SUBJECT: Setting February 26~ 1980, as the Date for Public Hearing on
the Assessment of Costs to Repair Damaged Sidewalks, Driveways
and Curbs
Introduction
ThlS report is requesting the City Council to set a public hearing for the
assessment of the costs to repair damaged sidewalks, driveways and curbs.
Background
On October 9, 1979, the City Council approved a sidewalk repair program which
provided for property owner participation in the cost of repairlng damaged
sidewalks (Item ll-C). Property owner participation was set at 50% of the
cost of the repairs, with the City to pay the remaining 50% of the cost of the
repair without regard to the reason for the damage.
Certain repair work has now been completed and the property owner's share of
the costs will now be due. A public hearing must be held pursuant to pro-
visions of Division 7, Chapter 22, Sections 5600 to 5630, of the Streets and
Highways Code for the State of California. A resolution setting the publlC
hearing for February 26, 1980 is attached.

It is recommended that the City Council adopt the attached resolution setting
a public hearing for February 26, 1980, on the assessment of costs of the
subject sidewalk repairs. fpD

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
t10NICA APPROVING THE FILING OF REPORT OF WORK AND
SETTING A HEARING DATE FOR ANY PROTESTS OR OBJECTIONS
TO THE REPORT OF THE SUPERINTENDENT OF STREETS REGARDING
REPAIR OF SID8~ALKS, DRIVEWAYS AND CURBS.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the Superintendent of Streets has filed a
report of work pursuant to Division 7, Chapter 22, Sections 5600 to 5630 of
the Streets and Highways Code of the State of California, relating to the
construction of certain improvements to sidewalks and driveways.
SECn ON 2. That pu"suant to Section 5600 et seq. of said code,

February, 1980, in the Council Chambers of the City Hall, it wl11 hear and
pass upon any and all objections or protests to the report of work of the
Superintendent of Streets and the amount of the assessment assigned against

SECTION 3. That all protests or objections must be 1n writing
and filed with the City Clerk on or before the time set for nearlng of
protests and objections.
SECTION 4. The City Clerk hereby is directed to mail notices,
in the manner and form prescribed by law) of the adoption of this resolution
to all persons owning real property affected by the sidewalk assessment
repair program, whose names and addresses appear on the last equalized assess-
ment roll for the clty taxes or as known to the City Clerk.

You are hereby notified that the City Council of the City of Santa Monica,
on the 26th day of February, 1980, at the hour of 7:30 p.m., in the Council
Chambers 1n the Santa Monica City Hall, 1685 Main Street, wlll hear and
pass upon a report by the Street Superintendent of the cost of the removal
and replacement of pce sidewalk as required by the City Council under
Division 7, Chapter 22, Sectlons 5600 to 5630 inclusive, of the Streets
and Hlghways Code of the State of California.

OF OBSTRUCTIONS, PERFORMED UNDER PROVISIONS OF DIVISION 7,
CHAPTER 22, SECTIONS 5600 TO 5630, INCLUSIVE, OF THE STREETS
AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA.(SR-80-l)
Pursuant to the provisions of Divislon 7, Chapter 22, Sections 5600
to 5630, incluslve, of the Streets and Hlghways Code of the State of Californla,
the following work was caused by the Street Superintendent to be done:
The removal of 1,859 square feet of PCC concrete and the
replacement of 1,715 square feet of PCC concrete within
the City of Santa Monica.
The total cost of the work was $5,361.00 based on a charge of $1.50 per square
foot to either remove or to replace pee concrete. The total proposed assess-
~ent 1S $2,680.50 or 50 percent of the total cost, the other 50 percent of
the cost belng pald by the City.
Reference 1S made to the attached sheets for a descrlption of the
real property in front of Wh1Ch the work has been done, the proposed assess-
ment against each property and a descrlptlon of the work done in front of
each property.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA CONFIRMING THE REPORT OF THE SUPER-
INTENDENT OF STREETS REGARDING REPAIRS TO DAMAGED
SIDEWALKS. DRIVEWAYS AND CURBS
WHEREAS. the Street Superintendent of the City of Santa Monlca, pur-
suant to Sectlon 5600 to 5630 of the Streets and Highways Code, commenced
proceedlngs to cause the repalr of damaged sldewalks. driveways and curbs
1n the City of Santa Monica, and
WHEREAS, sixty (60) days after sald order was served, the work had
not been completed by the owners or persons in possesslon of the affected
propertles, and the Superintendent of Streets caused the work to be done; and
WHEREAS, the Superintendent of Streets did file with the City
Council of the City of Santa Monlca his reports of such work, and a hearlng
thereon was called by Resolutlon No. 5483 (C.C.5.); and
WHEREAS, the City Council conducted a notlced hearlng to consider
any protests or obJectlons to the Reports of the Work.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Report of Work of the Superlntendent of
Streets heretofore filed and above described, be and the same is hereby
conflrmed.
SECTION 2. That all of said protests and obJections of every
kind and nature to the repairs or to the assessments and all appeals therefrom
to sald City Counell be and the same hereby are overruled and denled.

SECTION 3. That the cost of the repairs, as set forth ln said
Report, shall be assessed against the properties hereln described, which
properties front upon the improvement so constructed.
SECTION 4. That lf such assessment is not paid wlthln the
time permltted by law the same shall constitute a special assessment and
lien aga1nst the properties therein descf1bed, in the amount set forth
ln said Report, WhlCh lien shall continue unt1l the assessment and all
lnterest thereon is paid.
SECTION 5. That if the assessment 1S not paid within the
time permitted, the City Clerk shall deliver a Notlce of Lien, signed by
the Superintendent of Streets, as provided in Sectlon 5626 of the Streets
and Hlghways Code of the State of California, to the County Assessor and
Tax Collector, who, in accordance wlth appllcable law, shall collect said
assessment, together with all other taxes relating to such property.
SECTION 6. That the City Clerk shall certify to the adoption
of thlS Resolutlon.
