Introduction
The City Council set a Public Hearing for the assessment of costs
to repa~r daP1aged sidewalks, driveways and curbs at various areas
within the C~ty. It is recommended the Counc~l adopt the attached
Resolut~on confirm~ng the assessment of costs.
Background
On October 29, 1980, the ei ty Council set a public hear~ng for
November 25, 1980, on the assessment of costs to repair damaged
s:tdewalks, driveways and curbs with~n the City of Santa Monlca.
Individual letters stating the cost of this improvement were
ITia~led to each property owner on November 10, 1980. Attached is
Resolutlon No. 6113 (ecs) setting the date of the Publ~c Hearing
(ltem 6-J),

It is recommended the Clty Council:
l. Open the Publ~c Hearing;
2. Close the Public Hearing and overrule any protests; and
3. Adopt the Resolution confirm~ng the assesSP1ents.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA t-lONICA C01'1FIRNING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAHI-l.GED SIDEWALKS, DRIVEHAYS AND CURBS
(SR-80-9)
'\THEREAS, the Street Superintendent of the City of Santa
r.~onica , pursuant to Sectlon 5600 to 5630 of the Streets and
Highways Code, comnenced proceedlngs to cause the repair of
damaged sidewalks, driveways and curbs in the Clty of Santa
Honica, and t
WHEREAS, sixty days after said order was served, the
work had not been completed by the owners or persons in possession
of the affected properties, and the Superintendent of Streets
caused the work to be done; and
'l'mEREAS, the Superintendent of Streets did file with the
City Council of the City of Santa Monlca his report of such work,
and a hearing thereon was called by Resolution No. 6113 (CCS); and
WHEREAS, the City Council conducted a notlced hearing to
consider any protests or objectlons to the Report of Work;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
HONICA DOES HEREBY RESOLVE AS FOLLOWS: t
SECTION 1. That the Report of h'ork of the
Superintendent of Streets heretofore flIed and above-descrlbed, be
and the saMe is hereby conflrmed.
SECTION 2. That all of sald protests and objections of
every kind and nature to the repairs or to the assessments and all
appeals therefrom to said City Council be and the same hereby are
overruled and denied.

SECTION 3. That the cost of the repairs, as set forth
in said Repo rt , shall be assessed against the properties described
there~n, wh~ch properties front upon the improvement so
constructed.
SECTION 4. That if such assessment is not paid wi thin
the t~me pernutted by law, the same shall constitute a special
aSseSSl'lent and lien agalnst the propert~es therein described, in
the amount set forth in said Report, which l~en shall continue
until the assessment and all interest thereon is pald.
SECTION 5. That if the assessment is not paid within

the time permitted, the CJ_ ty Clerk shall deliver a Notice of Lien,
signed by the Superintendent of Streets, as provided in Sectlon
5626 of the Streets and Highways Code of the State of California,
to the County Assessor and Tax Collector, who, in accordance with
appl~cable law, shall collect said assessment, together with all
other taxes relatlng to such property.
SECTION 6. That the City Clerk shall certify to the
adoption of this Resolution,

Pursuant to the provislons of D1V1S1on 7, Chapter 22, Sectlons 5600
to 5630, lncluslve, of the Streets and Hlghways Code of the State of Cal1fornla,
the following work was caused to be done by the Street Superintendent:
The removal and replacement of 975 square feet of PCC concrete On
sidewalks;
The removal and replacement of 333 square feet of pec concrete on
dn veways; and
The removal of 56 square feet of concrete in parkway.
The total cost of the work was $4,341.00, based on the following charges:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA SETTING A HEARING DATE FOR ANY PROTESTS OR
OBJECTIONS TO THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING REPAIR OF SIDEWALKS, DRIVEWAYS AND CURBS.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE
AS FOLLOWS;
SECTION 1. That the Superintendent of Streets will file a report of
work pursuant to Division 7, Chapter 22, Sections 5600 and 5630 of the Streets
and Hlghways Code of the State of Californla, relatlng to the construction
of certain lmprovements to sldewalks and driveways.
SECTION 2. That pursuant to Sectlon 5600 et seq. of said code the City
Council does hereby order and declare that on the 25th day of November, 1980
in the Councll Chambers of the City Hall, lt will hear and pass upon any and
all obJections or protests to the report of work of the Superintendent of
Streets and the amount of the assessment assigned against the real property
described in said report.
SECTION 3. That all protests or obJectlons must be in writlng and
flled with the Clty Clerk on or before the tlme set for hearing of protests
and obJections,
SECTION 4, The Street Superlntendent hereby is dlrected to mail notices
ln the manner and form prescribed by law, of the adoptlon of this resolution
to all persons ownlng real property affected by the sldewalk assessment
repalr program, whose names and addresses appear on the last equa11zed
assessment roll for the city taxes or as known to the Clty Clerk.

Curb; and
The removal of 47 square feet of PCC concrete.
The total cost of the work was $3,804.50, based on the fallowing
charges:

Type A curb . .$10.00/1. ft.
Removal only . $1. SO/sq. ft.
The total proposed assessment is $1,902.25, or 50 percent of the
tot al cost. The other 50 percent of the cost is being paid by the
City.
