Emergency Ordinance Amending Municipal Code
Section 4811 Relating to Olympics Period Tenant
protections
At its meeting on March 27, 1984, the City Council adopted
an ordinance adding Section 4811 to the Santa Monica Municipal
Code relating to Olympics Period Tenant Protections. At the same
meeting, the City Council directed the City Attorney to return
with an emergency ordinance to permit new home purchasers to
evict for owner occupancy.
In response to this direction, the
accompanying ordinance has been prepared and is presented for
City Council consideration.
The accompanying ordinance adds subdivision {f} to
Municipal Code Section 4811 to provide that the owner of any
resident~al rental unit may evict for owner occupancy provid ed
that the eviction notice is served within 30 days of the
acquisition of the residential rental unit.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance be adopted.

(b) No landlord shall eVlct a tenant of
a resldential rental unJ..t durlng the perlod
comrrenC1.ng on "'lay 1, 1984, and ending on
August 31, 1984, unless the landlord
est.abllshes one of the grounds for evictlon
set forth in subdlV1G1ons (a) through (g) of
C~ty Charter Sectlon 1806.
As used In thlS
subdlVlsion, eV1CLlon shall mean any actlon
to recover possess~on of a resJ..dentlal rental

thlS ordlnance, to the extent of such lnconslstencles and no
further, are hereby repealed or ~odlfled to that extent necessary
to affect the provlslons of this ordlnance.
SECTION 4.
If any sectloD, subsectlon, sentence, clause,
or phrase of thlS ordlnance lS for any reason held to be l~valid
O~ ~nconstltu~lonal by a declslon of any court of any cc~petent
]urlsdlctlon, sucn declSlon shall not affect the valldlty of the
remalillng portlons of the ordlnance.
~he City Councll nereby

every sectlon, subsectlon, sentence, clause or phrase not
declared lnvalld O~ unconstltutional Wl thout regard to ,tlhet'ner
