Introduction
The Clty Council set a Pub11C Hearing for the assessment of costs to
repalr damaged sidewalks. drlveways and curbs at varlOUS areas within the
Clty. It is recommended the Councll adopt the attached Reso1utlon conflrming
the assessment of costs.
Background
On October 14. 1980, the Clty Council set a Public Hearin9 for November 11,
1980, on the assessment of costs to repalr damaged sldewalks, driveways and
curbs withln the City of Santa Monlca, Individual letters stating the cost
of this lmprovement were mal1ed to each property owner on October 27. 1980.
Attached lS the Resolutlon No. 6095 (CCS) settlng the date of the Public
Hearing (Item 6-F-7).
RecommendatlOn
It is recommended that the CounCl]
l. Open the Pub11C Hearlng;
2. Close the PubllC Hearing and overrule any protests; and
3. Adopt the Resolution conflrmlng the assessment costs

TO THE REPORT OF THE SUPERINTENDPH OF STREETS REGARDING

THE CITY COUNCIL OF THE CITY OF SAt'ITA nDNICA DOES HEREBY RESOLVE
AS FOlLO,;S:
SECTION 1. That the Superlntendent of Streets will flle a report
of work pursuant to Dlvlslon 7, Chapter 22, Sectlons 5600 and 5630 of t~e
Streets and Hlghways Code of the State of Californla, relatlng to the
constructlon of certaln improvements to sidewalks and drlveways.
SECTIGri 2. That pursua~t to Sectlon 5600 et seq. of sald code
the City Councll does hereby order and declare that on the 11th day of
November 1980, in the Councll Chanbers of the City Hall, lt wlll hear and
pass upon any and all objectlons or protests to the report of work of the
Superlntendent of Streets and t~e amount of t~e assessment asslgned against
the real property descrlbed in sald report.
SECTIO'\ 3. That all protests or obJectlons must be in wrltlrq
and fl1ed with the Clty Clerk on or before the tine set for hearlng of
protests and objectlons.
SECTION LI, The Street Superlntendent hereby lS dlrected to nall
notlces, in the manner and for~ prescrlbed by law, of the adoptlon of t~lS
resolution to all persons owning real property affected by the slde~alk
assessment repalr progra~, whose na~es and addresses appear on the last
equalized assessment roll for the clty taxes or as known to the Clty Clerk.

SECTION 5. The City Clerk shall certlfy to the adoptlon of
thlS resolutio~ and the~ceforth and thereafter the same shall be 1~ full
force and effect.

Dear Property Owner:
ThIS letter is notificatIon that the CIty CouncIl, on the 11th day
of November, 1980, at 7:30 p.m. in the CouncIl Chal'lbers in the
Santa MonIca CIty Hall, 1685 Main Street, WIll act on a report by
the Street SuperIntendent of the cost of the removal and
replacement of SIdewalk as required by Division 7, Chapter 22,
SectIons 5600 and 5630 inclusive, of the Streets and Highways Code
of the State of CalifornIa.
The total cost of the work that was done at the above location is
$ .
Your cost IS $ , which IS one half the total cost and will
be assessed against your property after confirmation of the Street
Superintendent's report.
The above assessment is due and payable no later than December 11 ,
1980.
If the assessment IS not paId by that date, the City has the right
to file a lien agaInst the property
The City will provide aSsIstance for low-to-moderate Income

extensIon 216.
All protests or objections to the above work must be submitted in
writIng and filed wIth the CIty Clerk on or before 7:30 p.m.,

REMOVAL OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS
OF DIVISION 7, CHAPTER 22, SECTIONS 5600 to 5630,
INCLUSIVE, OF THE STREETS AND HIGHWAYS CODE OF THE STATE
OF CALIFORNIA (SR-80-8)
Pursuant to the provislons of Divislon 7, Chapter 22, Sections
5600 to 5630, incluslve, of the Streets and Hlghways Code of the State of
Californla, the followlng work was caused to be done by the Street Superlntendent:
The removal and replacement of 1,027 square feet of pec
concrete on sidewalks; and
The removal and replacement of 23 llneal feet of PCC curb, and
The removal of 68 square feet of PCC concrete.
The total cost of the work was $3,413,00, based on the followlng charges:
Removal and replacement of:

pee curb . . . . , , 510.00/11neal ft.
Removal only . $1.50/sq. ft.
The total proposed assessment is $1,706.50, or 50 percent of the total cost,
The other 50 percent of the cost lS being pald by the City,

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS,
DRIVEWAYS AND CURBS (SR-80-8)
WHEREAS, the Street Superintendent of the Clty of Santa Monica,
pursuant to Sectlon 5600 to 5630 of the Streets and Highways Code, commenced
proceedings to cause the repair of damaged sidewalks, drlveways and curbs in
the City of Santa Monica, and
WHEREAS, sixty days after said order was served, the work had
not been completed by the owners or persons ln possession of the affected
properties. and the Superintendent of Streets caused the work to be done; and
WHEREAS, the Superlntendent of Streets did file with the City
Council of the City of Santa Monica his reports of such work, and a hearing thereon
was called by Resolution No. 6095 (CCS); and
WHEREAS, the City Council conducted a noticed hearing to conslder
any protests or objectlons to the Reports of the Work.
NOW. THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Report of Work of the Superintendent of
Streets heretofore filed and above described, be and the same is hereby
confi rmed.
SECTION 2. That all of said protests and objections of every
kind and nature to the repairs or to the assessments and all appeals therefrom
to said City Council be and the same hereby are overruled and denied.

SECTION 3. That the cost of the repalrs, as set forth in said
Report. shall be assessed against the propert1es descrlbed hereln, Wh1Ch
propert1es front upon the improvement so constructed.
SECTION 4. That If such assessment is not pald within the time
permitted by law the same shall const1tute a special assessment and lien
a9a1nst the properties therein descrlbed, 1n the amount set forth 1n said
Report, whlch lien shall continue until the assessment and all interest thereon
is paid.
SECTION 5 That if the assessment is not paid within the time
permitted, the Clty Clerk shall deliver a Notice of Lien, slgned by tne
Superintendent of Streets, as provided in Section 5626 of the Streets and
Hlghways Code of the State of California, to the County Assessor and Tax
Collector. who. in accordance wlth applicable law, shall collect said
assessment, together with all other taxes relating to such property.
SECTION 6. That the City Clerk shall certify to the adoption of
thlS Resolutlon.
