Curbs (SR-80-15)
Introduction
The City Council set a Public Hearing for the assessment of costs
to repair damaged sidewalks, driveways and curbs at various areas
within the City. It is recommended the Council adopt the attached
Resolution confirming the assessment of costs.
Background
On February 24, 1981, the City Council set a public hearing for
March 24, 1981, on the assessment of costs to repair damaged
sidewalks, driveways and curbs within the City of Santa Monica.
Individual letters stating the cost of this improvement were
mailed to each property owner on March 13, 1981. Attached is
Resolution No. 6211 (CCS) setting the date of the Public Hearing
(Item 6-Fl.
Recomm end a t ion
It is recommended the City Council:
1. Open the Public Hearing;
2. Close the Public Hearing and overrule any protests; and
3. Adopt the Resolution confirming the assessments.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA SETTING A
HEARING DATE FOR ANY PROTESTS OR
OBJECTIONS TO THE REPORT OF THE
SUPERINTEt.lDENT OF STREETS REGARDING
REPAIR OF SIDEWALKS, DRIVEWAYS AND
CURBS. (SR-80-151
THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOllOWS:
SECTION 1. That the Superintendent of Streets
will fil e a report of work pursuant to Division 7,
Chapter 22, Sections 5600 and 5630 of the Streets and
Highways Code of the State of California, relating to
the construction of certain improvements to sidewalks
and driveways.
SECTION 2. That pursuant to Section 5600 et
seq. of said code, the City Council does hereby order
and declare that on the 24th day of March, 19B1, in the
Council Chambers of the City Hall, it will hear and pass
upon any and all objections or protests to the report of
work of the Superintendent of Streets and the amount of
the assessment assigned cgainst the real property
described in said report.
SEC TI ON 3. That all protests or objections
must be in writing and filed with the City Clerk on or
before the time set for hearing of protests and
objections.
SECTION 4. The Superintendent of Streets is hereby

directed to mail notices, in the manner and form
prescribed by law, of the adoption of this resolution to
all persons owning real property affected by the
sidewalk assessment repair program, whose names and
addresses appear on the last eQualized assessment roll
for the City taxes or as known to the City Clerk.
SECTION 5. The City Clerk shall certify to
the adoption of this resolution and thenceforth and
thereafter the same shall be in full force and effect.

Dear Property Owner:
This letter is notification that the City Council, on the
24th day of March, 1981, at 7:30 p.m. in the Council
Chambers in the Santa Monica City Ha 11 , 1685 Main Street,
wi 11 act on a report by the Street Superintendent of the cost
of the removal and replacement of sidewalk as required by
Divis~on 7, Chapter 22, Sections 5600 and 5630 inclusive, of
the Streets and Highways Code of the State of California.
The total cost of the work that was done at the abo\e
loci-tion is $225.00.
Your cost is $112.50, which is one hal f the total cost and
wi 11 be assessed against your property after confirmation of
the Street Superintendent's report. The City's policy is to
assess only once for the same improvement if caused by tree
damage. Therefore, you wi 11 not be assessed again for
repairs at this location if the damage is caused by tree
roots.
The above assessment is due and payable no later than April
23, 1981.
If the assessment is not paid by that date, the City has the
right to file a lien against the property.
The City will provide assistance for low-to-moderate income

REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS,
AND/OR REMOVAL OF OBSTR UCT! ONS , PERFORMED
UNDER PROVISIONS OF DIVISION 7, CHAPTER 22,
SECTIONS 5600 TO 5630, OF TH E STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORN IA
(SR-BO-15l
Pursuant to the provisions of Division 7, Chapter 22,
Sections 5600 to 5630, of the Streets and Highways Code of the
State of Cal Hornia, the following work was caused to be done by
the Street Superintendent:
The removal and replacement of
1020 square feet of PC concrete
on sidewalks;
The removal and replacement of
76 square feet of PC concrete
on driveways;
The removal and replacement of
6 lineal feet of PC concrete
curbing; and
The removal of 32 square feet
of PC concrete in the parkway.
The total cost of the work was $3,472.00, based on the following
charges:
Removal and replacement of:
PCC sidewalk . $3.00/sq.ft.
PCC drlVeway . $4.00/so.ft.
Type A Curb .$10.00/1. ft.
Removal only . $1.50/sq.ft.
The total proposed assessment for sidewalks damaged by tree roots
is $1,736.00 or 50 percent of the total cost. The other 50
percent of the cost is being paid by the City.

In addition, for sidewalk damage not caused by tree roots (100
percent of assessment being paid by the property owner), the
following work was done:
The removal and replacement of
108 squa re feet of PC concrete
on sidewalks;
The removal and replacement of
90 square feet of PC concrete
on driveways; and
The removal and replacement of
18 1 i neal feet of PC concrete
curbing.
The total proposed assessment
for non-tree rel ated damage to
sidewalks is S864.00.
The to tal proposed assessment
for this sidewalk assessment
district is 52,600.00.
Reference is made to the attached sheets for a
description of the real property in front of which the work has
been done, the proposed assessment against each property, and a
description of the work done in front of each property.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-80-15)
WHEREAS, the Street Superfntendent of the Cfty of Santa
Monica, pursuant to Section 5600 to 5630 of the Streets and
Highways Code, commenced proceedings to cause the repair of
damaged sidewalks, driveways and curbs in the City of Santa
Monica, and
WHEREAS, six ty days after said order was served, the
work had not been completed by the owners or persons in possession
of the affected properties, and the Superintendent of Streets
caused the work to be done; and
WHEREASi the Superintendent of Streets did file with the
Ci ty Council of the City of Santa Monica his report of such work,
and a hearing thereon was called by Resolution No. 6211 (CCS); and
WHEREAS, the City Council conducted a noticed hearing to
consider any protests or objections to the Report of Work;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECT! ON l. That the Report of Work of the
Superintendent of Streets heretofore filed and above-described. be
and the same is hereby confirmed.
SECTION 2. That all of said protests and objections of
every kind and nature to the repairs or to the assessments and all
appeals therefrom to said City Council be and the same hereby are
overruled and denied.

SECTION 3. That the cost of the repairs, as set forth
in said Report, shall be assessed against the properties described
therein, which properties front upon the improvement so
constructed.
SECTION 4. That if such assessment is not paid within
the time permitted by law. the same shall constitute a special
assessment and lien against the properties therein described, in
the amount set forth in said Report. which lien shall continue
until the assessment and all interest thereon is paid.
SECTION 5. That if the assessment is not paid within
the time permitted. the City Clerk shall deliver a Notice of Lien,
signed by the Superintendent of Streets, as provided in Section
5626 of the Streets and Highways Code of the State of California.
to the County Assessor and Tax Collector, who. in accordance with
applicable law, shall collect said assessment, together with al'
other taxes relating to such property.
SECTION 6. That the City Cl erk shall cert i fy to the
adoption of this Resolution.
