Introduction
The City Council set a Public Hearing for the assessment of costs
to repair damaged sidewalks, driveways and curbs at various areas
within the City. It is recommended the Council adopt the attached
Resolution confirming the assessment of costs.

On May 12, 1981. the City Council set a public hearing for June 9,
1981, on the assessment of costs to repair damaged sidewalks,
driveways and curbs within the City of Santa Monica. Individual
letters stating the cost of this lmprovement were malled to each
property owner on May 29. 1981. Attached is Resolution No. 6253
(CCS) setting the date of the Public Hearing (Item 6-D).
Recommendation
It 1S recommended the C1ty Council:
1. Open the Public Hearing;
2. Close the Public Hearing and overrule any protests; and
3. Adopt the Resolution confirming the assessments.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA SETTING A
HEARING DATE FOR ANY PROTESTS OR
OBJECT! ONS TO THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING
REPAIR OF SIDEWALKS, DRIVEWAYS AND
CURBS. (SR-80-16)
THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the Superintendent of Streets
will file a report of repair pursuant to Section 5617 of
the Streets and Highways Code of the State of
Cal Horn i a, relating to the construction of certain
improvements to sidewalks and d r i v ew ay s all within the
City of Santa Monica.
SECTION 2. That pursuant to Section 5600 et
seq. of said code, the Ci ty Council does hereby order
and dec1are that on the 9th day of June, 1981, at 7:30
P.H. , in the Council Chambers of the City Hall. it will
hear and pass upon the report by the Superintendent of
Streets of the cost of repair, together with any
objections or protests. if any, which may be raised by
any property owner liable to be assessed for the cost of
such repair and any other interested persons.
SECTION 3. That all protests or objections
must be in writing and filed with the City Clerk on or
before the time set for hearing of protests and
obj ect ions.

SECTI ON 4. The Superintendent of Streets is
hereby di rected to mail notices, in the manner and form
prescribed by 1 aw. of the cost of repair and of the
adoption of this resolution to all persons owning real
property affected by the sidewalk assessment repair
program, whose names and addresses appear on the last
equal ized assessment roll for the City taxes or as known
to the City Clerk.
SECTION 5. The City C 1 e r k shall certify to
the adootion of this resolution and thenceforth and
thereafter the same shall be in full force and effect.

TO CITY COUNCIL
REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS, CURBS,
AND/OR REMOVAL OF OBSTRUCT! ON S, PERFORMED
UNDER PROVISIONS OF DIVISION 7, CHAPTER 22,
SECTI ONS 5600 TO 5630, OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF CALIFORN IA
(SR-80-16 )
Pursuant to the provisions of Division 7, Chapter 22,
Sections 5600 to 5630, of the Streets and Highways Code of the
State of Cal ifornn. the following work was caused to be done by
the Street Superintendent:
The removal and replacement of
830 square feet of PC concrete
on sidewalks;
The removal and replacement of
192 square feet of PC concrete
on driveways;
The removal and replacement of
51 lineal feet of PC concrete
curbing; and
The removal of 158 square feet
of PC concrete in the parkway.
The total cost of the work was $4,005.00, based on the following
charges:
Removal and replacement of:
pec sidewalk . $3.00/sq.ft.
PCC driveway S4.00/sq.ft.
Type A Curb .$10.00/1. ft.
Removal only Sl . 50/sq. ft.
The total proposed assessment for sidewalks damaged by tree roots
is $2,002.50 or 50 percent of the total cos t. The other 50
percent of the cost is being paid by the City.

In addition, for sidewalk damage not caused by tree roots (100
percent of assessment being paid by th e property owner), the
following work was done:
The removal and replacement of
122 square feet of PC concrete
on sidewalks;
The replacement of 117 square
feet of PC concrete on sidewalks;
The removal and replacement of
18 lineal feet of PC concrete
curbing; and
The removal of 117 square feet
of PC concrete.
The total proposed assessment for non-tree related damage
to sidewalks is $897.00 based on the above costs. The total
proposed assessment for this sidewalk assessment district is
$2,899.50.
Reference is made to the attached sheets for a
description of the rea 1 property in front of which the work has
been don e, the proposed assessment against each property. and a
description of the work done in front of each property.

SUPERINTENDENT OF STREETS REGARDING REPAIRS TO

WHEREAS, the Street Superintendent of the City of Santa
Monica, pursuant to Section 5600 to 5630 of the Streets and
Highways Code, commenced proceedings to cause the repair of
damaged sidewalks, driveways and curbs in th e City of Santa
Monica; and
WHEREAS, six ty days after said order was served, the
work had not been completed by the owners or persons in possession
of the affected properties, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by Section 5616 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets did file with the
City Council of the City of Santa Monica his report of ~epairs and
cost as reauired by Section 5617 of the Streets and Highways Code;
and
WHEREAS, upon the day and hour fixed for hea ri ng by
Reso1ution Number 6253 ICCS). the City CouncfJ of the City of
Santa Monica heard and passed upon the report of the
Superintendent of Streets together with al1 obj ecti ons and
protests as required by Section 5618 of the Streets and Hlghways
Code;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOllOWS:
SECTION 1 . That the report of the Superintendent of
Streets he reto fo re filed and above-described be and the same is
hereby confirmed.
SECTION 2. That all protests and objections of every
kind and nature to the report of the Superinte~dent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repairs, as set forth
in the report of the Superintendent of Streets, shall be assessed
against the properties therein described, which properties front
upon the sidewalk upon which the repairs were made.
SECT! ON 4. That if such assessment is not paid within
the time permitted by 1 aw, the same shall constitute a special
assessment against and lien on the properties therein described,
in the amount set forth in the report of the Superintendent of
Streets, which lien shall continue until the assessment and all
interest thereon is paid or until it is discharged of record.
SECT! ON 5. Th at if the asssessment is not paid within
the time permi tted by 1 aw, the Superintendent of Streets, in
accordance wi th Section 5628 of the Streets and Highways Code,
shall deliver a Notice of Lien, prepared in the manner required by
Section 5626 of the Streets and Highways Code, to the County
Auditor who shall collect the assessment together with all other
taxes against the property.

presented the (oune,l with information that lndicated that a large lncrease in
~he amount of sidewalk repairs would be needed to reduce the number alid c.mount
of sidewalk injury liabillty e1alms. The staff reco~mended and the Cour,cll
approved a program which provlded funds so tnat a much greater s1del'/alk repair
program could be undertdkeD. The recommendation provided for property owner
participatlon by assessment for a portlOn of the repairs. The staff recommended
that this participatlon be 50~ of the cost of the repairs with the City to pay
the remaining 50~; of the cost of the t'epctlr without regard to the reason rOr'
the damage.

T~e program \'~h1Ch was approved by Council durHig the budget heanngs 1S
currently being administered, under provision of Chapter 22 of the Improvement
Act,of 1911 (a State Law) and 51 property owners have been given notices
to repa1r their sidewalks. Under t~is Act a for~al PubllC Hearing is held
after the work is done. Three residents have requested to speak to this
issue before the work 1S done. Of the 51 properties not,ced, 13 have requested
that the City proceed with the work and have requested that they be b,lled
for their 50% portion. Several of these Sidewalks have already been repaired
as requested. Three property owners have protested and have been glven
notice of this agenda ltem. In general, their protest centers on the following:
1. That the property owner had requested repairs to be do~p many
mOflths ago, before the polley was cflanged; therefore. they e>.pect
that those repa1rs should be included in the old policy rather
than be1ng assessed. Staff's response lS that all of the repairs
for whieh we are sendlng notlces have been needed for many months,
and all of the repairs would theoretleally fall under the prevlDus
policy if thlS reasonlng were used.
2. CitlZens are camp131n1ng that the City has 111dde temOOt'ilry repalrS
dun n9 the past several nJ011tfJS and that the perrnanent repa 1I'S shou 1 d
now be made at no cost to them, using similar reasoning to Item 1,
above.

to replace the assessments.
Recommendatlon
It is recollllllended that the City Councll authorize staff to continue 1'l1th
the sider/alk repalr assessment program dnd to assess the pr'operty owner's
for 50% of the cost of the sldewalk repalrs without regard to what hdS
caused the damage.

This reoort provides the Council with an explanation of the current sidewal~
repair assessment program.

Recently, City staff has recelved an increaslng number of complalnts concerning
the sldewalk repair assessment program. Staff would ll~e to take this opportunlty
to inform the Council of both the history of and the procedures used to carry
out the sldewalk repair program.
A. History
Previous sidewalk repalr policy has been to try to dlfferentlate the reasons
for damage to sidewalks. The property m~ner ;.,as assessed 1 f the d.'1J11age was
due to normal deterloratlon and the City would pay for the repalrs lf the
damage was caused by street trees. ThlS POllCY was very dlfflcult to administer
as it was not easy to determine what caused the damage to the sldewalks. In
1977, the Councll ordered an end to the POllCY. From that tlme up to July 1,
1979, the Clty dld not assess any property owners for side\~alk repairs.
During the 1979-80 budget hearlngs, Clty staff prese'lted the Councll \lith
informatlon that a large increase In the amount of sldewa1k repalrs would

ThlS participatlon would consist of th.e property owner paying for
50% of the cost of the reoairs wlth the City paying the remaining

The City Councll approved this shared particlpation and the progra~
is currently being administer~d under the provisions of Chapter 22
of the Improvement Act of 1911."'
B. Present Program
Administratlvely, the City is divided into 12 dlstrlcts for the purpose
of inspecting sldewalks, curbs and driveway approaches. Each mOl1th,
the street lnspectors walk one district noting all areas in which
repairs are needed. The street lnspectors prepare a Notice-to-Repalr
and photograph the area in need of repair. A copy of the photograph and
notice are sent to the Director of General Services for his reVlew.
Attached are the documents sent to the property owners notifYlng them
of a hazardous condltlon.
At this time, the property owner can choose elther to do the work
himself or to authorize the Clty to do the work. If the owner chooses
to do the work, the City will provide the concrete required to co~plete
the proJect; if the Clty does the work, the City wll1 contribute one-
half the cost of the work.

Sclction 5416 of the Streets and Hlghways Code spec1fically states ''If
the repair 1S not cCrn72nced withir two wee~s after notice lS given
and diligently and without interrupt10n prosecuted to completion. the
superintendent of streets shall make such repair. and the cost of
the same shall be a 1 i en on the property". However, if the owner
contacts staff, an extension of tlme to begin the work is granted,
i f needed. rhe property OI-mer may sign an authonzatlOn form authorizlng
the City to do the work. If the owner does not contact the City and
the work is not begun, the City will do the work and assess the property
owner.
After the City has co~pleted the work, as~essment proceed1ngs are begun.
A letter is mailed to the property owner not1fYlng h1m of the proposed
a~seSSffient cost and the date of the public hearlng. At the time of the
public hearing, the owner may protest the I'fork and the assessment. If
the assessment 1S conf1rmed by the City Councll, a second notlce lS
sent to the owner inform1ng him of the assessment, that he has 30 days
in Wh1Lh to pay (State law actually allows only 5 days - Sectlon 5625)
and that the Clty will provide ald to low-to-moderate income persons.
Attached are the documents sent to property owners not1fying them
of the assessment proceedings. If the assessment 15 not paid, the
City uses an alternative method of collectlon as provlded under Sectlon
5628. ThlS section provldes that ln the case of any unpaid assessments,
the lien is turned ove, to the County Assessor where it is lncluded as
a direct assessment on the next tax bill as opposed to filing the llen
wlth the County Recorder Thereafter, 1t 15 subject to the sawe
penalitles and lnterest and to the same procedure under foreclosure and
sale in the case of dellnquency as County taxes.

Presently the assessment co~ts are based o~ the following charges:

Removal and replacement of pee driveway $4 sq ft.
Removal and replacement of Class A curb $10 lin. ft.
Removal of pee parkway $1. 50 sq. ft.
Item 8-C on the October 14, 1980 agenda ~s an ordinance for introduction
which would allow resurfac1ng pennlt fees and work charges to be set
by resolution. Accompanying the ordlnance is a resolution which would
increase the wor~ charges to current cests. Assessment costs would be
increased to equal those new charges .-"

Section 5610 of t,:e Street:; "rid }Jlgh\./ays Code states: liThe owners of lots
or portions of lots fronting on any portion of a public street or place is
improved...shal1 maintain 3ry sidewalk in such a condition that the sidewalk
will not endanger persons or property and maintain it in a condit1cn WhlC~
will not interfere with the public convenience in the use of those wor~s
or areas... " It is, therefore, the property owner's responsibility by
state law, to rnalnta1n the sidewdlks in a safe condition if given notice
of a dangerous situatlon by the City.
2. Property owners also complaln that the damage is caused by tree roots.
They argue that the trees belong to the City and the City should pay for
the damage. The City's position is that property owners have a choice in
the selection of street t'"ees. The trees are beneficial both to the c1ty
and property owner and therefore joint participation is called for.
Item 5-L on the October 14, 1980 agenda is a request by Coullcilmember
Jennings for discussion regarding direct1ng the City Attorney to revise
the Tree Ordina~ce to ellffiinate proble~ trees from the C1ty'S list of
approved trees. Staff reco~meDds Counc11 approve this request in that the
approved 11st is 17 years old and many complaints have been received
concerning the type of trees planted. W1th an lncrease in tbe nu~ber of
tree planting distr1CtS and the increased act1v1ty ln the sidewalk renair
prograr~, thlS would be a good time to receive input f,oC! the public Oil
the type of trees approved to be planted 1n the City.
3. Property owners also compla1n about the frequency of assessrne'lts. City
policy is such that 1f an owner has been assessed once for sidewalk
repalrs for a partlcular site he will not be assessed agaIn if that sar.e
site needs repa1r.

City's contractor does the work. If the property owner decides to make the
repairs, the Clty will prov1de the necessary concrete.

The primary goal of the sidewalk re~air prosra~ is ~o eli~inate tri~ping
hazards or other darserous conc~:10r.S for w~ich the City could be re'd iiable.
