SR-506-003-08 (186) .. , ~-e - $""06- tJCJ3--o8 J N 2 4 1989 GS:ss council Meeting: January 24, 1989 Santa Monica, California TO: Mayor and City council FROM: City staff SUBJECT: Resolution setting a Public Hearing for February 28, 1989, on the Assessment of Costs to Repair Damaged Sidewalks, Driveways, and Curbs on Various streets (SR-89-124/125) Introduction This report requests that the city Council set a pUblic hearing for February 28, 1989, to hear protests regarding the work and confirm the assessments of the cost to repair damaged sidewalks, driveways and curbs. Background On October 9, 1979, the City Council approved a sidewalk repair program which provided for property owner participation in the cost of repairing damaged sidewalks. Residential property owner participation is 50% of the cost of the repairs if the damage is related to tree roots; the City pays the remaining 50% of the cost of the repair. Property owners are assessed 100% of the cost if the damage is not related to tree roots and commercial property owners are assessed 100% of the cost regardless of the cause of the damage. Certain repair work has been completed at the following addresses and the property owners' share of the cost is now due for the following properties: 1054 Princeton street, 1024 Princeton street, 2632 Montana Avenue, 830 Princeton street, 846 Princeton street, 904 Princeton street, 912 Princeton street, 942 Princeton street, 2621 Washington Avenue, 2635 Wilshire Boulevard, 2701 t,-e JAN 2 4 1989 -- , "- , Wilshire Boulevard, 803-807 Princeton street, 804-808 Princeton street, 1067 Princeton street, 864 Princeton street, 819 Princeton street, 829 Princeton street, 835 Princeton street, 843 Princeton street, 859 Princeton street, 901 Princeton street, 1019 Princeton street, 1023 Princeton street, 1033 Princeton street, 1051 Princeton street, 1105 Princeton street, and 1062 Princeton street. A hearing must be held pursuant to the provisions of Chapter 22, sections 5600 to 5630, of the streets and Highways Code of the state of California. A Resolution setting the public hearing for February 28, 1989, is attached. BUdget/Financial Impact The financial analysis, which will indicate total revenues to be derived from this assessment district over the next two years, will be presented to city council at the time of public hearing. Recommendation It is recommended the City Council adopt the attached Resolution setting a public hearing for February 28, 1989, on the assessment of costs of the subject sidewalk repairs. The Superintendent of Streets will file a report of repair pursuant to Section 5617 of the Streets and Highways Code of the State of California, relating to the construction of certain improvements to sidewalks and driveways at 1054 Princeton street, 1024 Princeton street, 2632 Montana Avenue, 830 Princeton Street, 846 Princeton street, 904 Princeton street, 912 Princeton street, 942 Princeton Street, 2621 Washington Avenue, 2635 Wilshire Boulevard, 2701 Wilshire Boulevard, 803-807 Princeton street, 804-808 Princeton street, 1067 Princeton Street, 864 Princeton street, 819 Princeton Street, 829 Princeton Street, 835 Princeton street, 843 Princeton Street, 859 Princeton Street, 901 Princeton street, 1019 Princeton Street, 1023 Princeton Street, 1033 Princeton Street, 1051 Princeton street, 1105 Princeton Street, and 1062 Princeton street, all within the City of Santa Monica. SECTION 2. Pursuant to Section 5600 at seq. of said Code, the City council does hereby order and declare that on the 28th day of February, 1989, at 7:30 P.M. , in the City Council Chambers of city Hall, it will hear and pass upon the report by . . - the Superintendent of Streets of the cost of repairs, together with any objections or protests, if any, which may be raised by any property owner liable to be assessed for the cost of such repairs and any other interested persons. SECTION 3. All protests or objections must be in writing and filed with the city Clerk on or before the time set for the hearing of the protests and objections. SECTION 4. The Superintendent of Streets is hereby directed to mail notices, in the manner and form prescribed by law, of the costs of repair and of the adoption of this Resolution to all persons owning real property affected by the sidewalk assessment repair program, whose names and addresses appear on the last equalized assessment roll for the City taxes or as known to the City Clerk.
