Establlshing Preferential Parking Zone C

INTRODUCTION
ThlS report recommends City Counell introduce the attached
ordinance establishing Preferentlal Parking Zone C, authorize
hiring one parking checker, and approprlate General Fund Reserve
funds to the Police Department.
BACKGROUND
In
January
1981
Staff received a petition requesting
preferential parking on Second and Third Streets between Ocean
Park Boulevard and the south Clty limits and Beach Street, Hill
Street, Ashland Avenue,
and Marine Street between Second and
Third Streets. Staff recommended City Council to instruct the
Clty Attorney to prepare an ordlnance.
The City Attorney
prepared an ordinance for the City Council's June 25th meeting.
The ordlnance was referred back to Staff for additional analysis.
The accompanying ordinance establishes Preferentlal Parking
Zone C. The proposed ordinance contains the followlng features:
1. Establishment of Preferential Parking Zone C on Second and
Third Street between Ocean Park Boulevard and the south
city limits and Beach Street, Hl11 Street, Ashland Avenue,

Pler Avenue,
and Marlne Street between Second and Third
Streets.
(Maln Street has not been lncluded ln accordance
with Municipal Code Section 3231.)
2. Exclusion of the portion of any such street directly
adJacent to a school, church, or a day care facility in
other than in a place of residence.
3. Parking ln Zone C requires a permit during the hours of
6:00 p.m. to 2:00 a.m.
4. Removal of any vehicle parked without a permit.
5. An annual permit fee of $25.00 per permit.
The enabllng ordinance contalns provisions relating to issuance
of permits, duration of permits, vlsitor permits, exemptions, and
flnes, among other things. See Munlcipal Code Section 3234-37.
Staff has reviewed Cauncll concerns about the inclusion of 4th
Street and Hill Street, Ashland Avenue, and Marine Street between
3rd and 4th Streets into the proposed Preferential Parking Zone
c. In the above mentioned area there are only approximately 15
on-street parking spaces. We advised OPCO of Staff's concerns
regardlng the inclusion of the subJect streets and they preferred
not to lnclude them at thlS time. Council may include these
street sectlons if desired.
Surveys
conducted
by City Staff lndicate the proposed
preferential parking zone wlll displace approximately 50 to 60
vehicles from the entlre zone. This was determined by comparing
on-street parking occupancles at 6:00 a.m.

assumed no comMercial related parking lS on-street, to 7:00 p.m.
and 12:00 a.m. on-street parking occupancies when the commerclal
related parking is at a peak. This equates to approximately 15 to
19 percent of the available parklng 1n the area.
Staff is preparing construction plans for improvements to
Parking Authority lot 11 located on Nellson Way between Ocean
Park Boulevard and Hollister Avenue as part of the 1982-83 FY
Budget Goals for the Park1ng Authority.
The lot wlll have Maln
Street
access
(which
1S not now ava11able) and provide
approxlmately 170 off-street parklng spaces. The lot will be able
to accomodate the 50 to 60 vehicles dlsplaced from the proposed
preferentlal parklng zone.
The proposed preferential parking zone wlll be ~n effect from
6 p.m.
to 2 a.m. and is speciflcally targeted to mitigate the
problems associated wlth people parking in the residentlal
neighborhood and 901n9 to the varlOUS eating and drinking
establishments on Main Street.
As proposed,
permits will be
$25.00 annually for res1dents and visitors.
The Maln Street
Merchant Associatlon actively supports the proposed preferential
parking zone.
The Parklng Authority will be acting on a proposal to
appropriate funds to hire an assessment englneer to analyze the
establlshMent of an assessment distrlct or other financing
mechanlsms to develop additional parklng facilitles in the Maln
Street area. Funds are in the budget for Staff to determine the
feasibility of establishlng a park and ride tram system in the
area.

It wlll be necessary to hire an additional parking checker to
prov1de the necessary enforcement for the proposed preferntial
parking zone. The cost of an additional employee for the balance
of the 82-83 fiscal year is $ 35,046. The parking checker will

the overall enforcement of the existing
preferentlal park1ng zone on Fraser, Hart and Wadsworth Avenues,
the off street metered parking lots,
and the Maln Street meters
which will be in effect from 9 a.m. to 12 a.m., daily. The
additonal revenues from parking funds will offset the cost of
enforcing these areas.
Staff will conduct an inlt1al study in accordance wlth the
proVls1ons of the California Environment Quality Act prior to the
second reading of the ordlnance.
Staff 1S recommend1ng this zone because there is available
off-street parking for any displaced vehicles from the proposed
zone and the zone w1ll not cause any undo hardshlp on the
businesses in the area.

RECOMMENDATION
It 15 recommended City Council:
1. Introduce the ordinance establish1ng Preferential Parking
Zone C.
2. Authorize one additional parking checker position in the
Police Department's budget.
3. Appropr1ate $35,046 from General Fund Reserves to the
Operat1ons Bureau of the Police Department.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ADDING SECTION 3238c
TO THE SANTA MONICA MUNICIPAL CODE TO
ESTABLISH PREFERENTIAL PARKING ZONE C
WHEREAS, the Parklng and Trafflc Engineer has recelved
a petltlon requestlng establishment of a preferentlal parking
zone ln the area bounded by Ocean Park Boulevard on the
north, Thlrd Street on the east, the Clty limits on the
south, and Maln Street on the west: and
WHEREAS, the petltlon has been verified to be slgned by
residents llvlng ln two-thlrds of the dwelllng units comprls-
lng not less than 50 percent of the developed frontage of the
proposed preferentlal parking zones; and
WHEREAS, the Parklng and Traffic Englneer has under-
taken such studles and surveys deemed necessary to determine
whether a preferential parklng zone should be deslgnated in
the areaj and
WHEREAS, the Parklng and Trafflc Englneer has deter-
mlned that a preferential parklng zone should be designated
ln the areaj and
WHEREAS, wlth the exceptlon of Main street, the Clty
Counell is satisfied that the proposed area meets the

des1gnat1on criteria set forth in Munic1pal Code Section
3232A,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES ORDAIN AS FOLLOWS:
SECTION 1. Sect10n 3238c 1S added to the Santa Monlca
Mun1clpal Code to read as follows:
Section 3238c. Preferential
Parklng Zone C.
(a) The followlng named and
described streets or portlons of
streets w1th1n the City shall con-
stitute Preferential Parklng Zone C:
Second and Thlrd Streets between Ocean
Park Boulevard and the south Clty
11mits and Beach Street, Hlll Street,
Ashland Avenue, and Marlne Street
between Second and Thlrd Streets,
exceptlng therefrom the portion of
any such street directly adjacent to
a school, church, or llcensed day care
facil1ty 1n other than a place of
residence.
(b) No vehicle shall be
parked or stopped adJacent to any
curb in Preferential Parklng Zone C
durlng the hours of 6:00 p.m. to
2:00 a.m. wlthout a permlt issued and

Chapter. Any veh~cle parked or
stopped w~thout a permit may be
removed from the street by any police

(c) The annual fee for each
permit ~ssued for Preferential Park-

SECTION 2. Any provlslon of the Santa Mon~ca Municipal
Code or append~ces thereto inconsistent w~th the provls~ons
of th1S ord~nance, to the extent of such inconsistencies and
no further, 15 hereby repealed or modified to that extent
necessary to affect the prov~s~ons of th~s ord~nance.
SECTION 3. If any sect~on, subsect~on, sentence,
clause, or phrase of this ord1nance ~s for any reason held to
be 1nval~d or unconst~tut~onal by a declsion of any court of
competent jur~sd~ct~on, such decision shall not affect the
val~d1ty of the remaining port~ons of the ord~nance. The
C1ty Council hereby declares that it would have passed th~s
ordlnance and each and every sect~on, subsect~on, sentence,
clause, or phrase not declared 1nval1d or unconst~tut~onal
w1thout regard to whether any port~on of the ord1nance would
be subsequently declared ~nval~d or unconst~tut~onal.

SECTION 4. The Mayor shall s~gn and the C~ty Clerk
shall attest to the passage of th~s ordlnance. The City
Clerk shall cause the same to be published once in the
off~cial newspaper w~th~n 15 days after lts adoption. The
ordinance shall become effectlve 30 days from its adoption.
