SUBJECT: Settlng a Public Hearing for November 11. 1980 to approve
Tree PlantIng and Sidewalk Construction on Neilson Way
Introductlon
ThlS report recommends the Clty CouncIl approve the attached ResolutIon of
Intention for the plantlng of trees and the construction of sidewalks on the
east sIde of Neilson Way between P1CQ Boulevard and Holllster Avenue.
Background
In conJunctlon wlth the 1ncreased pedestrlan actlvlty 1n the Maln Street -
Neilson Way area, staff believes thIs lS the approprlate tlme to implement
sidewalk construction and tree plantlng along the east slde of Neilson Way
between P1CO Boulevard and HollIster Avenue. The area, presently 1S un1mproved
and these improvements will bring the area to a standard slmilar to the
surround1ng area. ~;-

The total cost of constructing concrete sidewalks is recommended to be
assessed to the property owner. The assessment for the 5-ft wide sldewalks is
estimated to be 510.00 per front foot. The City and the Parking Authority
own approx1mately one-half of the abuttlng frontage; the remainder 1S private
property.
The Clty will do the tree planting 1n conformance w1th the approved tree map
{except for owners who may w1sh to do so} and w11l partlc1pate 1n the cost.
The estimated cost to the abutting property owner 1S $1.75 per front foot.

Total estimated cost of the entire project to the City is 57,800 which can
be pa1d from Gas Tax Funds. Est1mated cost to property owners is $5,800.
Recommendatlon
It 15 recommended the Clty Counc1l adopt the attached Resolution of Intent10n
settlng a publlC hearlng for November 11, 1980.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA DECLARING ITS INTENTIO~ TO PLANT
TREES AND CO~STRUCT CONCRETE SIDEWALKS ALONG
ThE EAST SIDE OF NEILSON WAY FROM PICO BOULEV~RD
TO HOLLISTER AVENUE, ALL IJITHIN THE CITY OF
SANTA MONICA
WHEREAS, the Clty Council of the C1ty of Santa Monica is
empowered by Section 5870, et seq., of the Streets and H1ghways Code of
the State of Callfornla to plant trees and construct sldewalks at various
locations w1thln the City of Santa Monlca;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTIO~ 1. That the publ1c interest requlres and it 1S the
lntentlon of the City Council of the Clty of Santa Monica to order the
followlng work to be done, to wit: The planting of trees and the construc-
tion of concrete sidewalks along the east slde of Neilson !Iay from Pico
Boulevard to Holllster Avenue all in the City of Santa Monica. The esti-
mated assessment cost of the t~ee i~prove~ent 1S $1.75 per front foot to
the abutting property owners and the balance of the cost is to be borne
by the C1ty. The estlmated aSSessment cost of the sldewalk construction
is $10.00 per front foot to the abutting property owners.
SECTION 2. That said proposed work or improvement, in the
opinlon of the City Council of the City of Santa Monica, 1S of more than
local or ordlnary public benefit, and said Council hereby proposes that
the d1strlct in the City of Santa Monica to be benefited by said work or
1mprovement and to be assessed to pay t~e cost and expense thereof includes
all of the property abuttlng the east slde of ~eilson \Iay between P1CO
Boulevard and Holllster Avenue.

SECTION 3. Notice hereby is glven pursuant to sa1d Section
5870 et seq., that on November II, 1980, at the hour of 7:30 p.m. in the
Council Cha~bers of the City Hall of sa1d C1ty of Santa Monica, sltuated
at 1685 Maln Street in sa1d City, any and all persons havlng any objections
to the proposed work or improvement may appear before the City CounCll and
sho~1 cause loJhy the said proposed \,Iork or illlprOVer1ent should not be carried
out 1n accordance wlth sald Resolution of Intent1on.
SECTION 4. The Superintendent of Streets immedlately shall
cause to be consp1cuously posted along the llne of said contemplated
improvement notlce of the passage of th1S Resolut1on of Intentlon in the
manner and form prescrJbed by law.
The City Clerk hereby lS directed to mall not1ces, 1n the
manner and form prescribed by law, of the adopt10n of this resolution
to all persons owning real property in the hereinbefore descr1bed assess-
ment dlstrict, whose names and addresses appear on the last equallzed roll
for c1ty taxes or as known to the Clty Clerk.
SECTION 5. The City Clerk shall certify to the adopt1on of
this resolution and thenceforth and thereafter the same shall be in full
force and effect.
