OF VARIOUS HOUSING SERVICES

Sect~on 4810. Disruption of
Housing SerVIces.
(a) Ho landlord shall, With
respect to property used as a residentIal
rental unit under any re n tal hOUSIng
agreement or other tenancy or estate at

(3 ) Remove outslde doors or
~lindows of the rental unIt.
( 4 ) Remove from the rental
unlt personal property, the furnlshlngs,
or any other ltems \on thout the prIor
wrltten consent of the tenant, except
Hhen done pursuant to the procedure set
forth ~n Chapter 5 (commenclng Hith
SectIon 1980) of Tl.tle 5 of Part 4 of
D1VISIon 3 of the c~ v~l Code.
(b) Ho landlord shall, H~th

actIon to recover posseSSIon of a
controlled rental unlt or recover
possessIon of a controlled rental unIt

( 2 ) Take any other act~on to
recover possess~on of a controlled rental
unlt unless authorized by and in
accordance w~th C~ty Charter Sect~on 1306
and the regulat~ons promulgated
thereunder. For purposes of th~s
subd~vlslon, other actlon lncludes, but
15 not Ilmlted to, the se rv lce or
delivery of l,jrl tten notlces or demands
and the communlcatlon of oral notices or
demands.
(c) Hothing in thl'3 section shall
be construed as to prevent the lawful
eVlctlon of a tenant by appropr~ate legal
means, nor shall anyth~ng ~n tillS
subd~v~slon apply to occupanCles defined
by subd~v~sl.on ( b) of ClVIl Code Sect~on
1940.
(d) For purposes of thls section,
the terms landlord, tenant, rent, rental
housIng agreement, rental unIt, and
controlled rental un~t shall be defined
as set forth ln Article XVIII of the Cl ty
Charter.

SeCTION 2. Any prov~slon of the Santa i1on~ca nUl11clpal
Code or append~ces thereto Inconslstent ."1 th the prOVISIons of
this ordlnance, to the extent of such lnconsistencles and no
further, are hereby repealed or mod~fled to that extent necessary
to affect the provislons of tlns ordinance.
SECTION 3. If any sectlon, subsection, sentence, clause,
or phrase of thlS ordinance IS for any reason held to be lnvalId
or unconst~tutIonal by a declslon of any court of any competent
JurIsdIctIon, such declslon shall not affect the valIdIty of the
remalning port~ons of the ordinance. 'i'h e C~ty Councll hereby
declares that It ,",ould have passed th~s ord~nance and each and
every sect lon, subsect~on, sentence, clause or phrase not
declared invalId or unconstitutional without regard to whether
any portIon of the ordinance ."auld be subsequently declared
InvalId or unconstitutIonal.

SECTION 4. The Mayor shall Slgn and the C1ty Clerk shall
attest to the passage of th1S ord1nance. Th~s C~ty Clerk shall
cause the same to be publ1shed once 10 the off1clal newspaper
.nth~n 15 days after 1tS adopt1on. The ordlnance shall become
effectlve after 30 days from 1tS adoption.
