sted by the Police.
Th1s would simp11fy
enforcement and would address the nOlse enVIronment of resldents
11vlng In or adJacent to non-resident1ally zoned areas.
In order to protect developers and contractors from belng
unnecessarlly restr1cted 10 their abllity to perform in areas
clearly free from resldences, a prov1s1on allow1ng exemptlons to
the c1tyw1de standards should be incorporated In the ord1nance.

If a developer or contractor appl1es for an exemption permlt, lt
shall be automatlcally granted if the proJect site is 500 feet
from the nearest resldence.
Conclusion
Based upon the information gathered from the survey of other
Cl ties,
1ntervlews wIth C1ty Departments,
revlew of Santa
Mon1ca's land use pattern and the C1ty'S ongOlng concern w1th the
qual1ty of llfe wlthln its borders, construction nOlse 15
adversely ImpactIng the resldents of the communlty and,
therefore, staff has concluded that modlflcat1ons to the exist1ng
construct1on t1me restrlct10ns are appropr1ate.
FINANCIAL/BUOOET IMPACT
The recommendatIons of th1s staff report have no financlaljbudget
lmpact.
RECOMMENDATIONS
Staff respectfully recommends that the Clty Attorney be directed
to prepare an ord1nance amendlng relevant exist1ng restr1ctlons
on constructIon and demolltlon tlmes 1n Sectlon 4204d2 (see
Exhlblt C) and Sectlon 4204dl (see Exh1b1t D) of the Santa Monica
MunicIpal Code as follows:
