between Second and Third Streets)
At its meeting on November 10, 1981, the C1ty Council
dlrected the City Attorney to prepare an ordinance establish-
ing a preferentlal parklng zone for the area bounded by Ocean
Park Boulevard on the north, Third Street on the east, the
city limits on the south, and Ma1n Street on the west. The
City Council indicated that the preferent1al park1ng district
should operate between the hours of 6:00 p.m. and 2:00 a.m.
and should exclude those portions of streets adjacent to
schools, churches, and day care centers. In response to th1s
d1rection, the accompanying ordinance has been prepared.
The accompanying ordinance establishes Preferent1al
Parklng Zone C. The proposed ordinance conta1ns the follow-
1ng features:

1. Establishment of Preferent~al Parking Zone C
on Second and Third Street between Ocean Park
Boulevard and the south city lim~ts and Beach
Street, Hill Street, Ashland Avenue, pier
Avenue, and Marine Street between Second and
Third Streets. (Main Street has not been
included in accordance w~th Munic1pal Code
Section 3231.)
2. Exclusion of the port~on of any such street
directly adjacent to a school, church, or
a day care facility 1n other than 1n a place
of residence.
3. Park1ng in Zone C requIres a permit during the
hours of 6:00 p.rn to 2:00 a.m.
4. Removal of any vehicle parked without a permit.
5. An annual permit fee of $ 10.00 per permit.
The enabllng ordinance contains provisions relatIng to ISSU-
ance of perm1ts, duration of permits, vis1tor permits, exemp-
tions, and fines, among other things. See MunicIpal Code
Sections 3234-37.
At thIS time, an init~al study has not been prepared in
accordance w~th the provlsions of the Californ1a Environ-
mental Quality Act. Earlier this year, in connection with
the proposed preferent~al park~ng distrIct east of Lincoln
Boulevard, the city Council concluded that the area had the
potentIal of redirecting the traff1c problem to the east of
the preferential parking area. In the oplnion of the TraffIc
and Parking EngIneer, the same problems might be present wIth
this proposed area, and he now believes that Fourth Street
would be a better eastern boundary for the area. Therefore,
before undertakIng the expense of an Initial study, the pro-
posed ordInance is beIng presented at this time to determIne

whether or not the City Council is satisfied with the pro-
posed boundaries of the area and the exclusions therefrom.
If so, comp11ance with the California Environmental Quality
Act will be ach1eved prior to return1ng the ordinance to the
City Council for adoption.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be introduced for first reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ADDING SECTION 3238c
TO THE SANTA MONICA MUNICIPAL CODE TO
ESTABLISH PREFERENTIAL PARKING ZONE C
WHEREAS, the ParkIng and Traffic EngIneer has received
a petItIon requestIng establIshment of a preferential parkIng
zone In the area bounded by Ocean Park Boulevard on the
north, ThIrd Street on the east, the CIty limits on the
south, and MaIn Street on the west; and
WHEREAS, the petition has been verifIed to be SIgned by
residents lIVIng In two-thirds of the dwelling unIts compris-
ing not less than 50 percent of the developed frontage of the
proposed preferential parkIng zones; and
WHEREAS, the Parking and Traffic EngIneer has under-
taken such studies and surveys deemed necessary to determIne
whether a preferentIal parkIng zone should be designated in
the area; and
WHEREAS, the Parking and TraffIC Engineer has deter-
mIned that a preferentIal parking zone should be deSIgnated
In the area; and
WHEREAS, WIth the exceptIon of MaIn Street, the CIty
Council is satIsfied that the proposed area meets the
designatlon criteria set forth in Munlclpal Code Section
3232A,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION l. Section 3238c lS added to the Santa Monlca
Munlclpal Code to read as follows:
Section 3238c. Preferential
Parking Zone C.
(a) The following named and
described streets or portlons of
streets withln the City shall con-
stitute Preferential Parking Zone C:
Second and Third Streets between Ocean
Park Boulevard and the south city
limits and Beach Street, Hlll Street,
Ashland Avenue, pier Avenue, and
Marine Street between Second and
Third Streets, excepting therefrom
the portlon of any such street
directly adjacent to a school, church,
or llcensed day care facility in other
than a place of residence.
(b) No vehlcle shall be
parked or stopped adjacent to any
curb in Preferentlal Parking Zone C
during the hours of 6:00 p.m. to
2:00 a.m. without a permit issued and

displayed in accordance wlth this
Chapter. Any vehicle parked or
stopped wlthout a permlt may be
removed from the street by any police
office.
(c) The annual fee for each
permlt lssued for Preferentlal park-
lng Zone C shall be $ 10.00 per per-
mit or such other fee as may be
established from time to tlme by
resolution of the City Councll.
SECTION 2. Any provision of the Santa Monica Munlcipal
Code or appendices thereto lnconslstent with the provlSlons
of thlS ordlnance, to the extent of such lnconsistencies and
no further, lS hereby repealed or modlfled to that extent
necessary to affect the provlslons of this ordlnance.
SECTION 3. If any section, subsectlon, sentence,
clause, or phrase of thlS ordlnance is for any reason held to
be lnvalid or unconstitutional by a decision of any court of
competent Jurisdlction, such declsion shall not affect the
validity of the remaining portions of the ordinance. The
Clty Councll hereby declares that it would have passed this
ordlnance and each and every section, subsection, sentence,
clause, or phrase not declared lnvalld or unconstltutlonal
wlthout regard to whether any portlon of the ordlnance would
be subsequently declared lnvalid or unconstltutional.

SECTION 4. The Mayor shall s~gn and the c~ty Clerk
shall attest to the passage of this ord~nance. The City
Clerk shall cause the same to be published once in the
off1c~al newspaper with~n 15 days after its adoption. The
ord~nance shall become effect~ve 30 days from its adoption.
