Introduction
The City Council set a Public Hearing for the assessment of costs
to repair damaged sidewalks, driveways and curbs at various areas
within the City. It is recommended the Council adopt the attached
Resolution confirming the assessment of costs.
Background
On January 27, 1981, the City Council set a public hearing for
February 24, 1981, on the assessment of costs to repair damaged
"
sidewalks, driveways and curbs within the City of Santa Monica.
Individual letters stating the cost of this improvement were
mail ed to each property owner on Februar:J 11, 1981. Attached is
Resolution No. 6190 (CCS) setting the date of the Public Hearing
(Item 6-0).
Recommendation
It is recommended the City Council:
1. Open the Public Hearing;
2. Close the Public Hearing and overrule any protests; and
3. Adopt the Resolution confirming the assessments.

HEARING DATE FOR ANY PROTESTS OR
OBJECTIONS TO THE REPORT OF THE

DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1 . That t~e Suoerintendent of Streets
wi 11 fil e a report of work pursuant to Division 7,
Chapter 22, Sections 5600 and 5630 of t~e Streets and
Highways Code of the State of- Cal i forni a, relating to
tfle construction of certain improvements to sidewalks
and driveways.
SECTION 2. That pursuant to Section ~600 et
seq. of said code, the City Council does hereby order
and declare that on t~e 2at~ day of Februa ry, 19 AI, in
the Council C~ambers of the City Hall, it will hear and
pass upon any and all objectlons or protests to t~e
report of ~ork of t~e Superintendent of Streets and the
amount of the asseSSl'lent assigned against the real
pronerty described in said report.
SECTION 3. Tha t all protests or ohjections
must be in writlng and flled with the City Clerk on or
before the t ll~e se t for heari nQ of protests and
ohjections.

Dear Property Owner:
This letter is notification that the City Council, on the
24th day of February, 1981, at 7:30 p.m. in the Council
Chambers in the Santa Monica City Hall, 1685 Main Street,
will act on a report by the Street Superintendent of the cost
of the removal and replacement of sidewalk as required by
Division 7, Chapter 22, Sections 5600 and 5630 inclusive, of
the Streets and Highways Code of the State of California.
The to tal cost of the work that was done at the above
location is $300.00.
Your cost is $150.00, which is one hal f the total cost and
wi 11 be assessed against your property after confirmation of
the Street Superintendent's report. The City's policy is to
assess only once for the same improvement if caused by tree
damage. Therefore, you wi 11 not be assessed again for
repairs at th is location if the damage is caused by tree
roots.
The above assessment is due and payable no later than March
24, 1981.
If the assessment is not paid by that date, the City has the
right to file a lien against the property.
The City will provide assistance for low-to-moderate income

UNDER PROVISIONS OF DIVISION 7, CHAPTER 22,
SECT! ONS 5600 TO 5630, OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORNIA
(SR-80-13)
Pursuant to the provisions of Division 7, Chapter 22,
Sections 5600 to 5630, of the Streets and Highways Code of the
State of California, the following work was caused to be done by
the Street Superintendent:
The removal and replacement of
703 square feet of PCC concrete
on sidewalks;
The removal and replacement of
60 square feet of PCC concrete
on driveways;
The removal and replacement of
152 square feet of pce concrete.
The total cost of the work was $2,577, based
on the fallowing charges:
Removal and replacement of:
pee sidewalk. . . $3.00/SQ.ft.
pee driveway. . $4.00/sQ.ft.
Type A Curb . .S10.0011. ft.
Removal only . . $l.50/sq.ft.
The total proposed assessment is $1,288.50, or 50 percent of the
total cas t. The other 50 percent of the cost is being paid by the
City.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS At-lD CURBS
ISR-80-13)
WHEREAS, the Street Superintendent of the City of Santa
Monica, pursuant to Sec t ion 5600 to 5630 of the Streets and
Hi ghways Code, commenced proceedings to cause the repair of
damaged sidewalks, driveways and curbs in the City of Santa
Monica, and
WHEREAS, six ty days after said order was served, the
work had not been completed by the owners or persons in possession
of the affected properties, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superintendent of Streets did file with the
City Counc il of the City of Santa Monica his report of such work,
and a hearing thereon was called by Resolution No. 6190 I CCS); and
WHEREAS, the City Council conducted a noticed hearing to
consider any protests or objections to the Report of Work;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION l. That the Report of Work of the
Superintendent of Streets heretofore filed and above-described, be
and the same is hereby confirmed.
SECTION 2. That all of said protests and objections of
every kind and nature to the repairs or to the assessments and all
appeals therefrom to said City Council be and the same hereby are
overruled and denied.

SECTION 3. That the cost of the repairs, as set forth
in said Report, shall be assessed,agafnst the properties described
therein, wh i c h properties front upon the improvement so
constructed,
SECTION 4. That if such assessment is not paid within
the time permitted by 1 aw, the same shall constitute a special
assessment and lien against the properties therein described, in
the amount set forth in said Report, which lien shall continue
until the assessment and all interest thereon is paid,
SECTION 5. That if the assessment is not paid within
the time permitted, the City Clerk shall deliver a Notice of Lien,
signed by the Superintendent of Streets, as provided in Section
5626 of the Streets and Highways Code of the State of california,
to the County Assessor and Tax Collector, who, in accordance with
applicable law, shall collect said assessment,together with all
other taxes relating to such property.
SECTI ON 6. That the City Clerk shall certify to the
adoption of this Resolution.
