Background On October 9, 1979, the Clty Council approved a sidewalk repalr program WhlCh provided for property owner partlclpation in the cost of repalrlng damaged sldewalks (Item II-C). Property owner particlpatlon was set at 50~ of the cost of the repairs, wlth the City to pay the re~ainlng 50% of the cost of the repalr without regard to the reason for the da~age. Certain repalr work has now been co~pleted and the property owner's share of the costs wlll now be due. A public hearlng must be held pursuant to provislons of Divlslon 7, Chapter 22. Section 5600 to 5630, of the Streets and Highways Code for the State of Californla. A resolutlon settlng the publlC hearing for November 11, 1980 is attac~ed. Recol'lmenda ti on It is reco~ended that the City Council adopt the attached resolutlon settlng a pub11C hearing for November 11. 1980, on the assessment of costs of the subject sldewalk repairs. THE CITY COUNCIL OF THE CITY OF SANTA ~iONICA DOES HEREBY RESOLVE AS FOLLO~S: SECTION 1. That the Superlntendent of Streets will flle a report of work pursuant to D1Vlsion 7, Chapter 22, Sections 5600 and 5630 of the Streets and Hlghways Code of the State of Californla, relatlng to the constructlon of certain improve~ents to sidewalks and drlveways. SECTION 2. That pursuant to Sectlon 5600 et seq. of 5ald code the Clty Counell does hereby order and declare that on the 11th day of November 1980, ln the Council Cha~bers of the City Hall, lt wlll hear and pass upon any and all objections or protests to the report of work of the Superlntendent of Streets and the amount of the assessment asslgned agalnst the real property descrlbed ln said report. SECTION 3. That all protests or objections must be in wrltlng and filed with the City Clerk on or before the time set for hearing of protests and objections. SECTION 4. The Street Superintendent hereby is dlrected to mail notices, in the manner and for~ prescribed by law, of the adoptlon of this resolution to all persons owning real property affected by the sidewalk assessment repalr program, whose names and addresses appear on the last equalized assessment roll for the Clty taxes or as known to the City Clerk. -1- . . . - - - ,. .
