SUBJECT: Setting March 24, 1981, as the Date for
Public Hearing on the Assessment of Costs
to Repair Damaged Sidewalks, Driveways,
and Curbs (SR-80-1S)
Introduction
This report requests the City Council set a pUblic hearing for the
assessment of the costs to repair damaged sidewalks, driveways and
curbs.
Background
On October 9, 1979, the City Council approved a sidewalk repair
program wh i c h provided for property owner participation in the
cost of repairing damaged sidewalks ( I tern ll-C). Property owner
participation was set at 50% of the cost of the repairs; the City
wi 11 pay the remaining 50% of the cost of the repair without
regard to the reason for the damage.
Certain repair work has been completed and the prooerty owners'
share of the costs will now be due. A pUblic hearing must be held
pursuant to provisions of Division 7, Chapter 22, Sections 5600 to
5630, of the Streets and Highways Code for the State of
California. A resolution setting the public hearing for March 24,
1981 is attached.

Recommendation
It is recommended the City Council adopt the attached resolution
setting a public hearing for March 24, 1981, on the assessment of
costs of the subject sidewalk repairs.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA SETTING A
HEARING DATE FOR ANY PROTESTS OR
OBJECT! ONS TO THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING
REPAIR OF SIDEWALKS, DRIVEWAYS AND
CURBS. (SR-80-151
THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the Superintendent of Streets
wi 11 fil e a report of work pursuant to Division 7,
Chapter 22, Sections 5600 and 5630 of the Streets and
Highways Code of the State of California, re1 ati ng to
the construction of certain improvements to sidewalks
and driveways.
SECT I ON 2. That pursuant to Section 5600 et
seq. of said code, the City Council does hereby order
and declare that on the 24th day of March, 1981, in the
Council Chambers of the Ci ty Hall, it will hear and pass
upon any and all abjections or protests to the report of
work of the Superintendent of Streets and the amount of
the assessment assigned against the real property

described in said report.
SECTION 3. That all protests or objections
must he in writing and filed with the City Clerk on or
before the time set for hearing of protests and
objections.
SECTION 4. The Superintendent of Streets is hereby

prescribed by law, of the adoption of this resolution to

all persons owning real property affected by the
sidewalk assessment repair program, whose names and
addresses appear on the last equalized assessment 1"011
for the City taxes or as known to the City Clerk.
SECTION 5. The City Cl erk shall certi fy to
the adoption of this resolution and thenceforth and
thereafter the same shall be in full force and effect.
