Introduction
The City Council set a Public Hearinq for the assessment of costs
to repair damaged sidewalks, driveways and curbs at various areas
within the City. It is recommended the Council adopt the attached
Resolution confirminq the assessment of costs.
Background
On February 10, 1981, the City Council set a public nearing for
March 10, 1981, on the assessment of costs to repair damaqed
sidewalks, driveways and curbs within the City of Santa Monica.
Individual letters stating the cost of this improvement were
mailed to each property owner on February 27, 198!. Attac hed is
Resolution No. 6198 (CCS) sett i nq the date of the Public Hearing
(Itell1 6-B).
RecoJ11mendation
It is recoll1mended the City Council:
l. Open the Public Hearing;
2. Close the Public Hearina and overrule any protests; and
3. Adopt the Resolution confirminq the assessments.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MOIJICA SETTING A
HEARING DATE FOR ANY PROTESTS OR
OBJECTIONS TO THE REPORT OF THE
SUPER I NTENDHlT OF STREETS REGARDING
REPAIR OF SIDEWALKS. DRIVEWAYS AND
CURBS. (SR-80-14)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the Superintendent of Streets
will fil e a report of work pursuant to Division 7.
Chapter 22, Sections 5600 and 5630 of the Streets and
Highways Code of the State of California, relating to
the construction of certain improvements to sidewalks
and driveways.
SECTION 2. That pursuant to Section 5600 et
seq. of said code. the City Council does hereby order
and declare that on the lOth day of March. 1981. in the
Council Chambers of the City Hall. it wi 11 hear and pass
-- upon any and all objections or protests to the report of
work of the Superintendent of Streets and the amount of
the assessment assigned against the real property
described in said report.

SECTION 3. That all protests or objections
must be in writing and filed with the City Clerk on or
before the time set for hearing of protests and
objections.
SECTI ON 4. The Superintendent of Streets is hereby

directed to mail notices, in the manner and form
prescribed by law, of the adoption of this resolution to
all persons owning real prooerty affected by the
sidewalk assessment repair proqram, whose names and
addresses appear on the last eQualized assessment roll
for the City taxes or as known to the City Clerk.
SECTION 5. The City Clerk shall certify to
the adoption of this resolution and thenceforth and
thereafter the same shall be in full force and effect.

Dear Property Owner:
This letter is notification that the City Council. on the
10th day of March, 1981. at 7:30 p.m. in the Council
Chambers in the Santa Monica City Hall, 1685 Main Street,
will act on a report by the Street Superintendent of the cost
of the removal and replacement of sidewalk as required by
Division 7, Chapter 22. Sections 5600 and 5630 inclusive, of
the Streets and Highways Code of the State of California.
The total cost of the work that was done at the above
location is $834.25.
Your cost is $417.13, which is one half the total cost and
will be assessed against your property after confirmation of
the Street Superintendent's report. The City's policy is to
assess only once for the same improvement if caused by tree
damage. Therefore, you will not be assessed again for
repairs at this location if the damage is caused by tree
roots.
The above assessment is due and payable no later than April
9, 198!.
If the assessment is not paid by that date, the City has the
right to file a lien against the property.
The City will provide assistance for low-to-moderate income

AND/OR REMOVAL OF OBSTRUCTIONS, PERFORMED
UNDER P~OVISIONS OF DIVISION 7, CHAPTER 22,
SECTIONS 5600 TO 5630, OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORNIA
(SR-80-14)
Pursuant to the provisions of Division 7, Chapter 22,
Sections 5600 to 5630, of the Streets and Hiqhways Code of the
State of California, the followina work was caused to be done by
the Street Superintendent:
The removal and replacement of
726 square feet of PC concrete
on sidewalks;
The removal and replacement of
173 square feet of PC concrete
on driveways;
The removal and replacement of
37 lineal feet of PC concrete
curbinQ; and
The removal and replacement of
59.5 square feet of PC concrete
1n the pa rkway.
The to tal cost of the work was $3,329.25, based on the following
charges:
Removal and replacement of:
PCC sidewalk $3.00/SQ. ft.
pee driveway $4.00/sQ.ft.
Type A Curb .$10.0011. ft.
Removal only $1.50/sQ.ft.
The to tal proposed assessment is $1,664.63, or 50 percent of the
to tal cost. The other 50 percent of the cost is beina paid by the
City.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-80-14)
WHEREAS, the Street Superintendent of the City of Santa
Monica, pursuant to Section 5600 to 5630 of the Streets and
. Highways Code, commenced proceedings to cause the repair of
damaged sidewalks, dri veways and curbs in the City of Santa
Monica, and
WHEREAS. six ty days after said order was served. the
work had not been completed by the owners or persons in possession
of the affected properties, and the Superintendent of Streets
caused the work to be done; and
WHEREAS. the Superintendent of Streets did file with the
City Counc il of the City of Santa Monica his report of such work.
and a hearing thereon was called by Resolution No. 6198 (CCS); and
WHEREAS, the Ci ty Council conducted a noticed hearing to
consider any protests or objections to the Report of Work;
NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTI ON l. That the Report of Work of the
Superintendent of Streets heretofore filed and above-described, be
and the same is hereby confirmed.
SECTION 2. That all of said protests and objections of
every kind and nature to the repairs or to the assessments and all
appeals therefrom to said City Council be and the same hereby are
overruled and denied.

SECT! ON 3. That the cost of the repairs, as set forth
in said Report, shall be assessed against the properties described
therein, which properties front upon the il'1provement so
constructed.
SECT! ON 4. That if such assessment is not paid within
the time permitted by law, the same shall constitute a special
assessment and lien aQainst the properties therein described, in
the amount set forth in said Report, which lien shall continue
. until the assessment and all interest thereon is paid.
SECTION 5. That if the assessment is not paid within
the time permitted, the City Clerk shall deliver a Notice of Lien,
signed by the Super~ntendent of Streets, as provided in Section
5626 of the Streets and Highways Code of the State of California,
to the County Assessor and Tax Collector, who, in accordance with
applicable law. shall collect said assessment,together with all
other taxes relating to such property.
SECTION 6. That the City Clerk shall certify to the
adoption of this Resolution.
