Subject: Establishment of Parking Zones for the Physically Handicapped
Introduction
This report introduces to Clty Councll a proposed ordlnance to enable the
establishment of parking zones for the physically handicapped.
Background
The California Vehlcle Code (Section 21458) states that blue palnt on the
curb adjacent to a parklng space lndicates parking is limited exclusively to
vehicles of physlcally handicapped persons. In additlon, the regulations
shall be effective upon such days and during such hours or times as may be
described by local ordinance.
The California Vehicle Code (Section 22511.7) further states that local
authorities may by resolution designate parking spaces for the exclusive
use of vehicles which display a distlnguishing license plate or a placard
for physlcally handlcapped persons.
It should be noted that any vehlcle displaying distlnguishing plates or a
placard for physically handicapped persons may park in any time restricted
zones and any metered parking space wlthout being required to pay any park-
ing meter fees (Section 22511). This should not be construed, however, to
allow the stopping, parking or standing of a vehicle at the times and places
all vehicles are prohibited by State law or local ordinance (i.e. red zones,
loading zones, taxi zones).

The proposed ordinance will enable the establishment of parking zones for
exclusive use by the physically handicapped in areas that are not metered
and do not have time restrictlons, or where there is sufficient activity for
physically handicapped persons.
Recommendation
It is recommended Clty Counc1l introduce the ordinance to establish parklng
zones for use by the physically handicapped.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ADDING SECTION 3366A
TO ARTICLE III OF THE SANTA MONICA MUNICIPAL
CODE SETTING FORTH THE DEFINITION, RESTRICTION
AND DESIGNATION PROCESS FOR PHYSICALLY F~NDI-
CAPPED ZONES
SECTION 1.
A Physically Handicapped Zone shall exist where the
curb or edge of the paved portion of the street adjacent to
the space is painted blue. In addition to blue paint, the
space may also be indicated by signs or other su~table means.
No person shall stop or park a vehicle in a Physically
Handicapped Zone unless the vehlcle has dlstlnguishing license
plates or placards issued to disabled persons pursuant to
Section 22511.5 of the Vehicle Code or to disabled veterans
as specified in Section 9105 of the Vehicle Code.
A Physically Handicapped Zone may be established by
Resolution of City Council and subject to the approval of the
Parklng and Traffic Engineer if either of the following factors
exist:
(1) The location is ne~ther metered nor ti~e restricted
and curb parking is insufficlent due to heavy area
parking; or
(2) Sufficient vehIcular activity by physically handi-
capped persons exists at the location.

SECTION 2. Any provision of the Santa Monlca
Municipal CQde or apDendices thereto lnconsistent
therewith, to the extent of such inconsistencies
and no further, are hereby repealed or modified
to that extent necessary to affect the provisiDns
of this ordlnance.
SECTION 3. If any sectlon, subsectlon, sentence,
clause, or phrase of thlS ordinance is for any reason
held to be invalid or unconstitutional by a decision
of any court of any competent jurisdiction, such
decision shall not affect the validity of the re~aining
port ions of the ord inance. The City CO'.ly!C i 1.. hereby
declares that it would have passed this or~lnance
and each and every sectlon, subsection, sentence,
clause or phrase not declared invalid or unconstitutional
without regard to whether any portion of the ordinance
would be subsequently declared lnvalid or unconstitutional.
SECTION 4. The Mayor shall SJgn and the Cit~
Clerk shall attest to the passage of thig ordinance.
The City Clerk shall cause the same to be published
once in the official newspaper wlthin fifteen (15)
days after its adoption. The ordlnance shall become
effective after thlrty (30) days fron its adoption.
