SUBJECT: Resolution Setting a Public Hearing for June 27, 1989,
on the Assessment of Costs to Repair Damaged Sidewalks,
Driveways, and Curbs on Various streets (SR-89-138/139)
Introduction
This report requests that the city Council set a public hearing
for June 27, 1989, to hear protests regarding the work and
confirm the assessments of the cost to repair damaged sidewalks,
driveways and curbs.
Background
On October 9, 1979, the city Council approved a sidewalk repair
program which provided for property owner participation in the
cost of repairing damaged sidewalks. Residential property owner
participation is 50% of the cost of the repairs if the damage is
related to tree roots; the City pays the remaining 50% of the
cost of the repair. Property owners are assessed 100% of the
cost if the damage is not related to tree roots and commercial
property owners are assessed 100% of the cost regardless of the
cause of the damage.
Certain repair work has been completed at the following addresses
and the property owners' share of the cost is now due for the
following properties: 653-655 Navy street, 754 Navy street, 707
Navy street, 738 Marine street, 638 Marine street, 801-807 Second
Street, 911 Second Street, 743 Ozone street, 641 Ozone Street,
130 Washington Avenue, 848 22nd street, 1310 18th Street, 1048

Navy street, 636 Navy street, 2216 Marine street, 422 24th
street, 702 Marine street, 841-853 Second street, 1038 Second

Strand Avenue, 223 Palisades Avenue, 1044 Yale Street, 1602 Santa
Monica Boulevard.
A hearing must be held pursuant to the provisions of Chapter 22,
sections 5600 to 5630, of the streets and Highways Code of the
State of California. A Resolution setting the public hearing for
June 27, 1989, is attached.
BUdget/Financial Impact
The financial analysis, which will indicate total revenues to be
derived from this assessment district over the next two years,
will be presented to City Council at the time of public hearing.
Recommendation
It is recommended the City Council adopt the attached Resolution
setting a public hearing for June 27, 1989, on the assessment of
costs of the subject sidewalk repairs.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA SETTING A HEARING
DATE FOR ANY PROTESTS OR OBJECTIONS TO
THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING REPAIR OF SIDEWALKS,
DRIVEWAYS AND CURBS (SR-89-138/1J9)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. The Superintendent of streets will file a
report of repair pursuant to Section 5617 of the streets and
Highways Code of the state of California, relating to the
construction of certain improvements to sidewalks and driveways
at 653-655 Navy Street, 754 Navy Street, 707 Navy street, 738
Marine street, 638 Marine street, 801-807 Second street, 911
Second street, 743 Ozone street, 641 Ozone street, 130 washington
Avenue, 848 22nd Street, 1310 18th street, 1048 Pico Boulevard,
243 Mills street, 1911 California Avenue, 724 Navy street, 636
Navy Street, 2216 Marine street, 422 24th street, 702 Marine
street, 841-853 Second Street, 1038 Second Street, 810 Ozone
Street, 1257 12th street, 2643 centinela Avenue, 619 11th Street,
819 Pier Avenue, 2020 Hill street, 317 Strand Avenue, 223
Palisades Avenue, 1044 Yale Street, and 1602 Santa Monica
Boulevard, all within the City of Santa Monica.
SECTION 2. Pursuant to Section 5600 et seq of said Code,
the City Council does hereby order and declare that on the 27th
day of June, 1989, at 7:30 P.M., in the City Council Chambers of
City Hall, it will hear and pass upon the report by the
Superintendent of Streets of the cost of repairs, together with

any objections or protests, it any I which may be raised by any
. property owner liable to be assessed tor the cost of such repairs
and any other interested persons.
SECTION 3. All protests or objections must be in writing
and tiled with the City Clerk on or before the time set for the
hearinq of the protests and objections.
SECTION 4. The Superintendent of Streets is hereby
directed to mail notices, in the manner and form prescribed by
law, of the costs of repair and of the adoption of this
Resol ution to all persons owning real property affected by.. the
sidewalk assessment repair program, whose names and addresses
appear on the last equalized assessment roll for the City taxes
or as known to the City Clerk.
SECTION 5. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and eftect.
