SUBJECT: Setting June 9 , 1981. as the Date for
Public Hearing on the Assessment of Costs
to Repair Damaged Sidewalks, Driveways.
and Curbs (SR-80-161
Introduction
This report requests the City Council set a public hearing for the
assessment of the costs to repair damaged sidewalks. driveways and
curbs.
Background
On October 9. 1979. the City Council approved a sidewalk repair
program wh i c h provided for property owner participation in the
cost of repairing damaged sidewalks (I tern 11- C 1 . Property owner
participation was set at 50% of the cost of the repairs; the Cl ty
will pay the remaining 50% of the cost of the repair without
regard to the reason for the damage.
Certain repair work has been completed and the property owners'
share of the costs will now be due. A public hearing must be held
pursuant to provisions of Division 7. Chapter 22. Sections 5600 to
5630. of the Streets and Highways Code for the State of
California. A resolution setting the public hearing for June 9.
1981 is attached.

setting a oublic hearing for June 9, 1981, on the assessment of

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA SETTING A
HEARlflG DATE FOR ANY PROTESTS OR
OBJECTI ONS TO THE REPORT OF THE
SUPERIflTENDEtH OF STREETS REGARDING
REPAIR OF SIDEWALKS. DRIVEWAYS AND
CURBS. (SR-80-16)
THE CITY COUflCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTIOt.J 1. That the Superintendent of Streets
will file a report of repair pursuant to Section 5617 of
the Streets and Highways Code of the State of
California. relating to the construction of certain
improvements to sidewalks and driveways all within the
City of Santa Monica.
SECTION 2. That pursuant to Section 5600 et
seq. of said code. the City Council does hereby order
and declare that on the 9th day of June. 1981, at 7:30
P.H. , in the Council Chambers of the City Hall, it will
hear and pass upon the report by the Superintendent of
Streets of the cost of repair. together with any
objections or protests. i f any. which may be raised by
any property owner liable to be assessed for the cost of
such repair and any other interested persons.
SECTION 3. That all protests or objections
must be in writing and filed with the City Clerk on or
before the tiMe set for hearing of protests and
objections.

SECn ON 4. The Superintendent of Streets is
hereby di rected to ma il notices, in the manner and form
prescribed by law, of the cost of repair and of the
adoption of this resol ution to all persons owning real
property affected by the sidewalk assessment repair
program, whose names and addresses appear on the last
equalized assessment roll for the City taxes or as known
to the City Clerk.
SECTION 5. The City Cl erk shall certify to
the adoption of this resolution and thenceforth and
thereafter the same shall be in full force and effect.
