Subject: Public Hearing on Assessments of Costs to
Repair Damaged Sldewalks, Driveways and
Curbs (SR-80-12)
Introduction
The City Council set a Public Hearing for the assessment of costs
to repair damaged sidewalks, driveways and curbs at various areas
within the City. It is recommended the Council adopt the attached
Resolution confirming the assessment of costs.
Background
On January 14, 1981, the City Council set a publ ic hearing for
February 10, 1981, on the assessment of costs to repair damaged
sidewalks, driveways and curbs within the City of Santa Monica.
Individual letters stating the cost of this improvement were
ma i1 e d to each property owner on January 28, 1981. Attached is
Resolution No. 6170 (CCS) setti ng the date of the Public Hearinq
(Item 6-M).
Recommendation
It is recommended the Clty Council:
1. Open the Public Hearing;
2. Close the Public Hearinq and overrule any protests; and
3. Adopt the Resolution confirming the assessments.

THE CITY COUNCIL OF THE CITY OF SANTA MnNICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the Superintendent of Streets

Highways Code of the State of Cal ifornia, relating to
the construction of certain improvements to sidewalks
and dri veways.
SECTION 2. That pursuant to Section 5600 et
seq. of said code, the City Council does herehy order

must be in writing and filed with the City Clerk on or
before the time set for hearing of protests and

SECTION 4. The Superintendent of Streets is hereby

will act on a report by the Street Superintendent of the cost
of the removal and replacement of sidewalk as required by
Division 7, Chapter 22, Sections 5600 and 5630 inclusive, of
the Streets and Highways Code of the State of California.
The to tal cost of the work that ",as done at the above
location is $1,404.00,_
Your cost is $702.00, which is one half the total cost and
wi 11 be assessed against your property after confirmation of
the Street Superintendent's report.

The above assessment is due and payable no later than March
12, 1981.
If the assessment is not paid by that date, the Ci ty has the
right to file a lien against the property.
The City will provide assistance for low-to-moderate income

REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS,
AND/OR REMOVAL OF OBSTRUCTIONS, PERFORMED
UNDER PROVISIONS OF DIVISION 7, CHAPTER 22,
SECTIONS 5600 TO 5630, OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORNIA
(SR-80-12)
Pursuant to the provisions of Division 7, Chapter 22,
Sections 5600 to 5630, of the Streets and Highways Code of the
S tate of California, the following work was caused to be done by
the Street Superintendent:
The removal and replacement of
691.5 square feet of PCC concrete
on sidewalks;
The removal and replacement of
356 square feet of PCC concrete
on driveways;
The removal and replacement of
24.6 lineal feet of Type A and
curb; and
The removal and replacement of
65 square feet of PCC concrete.
The to tal cost of the work was 53,842, based on the following
charges:
Removal and replacement of:
PCC sidewalk $3.00/sq.ft.
PCC driveway. . $4.00/sq.ft.
Type A Curb .~10.00/1. ft.
Removal only $1.50/sq.ft.
The to tal proposed assessment is $1,921.00, or 50 percent of the
to tal cost. The other 50 percent of the cost is being paid by the
Ci ty.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-80-12)
WHEREAS, the Street Superintendent of the City of Santa
Monica, pursuant to Section 5600 to 5630 of the Streets and
Highways Code, commenced proceedings to cause the repair of
damaged sidewalks, driveways and curbs in the City of Santa
Monica, and
WHEREAS, sixty days after said order was served, the
work had not been completed by the owners or persons in possession
of the affected properties, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superintendent of Streets did file with the
City Council of the City of Santa Monica his report of such work,
and a hearing thereon was called by Resolution No. 6170 (CCS) ; and
-~ -1 .,...... ;;....-- ~~ WHEREAS, the City Council conducted a noticed hearing to,
consider any protests or objections to the Report of Work;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECn ON 1. That the Report of Work of the
Superintendent of Streets heretofore filed and above-described, be
and the same is hereby confirmed.
SEe TI ON 2. That all of said protests and objections of
:
every kind and nature to the repairs or to the assessments and all
appeals therefrom to said City Council be and the same hereby are
overruled and denied.

SECTION 3. That the cost of the repairs, as set forth
in said Report, shall be assessed against the properties described
therein, wh i c h properties front upon the improvement so
constructed.
SEe Tl ON 4. That if such assessment is not paid within
the time permitted by law, the same shall constitute a special
assessment and lien against the properties therein described, in
the amount set forth in said Report, which lien shall continue
until the assessment and all interest thereon is paid.
SECTION 5. That if the assessment is not paid within
the time permitted, the City Clerk shall deliver a Notice of Lien,
signed by the Superintendent of Streets, as provided in Section
5626 of the Streets and Highways Code of the State of California,
to the County Assessor and Tax Collector, who, in accordance with
applicable law, shall collect said assessment,together with all
other taxes relating to such property.
SECTION 6. That the City Clerk shall certi fy to the
adoption of this Resolution.
