CA:RMM:lmco235jhpw City Council Meeting 7-25-89 Santa Monica, California ORDINANCE NUMBER 14B9(CCS) (city council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA MONICA ADDING SECTION 8111 TO THE SANTA MONICA MUNICIPAL CODE TO ADOPT A SEISMIC EVALUATION REPORT FOR PRE-1933 UNREINFORCED MASONRY STRUCTURES WHEREAS, the recently enacted Unreinforced Masonry Law requ~res the city council of the city of Santa Monica to adopt a mitigation program for seismically hazardous buildings by January I, 1990; and WHEREAS, the adoption of a seismic retrofitting program for unreinforced masonry buildings will be considered by the City Council later this year; and WHEREAS, the Ci ty Council desires the review of such a seismic retrofitting program by the City Building and Safety commission; and WHEREAS, additional information on the condition of potentially hazardous pre-1933 unreinforced masonry structures within the city would be useful in evaluating a seismic retrofitting program; and WHEREAS, the completion of the "seismic Evaluation Report for Pre-1933 Unreinforced Masonry structures" (attached hereto as Attachment A) by a California state licensed structural engineer for all pre-1933 unreinforced masonry structures which have been - 1 - . . identified as substandard and potentially hazardous will provide the City with information that will be useful in the evaluation of a seismic retrofitting program, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 8111 is added to the Santa Monica Municipal Code to read as follows: SECTION 8111. Seismic Evaluation Report. On or before January 25, 1990, each owner of a pre-1933 unreinforced masonry structure which has had recorded against the structure a "Notice of Substandard Building" shall file with the Building and Safety Division a "Seismic Evaluation Report for Pre-1933 URM Structurell on a form provided by the Building and Safety Division. Such seismic Evaluation Report shall be completed by a California licensed Structural Engineer whose license is active. SECTION 2. Any provisions of the Santa Monica Municipal Code or appendices thereto inconsistent herewith, to the extent of such inconsistencies and no further, are hereby repealed or modified to the extent necessary to effect the provisions of this Ordinance. - 2 - · 'f , .( . . SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The ci ty Council hereby declares that it would have passed this Ordinance and each and every section, subsection, sentence, clause or phrase not declared invalid or unconstitutional without regard to whether any portion of this Ordinance wo~ld be subsequently declared invalid or unconstitutional. SECTION 4. The Mayor shall sign and the city Clerk shall attest to the passage of this Ordinance. The city Clerk shall cause the same to be published once in the official newspaper within fifteen (15) days after its adoption.
