Compensation for Members of the Parking
Authority
At its meeting on October 22, 1985, the Parking Authority
requested that the City Attorney prepare a resolution providing
compensation for members of the Parking Authority of the City of
Santa Monica. The Parking Authority requested that the level of
compensation be set comparable to that currently paid to members
of the Redevelopment Agency of the city of Santa Monica. The
attached resolution is presented to the Parking Authority for
adoption.
It should be noted that no specific statutory authority
exists for the payment of compensaton. The streets and Highways
Code formerly contained a section which read as follows:
Members shall receive their actual
and
necessary
expenses,
including
traveling expenses, and may receive such
other compensation as the legislative body
proscribes.

This section, however, was repealed by the Legislature in 1951.
Despi te the repeal of the section set forth above I the
California streets and Highways Code does not contain any express
limitation or prohibition on compensation of members of the
Parking Authority. Thus, the general corporate powers set forth
in streets and Highways Code Section 32801 would appear to
authorize compensation of parking Authority members.
California Health & Safety Code section 33114.5 provides
that the lawful amount of compensation for redevelopment agencies
whose members are the legislative body of a city the size of
Santa Monica shall not exceed $30 per member for each meeting I
and that no member shall receive compensation for attending more
than four meetings of the agency during a calendar month.
However, since the Parking Authority requested that members be
compensated in an amount comparable to that currently being paid
to the members of the Redevelopment Agency of the city of Santa
Monica, the specific amount of compensation provided in the
attached resolution is less than the maximum allowed by State law
for members of the Redevelopment Agency. The specific amount of
compensation provided in the attached resolution represents $25

per member for each meeting, not to exceed $50 per month, plus
actual and necessary expenses.
RECOMMENDATION
It is respectfully recommended that the accompanying
resolution be adopted.
