SUBJECT: Resolution Repealing Resolution No. 7386 Setting a
Public Hearing for April 14, 1987, resetting a Public
Hearing for April 28, 1987, on the Assessment of Costs
to Repair Damaged Sidewalks, Driveways, and Curbs on
Various streets (SR-87-97)
Introduction
This report requests that the City council repeal Resolution No.
7386 setting a public hearing for April 14, 1987, and reset the
pub1 ic hearing for April 28, 1987, to hear protests regarding
the work and confirm the assessments of the cost to repair
damaged sidewalks, driveways and curbs.
Background
On October 9, 1979, the city Council approved a sidewalk repair
program which provided for property owner participation in the
cost of repairing damaged sidewalks. Residential property owner
participation is 50% of the cost of the repairs if the damage is
related to tree roots; the City pays the remaining 50% of the
cost of the repair. Property owners are assessed 100% of the
cost if the damage is not related to tree roots and commercial
property owners are assessed 100% of the cost regardless of the
cause of the damage.
Certain repair work has been completed at the following addresses
and the property owners' share of the cost is now due for the
following properties: 817 Pier Avenue, 813 Pier Avenue, 1001
Pier Avenue, 1433 Franklin Street, 1443 Franklin Street, 1007

Pier Avenue, 1015 Pier Avenue, 214 23rd street, 1620-26
California Avenue, 337 Euclid street, 1150-44-38 Yale street, and
1003 pier Avenue.
A hearing must be held pursuant to the provisions of Chapter 22,
Sections 5600 to 5630, of the streets and Highways Code of the
state of california. On March 10, 1987 a resolution was approved
setting a public hearing for April 14, 1987. However, it was
later decided that the City Council would not meet on April 14th.
Therefore, a new public hearing date must be set. The attached
resolution repeals Resolution No. 7386 that set a public hearing
for April 14, 1987, and resets the public hearing for April 28,
1987.
BUdget/Financial Impact
The financial analysis, which will indicate total revenues to be
derived from this assessment district over the next two years,
will be presented to city council at the time of public hearing.
Recommendation
It is recommended the City Council adopt the attached Resolution
repealing Resolution No. 7386 and resetting a public hearing for
April 28, 1987, on the assessment of costs of the subject
sidewalk repairs.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA REPEALING A
RESOLUTION SETTING A PUBLIC HEARING AND
RESETTING A HEARING DATE FOR ANY PROTESTS
OR OBJECTIONS TO THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING
REPAIR OF SIDEWALKS, DRIVEWAYS AND CURBS
(SR-87-97)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. Resolution No. 7386 is repealed.
SECTION 2. The Superintendent of streets will file a
report of repair pursuant to section 5617 of the streets and
Highways Code of the state of California, relating to the
construction of certain improvements to sidewalks and driveways
at 817 Pier Avenue, 813 pier Avenue, 1001 pier Avenue, 1433
Franklin street, 1443 Franklin street, 1007 Pier Avenue, 1015
Pier Avenue, 214 23rd Street, 1620-26 California Avenue, 337
Euclid street, 1150-44-38 Yale Street, and 1003 pier Avenue, all
within the City of Santa Monica.
SECTION 3. Pursuant to section 5600 et seq. of said
Code, the City Council does hereby order and declare that on the
28th day of April, 1987, at 7:30 P.M., in the Council Chambers of
City Hall, it will hear and pass upon the report by the
Superintendent of streets of the cost of repair, together with
any obj ections or protests, if any, which may be raised by any

property owner liable to be assessed for the cost of such repair
and any other interested persons.
SECTION 4. All protests or objections must be in writing
and filed with the City Clerk on or before the time set for
hearing of protests and objections.
SECTION 5. The Superintendent of Streets is hereby
directed to mail notices, in the manner and form prescribed by
law, of the cost of repair and of the adoption of this Resolution
to all persons owning real property affected by the sidewalk
assessment repair program, whose names and addresses appear on
the last equalized assessment roll for the City taxes or as known
to the city Clerk.
SECTION 6. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
