It is recommended that the City Council adopt the attached Resolution confirming the assessment of costs. Background On November 24, 1987, the City Council set a public hearing for January 12, 1988, on the assessment of costs to repair damaged sidewalks, driveways and curbs within the city of Santa Monica. Notices were sent on December 31, 1987, to property owners informing them of the public hearing in accordance with the legal requirements of Chapter 22 of the Improvement Act of 1911. Budget/Financial Impact This assessment district will generate revenues to the City over the next two years in the amount of $8,916. WHEREAS, the superintendent of Streets gave notice as required by Section 5616 of the streets and Highways Code; and WHEREAS, the Superintendent of Streets did file with the City Council of the City of Santa Monica his report of repairs and costs as required by Section 5617 of the streets and Highways Code: and WHEREAS, upon the day and hour fixed for hearing by Resolution Number 7517 (CCS), the City Council of the city of Santa Monica heard and passed upon the report of the Superintendent of streets together ---- ---- -- ------ ---- -- - -- -- - , . with all objections and protests as required by section 5618 of the . . streets and Highways Code, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The report of the Superintendent of streets heretofore filed and above-described be, and the same hereby is, confirmed. SECTION 2. All protests and objections of every kind and nature to the report of the Superintendent of streets be, and the same hereby are, overruled and denied. SECTION 3. The cost of the repairs, as set forth in the report of the Superintendent of Streets, shall be assessed against the properties therein described, which properties front the sidewalk upon which the repairs were made. SECTION 4. If such assessment is not paid within the time . permitted by law, the shall constitute special assessment same a against and lien on the properties therein described in the amount set forth in the report of the Superintendent of Streets, which lien shall continue until the assessment and all interest thereon is paid or until it is discharged of record. SECTION 5. If the assessment is not paid within the time permitted by law, the Superintendent of Streets, in accordance with section 5628 of the Streets and Highways Code, shall deliver a Notice of Lien, prepared in the manner required by Section 5626 of the . \ , . streets and Highways Code, to the County Auditor who shall collect the , assessment together with all other taxes against the property. The length of curb in. question was installed to close the opening left from an abandoned driveway fron the prior house. A Z I the cem.ent work was done by the ltcenesed cement contractor who was hired to set the new house. The work was approved by the City Inspectors. It should be noted here that within three months the City/at its expens~ replaced m.y neighbo~s sidewalks because of the poor condition they werein. The reason the sidewalk and curb was replaced was because in April 1986 a neighbor walking on the area of the sidewalk that had not been replaced..ft!ll down on this slab which had begun to break up due to Magnolia tree roots from the tree in the parkway. I called city Hall and inquired about the sidewalk being repaired to ppevent any further accidents. On 4-30-86 a City sidewalk inspector arrived to see the damaged walk and at the time noted that asection of curb was also raising on one end . The inspector filled out forms designating the areas and the cost estimate which I then filed with the City as instructed. The Insoector called street repair and a black top patch was ~ade on the walk. I asked the inspector to proceed with the replacements. Finally after a year or more had passed a City crew showed up and proceeded to remove the damaged watk and curb and replace with new concrete. The curb had raised another inch between the initial discovery and the repair. The curb also was raised by the root action of the same Magnolia tree in the City Parkway. I understand that when such is caused by oarkway tree roots a consideration is mad e in the charges.
