Introductlon
ThlS report requests the Clty Council hold a Public Hearlng for the
assessment of costs to repalr damaged sldewalks, drlveways and curbs withln
the City of Santa Monlca and to adopt the attached Resolution conflrmlng the
assessment of costs.
Background
On September 24, 1980, the Clty Councll set a Public Hearing for October 28,
1980, on the assessment of costs to repalr damaged sidewalks, drlveways and
curbs wlthln the City (Item 6-H). Indivldual letters stating the cost of
thlS lmprovement were mal led to each property owner on October 10, 1980,
Recommendatlon
It 1S recommended the Councll.
1. Open the Public Hearing
2. Close the PubllC Hearlng and overrule any protests, and
3. Adopt the Resolutlon conflrmlng the assessment costs.

You are hereby notlfled that the C1ty Counc1l of the C1ty of Santa Mon1ca,
on tne 28th day of October, 1980, at the hour of 7:30 p,m., ln the Council
Chambers ln the Santa Monica C1ty Hall, 1685 Main Street, wlll hear and
pass upon a report by the Street Superlntendent of the cost of the removal
and replacement of PCC sldewalk as requ1red by the C1ty Councl1 under
D1vlslon 7, Chapter 22, Sections J600 to 5630 inclus1ve, of the Streets
and Hlghways Code of the State of Cal1fornla,
The total cost of the work at the above named located is S
The proposed assessment lS S , Wh1Ch is one half the total cost
of the work, and may be assessed by the Clty Councl1 against sald property
upon conflrmatlon of the Street Superlntendent's report.
The above assessment lS due and payable wlthln 30 days after 1tS conflrmatlon
on October 28, 1980, by the Counc1l, If the assessment lS not pa1d by that
date, the Clty has the rlght to file a 11en agalnst the property in the
amount of the assessment plus an adminlstratlve fee. The C1ty will provide
assistance for low-to-moderate lncome persons. For informatlon, call

All protests or obJections to the above work must be submitted ln writ1ng

REPAIR OF DAMAGED SIDEALKS, DRIVEWAYS, CURBS, AND/OR
REMOVAL OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF
DIVISION 7, CHAPTER 22, SECTIONS 5600 to 5630, INCLUSIVE,
OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF
CALIFORNIA (SR-80-7)
Pursuant to the provislons of D1V1S1on 7, Chapter 22, Sectlons 5600
to 5630, lncluslve, of the Streets and Hlghways Code of the State of Cal1fornla,
the following work was caused to be done by the Street Superintendent:
The removal and replacement of 975 square feet of PCC concrete On
sidewalks;
The removal and replacement of 333 square feet of pec concrete on
dn veways; and
The removal of 56 square feet of concrete in parkway.
The total cost of the work was $4,341.00, based on the following charges:
Removal and replacement of'

Remova 1 , . $1.50/sq. ft.
The total proposed assessment 1S 32,170.50, or 50 percent of the total cost,

RESOLUT ION NO. 6104
(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS. DRIVE-
WAYS AND CURBS (SR-30-7)
WHEREAS, the Street Superintendent of the City of Santa Monica, pursuant
to Section 5600 to 5630 of the Streets and Highways Code. commenced proceedings
to cause the repalr of damaged sldewalks, drlveways and curbs 1n the C1ty of
Santa Monlca, and
WHEREAS, S1Xty days after sald order was served, the work had not been
completed by the owners or persons 1n possession of the affected properties,
and the Superintendent of Streets caused the work to be done; and
WHEREAS, the Superintendent of Streets did file with the City Council of
the Clty of Santa Monlca his reports of such work, and a hearing thereon was
called by Resolution No. 6089 (ceS); and
WHEREAS, the Clty Councl1 conducted a noticed hearing to conslder any
protests or objections to the reports of the work.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. That the Report of Work of the Superintendent of Streets
heretofore filed and above described, be and the same is hereby confirmed.
SECTION 2. That all of sald protests and objections of every kind and
nature to the repalrs or to the assessments and all appeals therefrom to
said City Councll be and the same hereby are overruled and denied,
SECTION 3, That the cost of the repairs, as set forth in said Report,
shall be assessed against the properties herein described, which propertles
front upon the improvement so constructed.

SECTION 4. That if such assessment is not pald wlthln the tlme permltted
by law the same shall constitute a speclal assessment and lien agalnst the
propertles thereln descrlbed, ln the amount set forth in sald Report, WhlCh
lien shall continue untll the assessment and all interest thereon is paid.
SECTI ON 5, That lf the assessment is not paid wlthin the time permitted,
the City Clerk shall deliver a Notice of Lien, slgned by the Superlntendent
of Streets, as provlded In Sectlon 5626 of the Streets and Highways Code of
the State of Callfornia, to the County Assessor and Tax Collector, who, in
accordance wlth appllcable law, shall collect said assessment, together with
all other taxes relating to such property.
SECTION 6. That the City Clerk shall certify to the adoption of this
ResolutlOn.
