Introduction
This report requests that the City Council hold a public hearing for
the assessment of costs to repair damaged sidewa~ks, driveways and
curbs at ~ariaus locations within the City. It is xecominended ~hat
the City Council adopt the attached Resolution confirming the
assassment Qf costs.
Background
On January 24, 1989, the Ci.ty Council set a public hearing for
February 28~ 1989, on the assessment of costs to repair damaged
sidewalks, driveways and curbs within the City of Santa Monica.
Notices were sent on February 17, 1989 to property owners ~nforming
them of the public hEaring in accordance with the legal requirements
of Chapter 22 of the Improvement Act of 1911.
Budget/Financial Ympact
This assessment district will generate revenues to the City over the
next two years in the amount of $5,146.50. Any unpaid assessments
wi~1 be plac~d on the FY1989-1990 property tax bill.

It is recommended the City Council:
l. open the public hearing;
2. Close th~ pub~~c hearing;
3. Acknawledge any protests and adopt the attached Resolution

Pursuant to Streets and Highways Code Section 561b, this letter is
natification that the City Council, pursuant to Resolution No. 7751
(CCS) adopted on January 24, 1989~ has scheduled a hearing to hear and
pass upon the report of the Superintendent of Streets of the cost o~
the sidewalk repair, in connection with the abave-described project,
together with any ob~ections and protests, if any, which may be raised
by any property owner liable to be assessed far the cost of such
sidewalk repair and any ather interested persons.
The hearing will be held as follows:

Any protests or objections must be in writing and must be fa.].ed with
the City Clerk on or before the time set for the hearing.
Upan confirmation of the repart of the Superintendent of Streets, as
provided for in Streets and Highways Cade Section 5618, the cost of
the sidewalk repair will be assessed against your property, and yau
wi11 be notified of the manner of payment. The City will pravida
financial assistance for low-to-moderate income persons. If your
income is less than $19,900 for a family of one person, $22,700 for
two persons, $25,550 for thrae persons or $28,400 for four persons,
call 458-$7d1 for information on this program.

Pursuant to the pravisions of Division 7, Chapter 22, Sections
560a of 5630, of the Streets and Highways eode o€ the State of
California, the following work was caused to be dane by the Street
Superintendent:
The removal and replacement of 1,59D square feet of s~dewalk
at $4.00 per square foot;
The removal and replacement of 377 square feet of sidewalk in
driveway at $5.00 per square foot;
The removal and replacement of 160 square feet of driveway
apron at $5.00 per square foot;
The removal and replacement of 72 linear feet of curbing at
$10.40 per linear foot;
The removal af 264 square feet of concrete at $2.Oa per square
foot;
The tatal cast of the above work was $10,293.00.
The total propased assessment for the above sidewalk and curb
damage is $5,146.50 or 50 percent of the total cvst. The other 5~
percent of the cast is being paid by the City as the above repairs
were caused by tree root damage.
Reference is made to the attached sheets for a description of the
rea~ praperty in front of wh~.ch the work has been done, the proposed
assessment against each property, and a description of the work done
in front of each property.

WHEREAS, the Superintendent of Streets of the City of Santa
M~nica, pursuant to Sections 5600-5630 a~' tha Streets and Highv,~a~rs
Code, commenced proceedings to cause the repair o~ damaged sidewalks,
driveways and curbs in the City of Santa Monica at 1054 Princeton
Street, 1024 Princeton Street, 2632 Montana Avenue, 83D Pr~nceton
Street, 846 Princeton Street~ 904 Princeton Street, 9I2 Princeton
Street, 942 Princeton Street, 2621 Washingtan A~enue, 2535 Wilshire

WHERE.~S, sixty days after said arder was served, the wark had not
laeen completed by the owners or persans in possession of the affected
properties, and the Superintendent of Streets caused the work to be
done; and
WHEREAS, the Superintendent of Streets gave natice as required by
Section 5616 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets did file with the City
Council of the City of Santa Monica a report of repairs and costs as
required by Sectian 5617 of the Str$ets and Highways Code; and
WHEREAS~ upon the day and haur fixed for hearing by Resoluti~n
Number 775~ (CCS), tha City Caunci~ of the City o~ Santa Monica heard
and passed upon the repart af the Superintendent of Streets together
with all objectians and protests as required by Section 56~8 of the
Streets and Highway Code,
NOW~ THEREFORE, THE CITY C~UNCIL OF THE CITY OF SANTA MONICA DOES
RES~LVE AS FOLLOWS:
SECTION 1. The report of the Superintendent of Streets haretofore
filed and above-described be, and the same hereby is, confirmed.
SECTION 2. All protests and abjections of every kind and nature
to the report of the Superintendent o~ Streets be and the same h~reby
are, overruled and denied.
SECTION 3. The cost of the repairs, as set ~arth in the report of
the Superintendent of Streets, shall be assessed against the
properties tharein described, which properties front the sidewalk upan
which the repairs were made.
SECTION 4. If such assessment is not paid within the time
permitted by law, the sama shall constitute a special assessment
against and lien an the properties therein described in the amount set
forth in the report of the Superintendent of streets, which li~n shall
continue untiZ the assessment and all interest thereon is paid or
until it is discharged of record.
SECTION 5. If the assessment is nat paid within the time
permitted by Iaw, ~he 5uper~ntendent of Streets, in accordance with
Sect~on 5628 of the Streets and Highway Code, shall deliver a Notice
of Lien, prepared in the manner required by Section 5626 af the
Streets and Highways Code, to the County Anditor who shal~ collect the
assessment together with all other taxes against the groperty.
SECTIDN 6. The City Clerk shall certify ta the adoptian of this
Resole~t~on, and thenceforth and thereafter the same shall be in full
force and effect.

The assessment for re~air of our sidewalk (se~ enclosed noticej is
not apprvpriate far the fal~owing reasons:
1) We were never noti~ied in advance of the impending
repair.
2) The repa~rs on aur pcoperty were an unnecessary
egtension of repairs to aur neighbor's sidewalk.
3) The warkers damaged our driveway and made no attempt
ta repair the damage. Using their cement sa~v they

3) The workers damaged our driveway and made no aitempt

severed a seven foot sect~an of ~~crete at the end o~' our
driveway up on aur property. The seven foat cut ~s stiil
there.
