Background The Park1ng Authority. at its meeting on January 22. 1980. directed Staff to prepare a draft ordinance establishing preferent1al parklng in certain districts of the C1ty. The Proposed Preferential Parking Ordinance was subm1tted to the Counc1l on March 11 (Item 8-0). C1ty Counc1l requested additional c1arif1cation and conslderatlon of the proposed ordinance. In add1tion. 1t was requested that the Preferential Parking Ordinance be considered as two items. The f1rst ord1nance would consist of the cr1teria to request, establlsh, and administer speclfic Preferential Parklng Zones. The second ordlnance would cons1st of the establlshment of a Preferent1al Parking Zone within the Ocean Park area. ThlS Section addresses the authority of the Parklng and Trafflc Englneer to promulgate rules and admlnister pollcies. The intent of Sectlon 3236.1 is to provide flexibility in accounting for any exceptions to the proposed ordinance that may exist. ThlS may include. but not llmited to, leased, borrowed, rented, or company vehicles, and persons making deliverles, etc. Staff has prepared a temporary exemptlon card to handle any such exceptions. By provlding the Parkl~g and Traffic Engineer the authority to make these exceptions, lt will reduce any delays to a resi- = dent requesting a permit. To: Mayor and C1ty Councll -3- March 31, 1980 Section 3236.1 of the Proposed Preferential Parking Ord1nance states that the IIParking and Traffic Engineer shall have the authority to promulgate rules and administer policies deslgned to implement this program.1I ThlS allows Staff to provide exemptions to the Ordinance for such things as G1rl Scouts del1verlng cookies, etc. It should be noted that the Cal1fornia Vehicle Code states that if a person 15 behind the steering wheel of a vehicle and 1n control of that vehicle, the vehicle 1S not considered to be parked. Thus, any parents dr1v1ng their children to dellver any product would not be in violation of any restrlctions in a Preferential Parklng Zone. The determination of adequate park1ng facil1ties for churches or sim1lar institut10ns will be determined by the Parking and Traffic Engineer during the survey process. If a church or similar institution does not have ade- quate off-street parking, it should be specifically exempted when a Prefer- ent1al Parking Distr1ct is established. 4) City Council Members may be exempt from Preferential Parking Districts when they are on official C1ty business and dlsplay their exemption card. Recommendation It is respectfully recommended that Clty Council lntroduce the attached Ordinance for the establishment of Preferential Parking Ordinance for f1rst reading and hold a public hearing thereon.
