Amendment of Munlclpal Code Section 3366A
Relatlng to Handlcapped Parklng
At its meet~ng on December 15, 1981, the C~ty Council
lntroduced for flrst reading an ordinance amendlng Munlclpal
Code Section 3366A relating to parking restricted for use by
disabled persons. The ordinance is now presented to the City
Council for adoption.
RECOMMENDATION
It is respectfully recommended that the accompanYlng
ordinance be adopted.

AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA AMENDING
SECTION 3366A OF THE SANTA MONICA
MUNICIPAL CODE RELATING TO PHYSICALLY
HANDICAPPED ZONES
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS
FOLLOWS:
SECTION 1.
SectIon 3366A of the Santa Monica MunIcipal
Code is amended to read as follows:
SECTION 3366A.
Physically Handi-
capped Zones.
A Physically Handicapped Zone shall
exist where the curb or edge of the paved
portion of the street adjacent to the
space or where the stall or spaces in any
publicly
owned or operated offstreet
parking faCility have been designated for
park~ng
for
physically
handicapped
persons in the manner requIred by the
Veh ic Ie Code.
No person shall stop or park a
vehicle in a Physically Handicappted Zone
unless the vehIcle has distinguishing
llcense plates or placards issued to

disabled persons pursuant to Section
22511.5 of the Vehicle Code or to
disabled veterans as specifIed in Section
9105 of the Veh1cle Code. Any veh1cle
parked in vIolation of this section may
be removed from the Physically
Handicapped ParkIng Zone by any polIce
officer.
A PhYSIcally Handicapped Zone may
be established by resolutIon of the City
Council upon request by any ind1vldual
and consideratIon by the Parking and
TraffIc Engineer, or upon recommendation
of the Traffic Engineer, if eIther of the
following factors eXlst:
(1) Curb parkIng is InsuffIcient
due to heavy area parking; or
(2) SufficIent vehicular actIvIty
by physically handIcapped persons eXIsts
at the locat1on.
SECTION 2. Any provision of the Santa MonIca MunicIpal
Code or appendIces thereto inconsIstent with the provisIons of
this ordInance, to the extent of such inconsIstencies and no
further, are hereby repealed or modified to that extent necessary
to affect the provIsions of thIS ordinance.
SECTION 3. If any sectIon, subsectlon, sentence, clause,
or phrase of this ordInance IS for any reason held to be invalid

Unconst~tutlonal by a decIsion of
any court of any competent
JurisdIctIon, such dec~sion shall not affect the val~dity of the
rema1nlng portions of the ordinance. The City Council hereby
declares that it would have passed th1S ordinance and each and
every
sect1on, subsect10n, sentence, clause or phrase not
declared Lnvalid or unconstitutional without regard to whether
any portion of the ord~nance would be subsequently declared
invalid or uncQnstitutional~
SECTION 4. The Mayor shall sign and the City Clerk shall
attest to the passage of th~s ordinance. ThIS City Clerk shall
cause the same to be publIshed once In the officIal newspaper
wlth1n 15 days after Its adoptIon.
The ord~nance shall become
effect~ve after 30 days from its adoptIon.
